Regulations of the Shenzhen Special Economic Zone on the
Appearance of the City and
Environmental Sanitation

of the Shenzhen Municipal People' s Congress on July

|
Chapter I General
Provisions
|
|
Article 1 In
order to strengthen the administration of the appearance of the
city and environmental sanitation
of the Shenzhen Special
Economic Zone (hereinafter referred to as "the Special
Zone" ) and build
a clean, beautiful and civilized city, these
regulations are formulated hereby in accordance with the basic
principles of the related law and rules as well as in the light
of the practical conditions of the
Special Zone. |
|
Article 2 The
responsible administrative department of urban management of the
Shenzhen Municipal People'
s Government shall be in charge of
the administration of the appearance of the city and
environmental
sanitation for the whole city. The responsible
administrative departments of urban management of all districts
and the offices of townships, neighborhoods shall be in charge
of the administration of the appearance
of the city and
environmental sanitation within the areas under their respective
jurisdiction. |
The municipal and district departments in charge of
public land planning, environmental protection, construction,
public security, industry and commerce, etc. shall be
responsible for the related administration
of the appearance of
the city and environmental sanitation according to their
respective functions. |
|
Article 3 The
responsible administrative departments of urban management on
the municipal and district levels
(hereinafter referred to as
"the responsible department" ) may delegate part of their
administrative
functions to qualified organizations. |
The authority of the responsible department over
administrative penalty specified by these regulations may be
exercised by agencies of comprehensive administration law
enforcement with governmental authorization. |
|
Article 4
In the administration of the appearance of the city and
environmental sanitation, the system of
jurisdiction
responsibility under unified leadership shall be instituted and
the principle of both
combination of management by the
professionals with management by the masses and combination of
education with penalty shall be insisted on. |
|
Article 5
The municipal and district people' s governments shall
integrate the task concerning the appearance
of the city and
environmental sanitation into their economic and social
development plans and push
for progress in fulfilling this task. |
|
Article 6
The municipal and district people' s governments and the press
shall strengthen propagandistic
education on the knowledge of
the appearance of the city and environmental sanitation, keep
enhancing
people' s consciousness of model sanitation, and
build up good social ethics. |
|
Article 7 All
units and individuals shall perform an obligation to preserve
the appearance of the city and
environmental sanitation, take
good care of public facilities, and have a right to prevent or
report
any acts against these regulations. |
All units and individuals shall respect the labor of
environmental sanitation workers and make no hindrance to their
daily routine. |
The responsible department may engage some urban
residents as volunteer-watchers to assist propagandistic
education as well to help correct illegal acts. |
|
Article 8 The
responsible department shall establish a reporting system of the
appearance of the city and
environmental sanitation. Anyone who
finds any acts against these regulations may report to the
responsible department. The responsible department shall make a
serious investigation of the report and settle
the issue. If any
reporter wants a reply, it shall be made in 10 days. |
The
responsible department shall establish a reward system of
reporting on the appearance of the
city and environmental
sanitation. If any report has been verified, the responsible
department
shall commend or reward the reporter. The measures on
rewarding the reporter shall be specified by the responsible
department. |
|
Article 9
Anyone violating these regulations shall be ordered by the
responsible department to make a correction
by a deadline or to
take remedial measures. If such an order has been refused to
follow, the responsible
department may delegate the authority of
implementation to the related units, and the illegal actor shall
be held liable for the resultant cost. |
|
Article 10
If anyone of the law enforcement concerning the appearance of
the city and environmental sanitation
has been found in taking
one of the following acts, administrative penalties shall be
imposed,
according to law, on those in charge and those with
direct responsibility; if there is a criminal offence, the
criminal responsibility shall be ascertained according to law as
well: |
(1)
neglecting duties, failing to stop and punish illegal acts which
should be stopped and punished; |
(2)
practicing favoritism and engaging in irregularities, shielding
and indulging illegal actors; |
(3)
abusing power, infringing upon the legal rights and interests of
citizens, legal persons, or
other organizations. |
|
Chapter II
Administrative Responsibilities within an Area under
