THE IMPORTATION OF GOODS FOR EXHIBITIONS BY THE COSTOMS
OF THE PEOPLE'S REPUBLIC OF CHINA

CHAPTER I GENERAL PROVISIONS

[Article 1] These Procedures are to ensure the effective implementation of state policies in the control of foreign trade and to facilitate foreign countries' exhibitions in China.

[Article 2] The import exhibits referred to in these Procedures include those transported into our country by foreign countries for the purpose of holding economic, cultural, scientific, technical and other exhibitions in China as well as publicity materials, decoration materials, service materials, small articles for sale and all other articles relating to the exhibitions.

[Article 3] The unit which accommodates a foreign country in its holding of an exhibition in China shall send a duplicate of the relevant instrument of approval in advance to the Customs house at the place of exhibition.

[Article 4] Import exhibits shall be put under the supervision of the Customs Service and go through the Customs formalities as stipulated in these Procedures.

[Article 5] When the Customs dispatches officers to the place of exhibition to carry out supervision duties, the exhibition or host organization shall provide them with offices and necessary office equipment.

CHAPTER II DECLARATION AND EXAMINATION OF EXHIBITS

[Article 6] Before the importation of the exhibits, the exhibition organization or its agent shall translate the exhibit list in duplicate into Chinese which should include such contents as marks, numbers, number of packages, weight, names, specifications, quantities, prices, etc., and declare them at the Customs house.

[Article 7] When the exhibits are imported, the exhibition organization or its agent shall submit a foreign goods transfer permit, a bill of lading (or a waybill) and a loading list for further conveyance to the Customs house at the place of entry and after they are examined by the Customs, transfer them to the place of exhibition as "the goods under the supervision of the Customs".

Approval from the Customs is needed when the exhibits are required for some reason to be moved out of the place of exhibition.

[Article 8] The exhibition organization shall notify the Customs before opening the cases of exhibits so that the Customs officers can be present for examination.

When the Customs officers examine the exhibits, the exhibition organization or its agent shall be present.

[Article 9] The exhibition organization shall submit in advance to the Customs house at the place of exhibition for examination and approval the publicity materials and technical data for exhibition or use, including movies, slides, sound recording tapes, video recording tapes, discs, photos, maps, manuals, advertisements, etc. and only after approval shall they be allowed to be exhibited or used.

Publicity materials and technical data which denigrate the politics, economy, culture, morality, etc. of the People's Republic of China shall not be exhibited or used and shall be confiscated, returned abroad or the exhibition organization shall be ordered to amend them before use as the case may be.

[Article 10] If there are some articles in the exhibits which shall be controlled as stipulated by other decrees of the People's Republic of China, the exhibition organization or its agent shall go through examination or approval formalities in accordance with the provisions of those decrees concerned.

CHAPTER III USE, PRESENTATION, SALE AND DISPOSAL OF EXHIBITS

[Article 11] The cigarettes, wine and food transported in by the exhibition organization used for serving in the exhibition shall be used duty-free after verification and approval by the Customs, but shall not be transferred, sold or used for other purposes.

[Article 12] The odd souvenirs or demonstration articles presented by the exhibition organization to the spectators and working personnel shall be examined and approved by the Customs before presentation.

[Article 13] If any exhibits are to be presented as gifts or samples, the exhibition organization shall report the objects of presentation to the Customs and go through exemption or taxation formalities in accordance with the Customs provisions for the administration of import gifts.

[Article 14] For all small articles for sale in the exhibition, the exhibition organization shall submit the permit signed and issued by the administration authorities of foreign trade of the People's Republic of China to the Customs for examination and pay the Customs duties and industrial and commercial consolidated tax.

[Article 15] The following principles shall be applied to the exhibits to be sold by the exhibition organization:

(1) If the exhibits are to be sold to foreign trade import and export corporations of our country, the corporations concerned shall conduct the import formalities at the Customs.

(2) If the exhibits are to be sold (or presented) to the embassy or consulate of other countries in China or their diplomats, the embassy or consulate or diplomats concerned shall conduct the import formalities at the Customs.

(3) If they are to be sold to other Chinese or foreign organizations or individuals, the exhibition organization shall apply to the administration authorities of foreign trade of the People's Republic of China for permits and they shall be examined, taxed and cleared by the Customs in accordance with the permits.

[Article 16] For the exhibits to be waived, the exhibition organization shall report their categories, quantities and values to the Customs.üü If there is any takeover unit, the takeover unit shall go through Customs formalities; if there is no takeover unit, they shall be disposed of by the Customs according to directions.

[Article 17] After the exhibition has closed, the exhibition organization shall submit a disposal list of exhibits in time to the Customs house at the place of exhibition, which should separately list the details of consumption, presentation, sale, disposal, re-export, etc.

CHAPTER IV TRANSFER AND RE-EXPORT OF EXHIBITS

[Article 18] If the exhibition organization is to transfer the exhibits to another part of our country for another exhibition, it shall go through transfer formalities at the Customs as provided for in Article 20 of these Procedures.

[Article 19] The exhibits to be re-exported shall be re-exported within three months from the date of the closing of the exhibition.üü If the exhibition organization fails to carry out the re-export as scheduled, it shall apply to the Customs for extension of time.üü Those exhibits which are not re-exported abroad within the said time limit shall be disposed of by the Customs in accordance with the regulations.

The exhibits re-exported as scheduled shall be exempted from Customs duties.

[Article 20] When the exhibits are transferred or re-exported, the exhibition organization or its agent shall submit to the Customs a foreign goods transfer permit and a loading list in duplicate and go through transfer formalities as "the goods under the supervision of the Customs".
