Notice on Relevant Issues concerning the Introduction of the New Edition of Import License for Solid Wastes that Can Be Used as Raw Materials [2005] No.47 The examination and approval work for wastes import of State Environmental Protection Administration and the Electronic Port of China Customs shall formally be integrated in one networking as of October 10, 2005. The Notice is hereby given on relevant issues concerning the introduction of the new edition of Import License for Solid Wastes that Can Be Used as Raw Materials for the purpose of guaranteeing the smooth carrying-out of this work.
I. The new edition of Import License for Automatically permitted and Restrictive Solid Wastes that Can Be Used as Raw Materials (hereinafter referred to as "the license", and sample annexed) will be introduced by State Environmental Protection Administration as October 10, 2005. In the meanwhile, the issuing of wastes import license of the old edition (including the automatically-permitted and the restricted) shall be ceased, and the previous issued wastes import license of the old edition may continue to be used in accordance with the former provisions during the period of validity.
II. The customs shall handle the declaration and clearance procedures on the basis of wastes import license in paper, for the wastes import license of the old edition is not electronically networked. Where the customs is doubtful about the content in the license, it may contact the Wastes Import Registration Management Center of State Environmental Protection Administration for the verification of the validity of the license hereof. The wastes import license of the old edition shall all and singular become invalid as of April 1, 2006, and the customs and the departments of inspection and quarantine shall not handle the declaration and the inspection procedures on the basis of the license hereof. The institution, holding such the wastes import license of the old edition as is in the period of validity and possesses of balance, may, upon the license hereof and in the period of from March 1, 2006 to March 31, 2006, directly apply to the environmental protection bureaus (departments) of the provinces, autonomous regions and municipalities directly under the Central Government for changing to the license of the new edition, and it is required to offer information demanded by the license of the new edition; and herein the environmental protection bureaus (departments) of the provinces, autonomous regions and municipalities directly under the Central Government shall collectively transfer them to the Wastes Import Registration Management Center of State Environmental Protection Administration to be handled.
III. The license of the new edition shall be effective in the year concerned; and in case of special demand for using it over the year, the period of validity shall not surpass March 31 of the next year.
IV. Where the authorized volume in the license fails to be used up in the period of validity, the licensee institution concerned may, within the period of validity, apply to the issuing authorities for prolongation. The issuing authorities hereof shall draw back the former license and reissue a new license after the deduction of the used volume.
V. Except such wastes import license of the old edition as can continue to be used within the period of validity, the customs of all ports shall examine the enterprises' licenses in paper and other import documents in accordance with the electronic licenses issued by State Environmental Protection Administration and handle the declaration of the enterprises hereof.
VI. Except the import of waste paper, other imported solid wastes shall be declared at the first import port customs specified in the license in the zone of customs directly under the GAC.
VII. Where the wastes import concerns more than one licenses, the customs declaration notes for imported goods shall be filled out separately, i.e. one declaration note for imported goods only corresponds to one license.
VIII. The license can be used for many times in customs declaration; for each lot of imported wastes, the customs shall conduct volume deduction in paper document and electronic data on the basis of the actual import quantity; and where the columns for customs signing in the paper document are used up, the customs shall, without reference to whether balance still exists in the license, manually settle the electronic data of the license. For the last lot of imported goods, the excess volume shall be calculated on the basis of the actual balance of the license hereof and of within 3% of the prescribed maximum excess.
IX. For each case of customs declaration, the customs shall retain and file the duplicated copy of the license and the declaration notes for record; for the last case of customs declaration, the customs shall draw back the original copy of the license and file it with declaration notes for record.
X. The unit of measurement used in the declaration note for imported goods shall be in conformity with the one used in the license.