Jurisdiction
|
|
Article 11 The
administrative responsibilities for the appearance of the city
and environmental sanitation
within an area under jurisdiction
shall include those as follows: |
(1)
to ensure within an area under jurisdiction that the
appearance of the city is clean and there is no displaying goods
for sale, posting, daubing, digging, building, piling, and
hanging out the washing that make a
mess against the related
rules; |
(2)
to ensure within an area under jurisdiction that
environmental sanitation meets the related standards set by the
state and there is no exposed garbage, foul water, smudges, mud,
dirt with waste residue, and breeding
places of flies and
mosquitoes; |
(3)
to ensure within an area under jurisdiction that the
facilities for environmental sanitation meet the related
standards set by the state. |
|
Article
12 The
administrative responsibilities for the appearance of the city
and environmental sanitation
shall be divided between areas
under different jurisdiction in compliance with the following
principles: |
(1)
districts, townships, and neighborhoods shall divide
their responsibilities according to their administrative areas; |
(2)
residential quarters, industrial areas, tourist areas,
warehouse sections, bonded zones, development zones, science
and
technology parks shall divide their responsibilities according
to their property management
limits; |
(3)
governmental offices, organizations, business and public
institutions shall divide their responsibilities according
to
their property lines. |
|
Article
13 The
administrative responsibility units of the appearance of the
city and environmental sanitation
shall be specifically divided
as follows: |
(1)
professional management departments of environmental
sanitation shall be responsible for the main and secondary
roads, interchanges, overhead walkways, pedestrian tunnels, and
public squares to be kept clean; |
(2)
property management units or residents committees shall
be responsible for inner streets, small lanes, public
accommodations of residential quarters; |
(3)
the authorities in charge shall be responsible for waters
and rivers; |
(4)
administration units or operator units shall be
responsible for tourist areas and attractions, commercial
establishments, industrial areas, warehouse sections, bonded
zones, development zones, science and technology
parks, ports,
airports, stations, harbors, docks, cultural and sports stadiums
(gymnasiums), parks,
etc.; |
(5)
property owner units or operator units shall be
responsible for commodity markets (including town markets,
illuminated night markets); |
(6)
governmental offices, organizations, schools, armed
forces, business and public institutions shall be responsible
for themselves; |
(7)
operators shall be responsible for individual stores,
vendors' stands, etc.; |
(8)
operation management units shall be responsible for
express highways, railways, highways, and both sides along their
routes; |
(9)
units undertaking construction shall be responsible for
their construction sites; |
(10)departments
in charge of public land planning shall be responsible for
government' s reserve
land; |
(11)proprietors
shall be responsible for the land to be developed; |
(12)professional
management departments in charge of greening by planting shall
be responsible for
urban green belts; |
(13)professional
management departments in charge of environmental sanitation or
property management
units shall be responsible for public
convenience, garbage transfer stations, and other environmental
sanitation facilities. |
|
Article
14 The
responsible department and the administrative responsibility
units shall sign pledges of administrative
responsibilities for
the appearance of the city and environmental sanitation within
areas under
their respective jurisdiction. |
|
Article 15 The
responsible department shall establish a system of assessment
and evaluation of the administrative
responsibilities for the
appearance of the city and environmental sanitation within areas
under
jurisdiction and also organize regular inspections, order
those who has failed to assume their responsibilities
to make a
correction by a deadline and may also give them warnings,
circulate criticism in official
dispatches or expose it in the
press. |
The assessment and evaluation of the appearance of the
city and environmental sanitation shall admit the masses into
the procedure and its result shall be made public by the press. |
|
Chapter III The
Management of the Appearance of the City
|
|
Part 1 The Management of
the Appearance of Roads
|
|
Article 16 The units in
charge of road management shall be responsible for keeping the
surface of urban roads
and their accessory facilities in good
condition and, in case of damages, organize repairing within 3
days after receiving a notice from the responsible department; a
fine of more than 3,000 but less than 5,000
RMB shall be imposed
if the repairing has not been done by the deadline. |
|
Article 17 All
covers of wells and ditches installed on urban roads shall be
kept in good condition and in
right places by property
owner-units. In case of damages, misplacing or loss of the
covers of wells
