PROVISIONS OF THE SPECIAL ECONOMIC
ZONES IN GUANGDONG PROVINCE FOR THE CONTROL
OF PERSONNEL ENTERING AND LEAVING CHINA

[Article 1] These Interim Provisions are formulated in accordance with the pertinent laws and decrees of the People's Republic of China and the Regulations on Special Economic Zones in Guangdong Province.
[Article 2] All foreign
nationals, overseas Chinese and compatriots from Hongkong, Macao
and Taiwan
who enter the special economic zones at the national
open ports located in the special zones or at the open ports
for
special use by such zones and who leave the country via the special
zones are subject to control
in accordance with these Interim Provisions.
Those who enter the country at such national open ports and proceed
to other parts of China, and those who come from other parts of
China and leave the country via the
special zones, shall continue
to be subject to already existing provisions.
All personnel who enter and leave China shall accept inspection
by the inspection offices at the ports.
[Article 3] Depending on their differing circumstances, personnel entering the special zones from Hongkong and Macao shall go through the entry procedures in accordance with the following provisions:
(1) Foreign nationals and overseas Chinese shall go through the procedures for applying for entry and exit by presenting their passports through the tourist agencies or other agencies in Hongkong and Macao that have been authorized by our side to handle such matters, and they shall be granted visas by our visa-granting offices. The frontier inspection stations shall give clearance after inspection of the visas.
Foreign nationals and overseas Chinese who set up factories or establish other undertakings in the special zones with their own investment and those who have bought houses or live there for extended periods, and therefore need to enter and leave the special zones frequently, may apply for multiple entry-exit visas, by presenting a certificate issued by the relevant special zone development company.
(2) Clearance shall be given to compatriots from Hongkong and Macao after inspection of their Home Visit Certificates for Hongkong and Macao Compatriots and the attached sheets or cards. Those Hongkong and Macao compatriots who set up factories or establish other undertakings in the special zones and those who have bought houses or live there for extended periods, and therefore frequently need to enter and leave the special zones in the same day, may apply by presenting a certificate issued by the relevant special zone development company or their Residence Permits for Hongkong and Macao Compatriots, which shall be signed by the special zone (municipal) public security bureau, without having to fill in the attached sheets or cards. The Customs office may issue to those who are permitted not to fill in the attached sheets or cards a long-term registration booklet for articles for personal use, which shall be filled in by the owners, and Customs clearance shall be given after verification.
(3) Taiwan compatriots who wish to enter the special zones via Hongkong or Macao may go through the procedures for applying for entry and exit by presenting their personal identification papers through the tourist agencies or other agencies in Hongkong or Macao that have been authorized by our side to handle such matters, and they shall be issued entry and exit papers by our visa-granting offices.
[Article 4] Foreign nationals who apply directly for entry into the special zones from other countries or regions (not including Hongkong and Macao) must have visas issued by our visa-granting offices, and clearance shall be given after inspection of the visas.
[Article 5] Group visas may be issued to tourist groups of foreign nationals and overseas Chinese who wish to make tourist trips to the special zones from Hongkong or Macao, and clearance shall be given after inspection of the visas.
[Article 6] Those foreign nationals, overseas Chinese and compatriots from Hongkong, Macao and Taiwan who have bought houses in the special zones or live there for extended periods shall be issued, respectively, Temporary Residence Permits for Foreigners or Temporary Residence Permits for Overseas Chinese and Compatriots from Hongkong, Macao and Taiwan by the relevant special zone (municipal) public security bureau, if their period of residence in the zones is between six months and one year; Foreigners' Residence Permits or Residence Permits for Overseas Chinese and Compatriots from Hongkong, Macao and Taiwan shall be issued to them, respectively, if their period of residence is more than one year. The permits shall be examined once every year.
[Article 7] The luggage and articles belonging to personnel entering the special zones from Hongkong or Macao or from foreign countries shall be handled in accordance with relevant control provisions of the Customs Administration of the People's Republic of China for the special economic zones.
[Article 8] Upon entering the country, all personnel and articles from epidemic areas and all objects subject to quarantine under the Regulations of the People's Republic of China on Health Quarantine and the Regulations of the People's Republic of China on the Quarantine of Animals and Plants shall be subject to inspection by the port authorities in charge of health quarantine and the quarantine of animals and plants.
[Article 9] Foreign nationals who enter other parts of China from the special zones or enter the special zones from other parts of China shall go through the relevant procedures in accordance with already existing provisions.
[Article 10] All means of transport and communication that run between the special economic zones and Hongkong and Macao must be approved by the relevant special zone (municipal) people's government and issued a traffic permit by the special zone (municipal) public security bureau; clearance shall be given after inspection.
[Article 11] The entry and exit procedures for cadres, staff and workers and other personnel from our side who work in the special zones shall continue to be handled in accordance with already existing provisions.
[Article 12] These Interim Provisions shall come into force on January 1, 1982.
