State Environmental Protection Administration Announcement No. 60 in 2005 of the State Environmental Protection Administration on Announcement on the Prohibition of Production and Use of the Substance that Depletes the Ozone Layer [2005] No.60 In order to protect the ozone layer, the international community formulated the Montreal Protocol on Substances that Deplete the Ozone Layer (hereafter referred to as the Protocol) in 1987, and China acceded the Protocol (London Amendment) in June 1991. And in accordance with the provisions in the Protocol, China shall gradually reduce and eventually completely cease the production and use of substances that deplete the ozone layer as of the year of 1999. The Chinese National Program for Phasing-out the Substances that Deplete the Ozone Layer (Amendment) approved by the State Council in 1999 prescribes the plan and objective of phasing-out the substances that deplete the ozone layer for the relevant industries, and prescribes the mode as a phasing-out in a whole industry. In accordance with the aforesaid provisions, China shall cease the production and use of the substance that deplete the ozone layer--CFC-113 as of the date of January 1, 2006. In order to implement the National Program approved by the State Council, it is hereby decided that the production and use of CFC-113 shall be prohibited nationwide as of the date of January 1, 2006. Any unit or individual, who, in violation of the aforesaid decision, continues the production and use of CFC-113 shall be treated by the local environmental protection authorities together with other relevant authorities in accordance with laws and regulations.