and ditches, the responsible department shall
set warning signs and notify the related property owner-units;
if the owner-units have failed in replacing or putting back the
covers in right places within 8 hours
after receiving a notice,
a fine of 500 RMB shall be imposed for each case. |
It shall be strictly prohibited to steal, illegally
purchase and sell any covers of wells and ditches installed on
urban roads and any traffic signs. Anyone stealing the
above-mentioned public property shall be
imposed on a fine of
more than 500 but less than 2,000 RMB by the department of
public security;
anyone illegally purchasing and selling the
above-mentioned public property shall be imposed on a fine of
more than 2,000 but less than 5,000 RMB by the responsible
department. If there is a criminal offence,
the criminal
responsibility shall be ascertained according to law. |
|
Article 18 It
shall be prohibited to occupy urban roads, overhead walkways,
pedestrian tunnels and other public
places without authorization
in order to pile goods, set stands and sell commodities. If it
is
indeed necessary to occupy temporarily the main and secondary
urban roads for major celebration activities, a report
shall be
filed to the municipal government for approval; temporary
occupation of other urban roads
and squares shall be reported to
the responsible department and departments of public security
and transportation for approval. |
In case of violation of the rules of the above section,
the responsible department shall order a correction and also
impose a fine of 200 RMB per square meter; if the correction has
been refused, all the goods for
sale beyond the limit shall be
confiscated; if anyone has been penalized more than three times
a year, an administrative department for industry and commerce
shall temporarily take away this person' s business
license and
issue an order to stop doing business for rectification. |
|
Article 20 Any
units undertaking construction shall promptly clear away the
remaining mud and filth as a result
of digging urban roads,
repairing pipelines or cleaning drainages and ditches, and keep
the road
surface clean. |
In case of violation of the rules of the above section,
the responsible department shall order cleaning by a deadline;
if the cleaning has not been done after the deadline, a fine of
1,000 RMB per square meter of the
contaminated area shall be
imposed. |
|
Article 21 It shall be
prohibited to install overhead pipes and lines over urban roads
and between residences
and buildings without authorization. As
for the existing pipes and lines which do not meet the
requirements, installers shall dismantle and remove them by a
deadline set by the responsible department. |
It shall be prohibited to install pipes and lines or to
hang out the washing on guardrails, wire posts, trees and
green
fences on urban roads and the both sides of the roads as well. |
In case of violation of the rules of the first section,
the responsible department shall order making a correction
by a
deadline; if the correction has been refused, a fine of more
than 500 but less than 1,000
RMB shall be imposed. In case of
violation of the rules of the second section, the responsible
department shall order making a correction and also impose a
fine of 200 RMB. |
|
Article 22 It
shall be prohibited to construct temporary buildings,
structures, etc. on the both sides of urban
roads and public
places without authorization. If it is indeed necessary to
install covered bus
stops, police boxes, newsstands, telephone
booths, telephone switchboard boxes, boxes of transformer
substation, cable TV terminal boxes, and other facilities,
approval shall be secured from the responsible
department and a
department of public land planning, and units in charge of
installing shall keep
the installations in good condition,
clean, and in harmony with the environment all around. |
In case of violation of the rules of the above section,
the responsible department shall order a unit in charge of
installation to make a correction by a deadline; if the
correction has been refused, a fine of
1,000 RMB shall be
imposed for each installation. |
|
Article 23 When
traveling on urban roads, motor vehicles loaded with articles
easy to be thrown up and scattered
such as soil, gravel, cement,
etc. and the liquid shall have their cargo covered or sealed in
order
to prevent scattering and leaking along roads, and also
follow scheduled time and assigned routes. |
It shall be prohibited to drive or park a motor vehicle
on sidewalks and ditch covers for underground pipelines. |
In case of violation of the rules of the first section,
anyone in failure to follow scheduled time and assigned routes
shall be ordered by the departments of public security and
transportation to make a correction
and also punished with a
fine of 200 RMB for one vehicle each time; anyone in failure to
have cargo
covered or sealed shall be ordered by the responsible
department to make a correction and also punished with a fine
of
200 RMB; anyone contaminating roads shall be ordered by the
responsible department to do cleaning
by a deadline and also
punished with a fine of more than 500 but less than 2,000 RMB.
In case of
violation of the rules of the second section, the
responsible department shall order making a correction and also
impose a fine of 200 RMB; if the correction has been refused or
the owner of the vehicle is not
on the spot, the responsible
department may lock and hold the vehicle; if sidewalks and ditch
covers
have been damaged, the owner of the vehicle shall be held
liable for compensation. |
|
Part 2 Management of the
Appearance of Streetward Buildings
|
|
Article 24 The units in
charge of management of streetward buildings or proprietors
shall be responsible for
keeping streetward buildings,
balconies, windows and roofs clean and beautiful, promptly
cleaning
and washing away smudges and rust from the exterior,
and repairing or removing without delay those buildings,
structures and facilities which adversely affect the appearance
of the city. |
If the streetward buildings, structures and facilities
which adversely affect the appearance of the city have not
been
repaired or removed in time, the responsible department shall
order making a correction by
a deadline; in case of refusal to
make a correction, a fine of more than 500 but less than 5,000
RMB shall be imposed. |
If the appearance of the city has been adversely affected
by setting up shelters, stands, and piling up odds and
ends on
the roof, the responsible department shall order dismantling,
removing and cleaning away
by a deadline; in case of failure to
do so after the deadline, a fine of more than 200 but less than
500 RMB shall be imposed. |
If the appearance of the city has been adversely affected
by piling up and hanging out articles on the balconies,
windowsills, exterior walls of streetward buildings, the
responsible department shall order cleaning
away by a deadline;
in case of failure to do so after the deadline, a fine of more
than 100 but
less than 500 RMB shall be imposed. |
|
Article 25 It
shall be prohibited to renovate and reconstruct the streetward
side of a building without approval. |
In case of violation of the rules of the above section,
the responsible department shall order making a correction
by a
deadline; if the correction has been refused, a fine of more
than 500 but less than 2,000
RMB shall be imposed. |
|
Article 26 Streetward
buildings shall have their common TV antenna system installed in
a unified form; as for
a building without common TV antenna, the
unit in charge of property management or proprietors shall make
improvement. |
If the appearance of the city has been adversely affected
by a separately installed outdoor TV antenna, the responsible
department shall order making a correction by a deadline; in
case of refusal to make the correction,
a fine of 500 RMB shall
be imposed. |
|
Article 27 It
shall be prohibited for any streetward building to be enclosed
by a solid wall. Options for dividing
lines in the front and the
back of a streetward building shall be open and beautiful
palings, green
fences, flower terrace (beds), and lawn. |
In case of violation of the rules of the above section,
the responsible department shall order making a correction
by a
deadline; if the correction has been refused, a fine of more
than 500 but less than 2,000
RMB shall be imposed. |
|
Part 3 Management of
Outdoor Advertisements, Signboards,
|
and Other Publicity
Materials
|
|
Article 28 It shall be
prohibited to have an outdoor advertisement without approval. |
Approved outdoor advertisements, signboards, etc. shall
be in harmony with the sights all around and safe. Those
advertisements and signboards which are old, broken, falling
off, and easy to collapse shall be
cleaned, repaired or removed
without delay by the units in charge of their installation.
Expired
advertisements, signboards shall be dismantled, removed
promptly or renewed in accordance with the related rules. |
In case of violation of the rules of the first section,
the responsible department shall order dismantling and removing
by a deadline and also impose a fine of more than 2,000 but less
than 5,000 RMB. In case of violation
of the rules of the second
section, the responsible department shall order making a
correction
by a deadline; if the correction has been refused, a
fine of more than 1,000 but less than 3,000 RMB shall be
imposed. |
|
Article 29 The
units and individuals who install outdoor advertisements,
signboards, glass-fronted newspaper
billboards, poster
billboards, traffic signs, display windows, galleries, neon
lights, electronic
screens, etc. shall do installation in
compliance with approved sites, specifications and schedules. |
In case of violation of the rules of the above section,
the responsible department shall order making a correction
by a
deadline; if the correction has been refused, a fine of more
than 1,000 but less than 5,000
RMB shall be imposed. |
|
Article 30 Those
who install publicity articles such as slogans, colored flags,
balloons, etc. on public places
and buildings upon approval by
the responsible department shall keep them clean without
spreading
over traffic signs and causing traffic problems, and
remove them in time. |
It shall be prohibited to distribute and hang promotion
materials on overhead walkways, interchanges, and the both
sides
of a road. |
In case of violation of the rules of the first and second
sections, the responsible department shall order a correction,
impose a fine of more than 500 but less than 1,000 RMB, and may
also confiscate the related publicity
materials. |
|
Article 31 It
shall be prohibited to post, scribble, engrave and draw on the
exterior walls of buildings and
structures, municipal public
facilities, pipelines and trees. |
In case of violation of the rules of the above section,
the responsible department shall order cleaning by a deadline
and also impose a fine of more than 1,000 but less than 3,000
RMB; if the cleaning has not been
done after the deadline or the
order has been rejected, the responsible department, after
verifying
the fact, may confiscate the illegal actor' s
communication tools or notify telecommunication enterprises in
writing to stop temporarily the service of the telecommunication
numbers indicated by the actor' s
posting, scribbling,
engraving and drawing. The related telecommunication enterprises
shall cooperate
in implementation within 3 days after receiving
the notice. During the temporary suspension of the service of
the telecommunication numbers, if the illegal actor has accepted
the order, the related telecommunication
enterprises shall
resume the service according to a notice from the responsible
department. The
illegal actor shall be held liable for the cost
of suspension and resumption of the service of the
telecommunication numbers. |
|
Part 4 Management of
Urban Greening
|
|
Article 32 The
responsible department shall be responsible for keeping urban
public green belts clean and beautiful,
trimming trees and
flowers in time and removing garbage promptly on the urban green
belts. If any
dirt, branches and leaves have been left after
planting and trimming, operators shall clean them away on the
same day of their work. |
A
property management unit or proprietors shall be responsible for
preserving the green belts of
a residential quarter and also the
greenbelts attached to a unit in compliance with the rules of
the above section. The responsible department shall offer its
instruction, inspection and supervision. |
|
Article 33 It
shall be prohibited to occupy, damage the land for urban
greening or change its use without authorization. |
It
shall be prohibited to drain sewage, dump garbage, and burn
leaves within urban green belts. |
It
shall be prohibited to break off branches, pick leaves, pluck
flowers and fruits from public
trees; it shall be prohibited to
scatter odds and ends within urban green belts; it shall be
prohibited
to step on any urban green belt with a sign of
forbidden zone. |
In
case of violation of the rules of the first section, the
responsible department shall order a
correction and to restore
the original state and also impose a fine of more than 2,000 but
less
than 5,000 RMB; if there is a criminal offence, the
criminal responsibility shall be ascertained according to law.
In case of violation of the rules of the second section, the
responsible department shall order
a correction and also impose
a fine of more than 500 but less than 2,000 RMB. In case of
violation
of the rules of the third section, the responsible
department shall order a correction and also impose a fine of
more than 50 but less than 200 RMB. |
|
Article 34 It
shall be prohibited to drive and park any vehicle on an urban
green belt. |
It
shall be prohibited to pile goods, set stands, and sell
commodities on an urban green belt. |
In
case of violation of the rules of the first section, the
responsible department shall order a
correction and also impose
a fine of 200 RMB; if the correction has been refused or the
owner of
the vehicle is not on the spot, the responsible
department may lock and hold the vehicle; if the green belt has
been damaged, the owner of the vehicle shall be held liable for
compensation. In case of violation
of the rules of the second
section, the responsible department shall order a correction and
also
impose a fine of 500 RMB per square meter of the occupied
area; if the fine has been rejected or the case is severe,
the
goods for sale shall be confiscated. |
|
Part 5 Management of
Urban Lights
|
|
Article 35 The professional
administrative department in charge of road illumination shall
ensure that the
working rate of its accepted road lamps and the
good condition rate of equipments meet the standard set by the
state. |
Road illumination facilities for public places such as
development zones, industrial areas, residential quarters,
stations, ports, etc. shall be installed according to planning,
and property management units or
proprietors shall ensure that
the working rate of road lamps and the good condition rate of
equipments
meet the stipulated standards. |
In case of violation of the rules of the first section
and second section, the responsible department shall order
a
correction by a deadline; if the correction has not been made
after the deadline, a fine of more
than 500 but less than 2,000
RMB shall be imposed. |
|
Article 36 Decorate
illumination facilities shall be installed on streetward
buildings and structures along
the main and secondary roads,
squares, and green belts in accordance with urban illumination
environmental
planning. |
If decorate illumination facilities and illuminated
advertisements and signboards have been broken or damaged,
installers or proprietors shall do repairing promptly. |
In case of violation of the rules of the second section,
the responsible department shall order completing repair
by a
deadline; if the repair has not been done after the deadline, a
fine of more than 500 but
less than 2,000 RMB shall be imposed. |
|
Chapter IV Management of
Environmental Sanitation
|
|
Part 1 Public
Environmental Sanitation
|
|
Article 37 It shall be
prohibited to place, dump and burn garbage and other wastes at
sites not assigned for
this purpose; it shall be prohibited to
empty and drain waste and polluted water to urban roads. |
In case of violation of the rules of the above section,
the responsible department shall order making a correction
and
restoring the original state, and also impose a fine of more
than 500 but less than 2,000 RMB. |
|
Article 38 It
shall be prohibited to spit, relieve oneself and throw up all
over the places and to litter chewing
gum, bagasse, fruit peel
and pip, waste paper, cigarette ends or other wastes. |
It shall be prohibited to throw garbage and other wastes
from buildings and vehicles. |
In violation of the rules of the first section, the
responsible department shall order cleaning and also impose a
fine of 50 RMB. In case of violation of the rules of the second
section, the responsible department
shall order cleaning and
also impose a fine of more than 100 but less than 300 RMB. |
|
Article 39 It
shall be prohibited to raise pigs, cattle and sheep within the
Special Zone; it shall be prohibited
to keep poultry and
livestock such as chicken, duck, geese and rabbits within the
urban areas of
the Special Zone. However, exceptions may be made
of the cases for teaching, scientific research and other special
needs. |
In case of violation of the rules of the above section,
the responsible department may take action of confiscation
and
also impose a fine of 500 RMB per head of pigs, cattle, sheep,
and 50 RMB per head of chicken,
duck, geese and rabbit. |
|
Article 40 Any
units undertaking construction shall abide by the following
rules in their operation: |
(1)
construction sites shall be fenced off for operation and
eye-catching signs shall be installed; |
(2)
construction sites shall be kept clean and all the
garbage resulting from construction shall be disposed of in
time; |
(3)
measures shall be taken to prevent the dust pollution of
the appearance and environment of the city; |
(4)
all the roads at entrances and exits of construction
sites shall be solidly-grounded and also washed and cleaned
by
workers specially assigned for this job; |
(5)
it shall be prohibited to drain untreated muddy water
into urban pipes for rain and sewage; |
(6)
solid wastes such as the residue of dirt, etc. shall be
removed to the designated places. |
In
violation of the rules of items (1), (2), the department in
charge of construction |
shall
order a correction by a deadline and also impose a fine of more
than 500 but less than 2,000
RMB; if the correction has been
refused, it shall be ordered to stop working for rectification.
In case of violation of the rules of items (3), (4), (5), (6),
the responsible department shall order a correction
by a
deadline and also impose a fine of more than 1,000 but less than
3,000 RMB. |
|
Article 41 Waste
purchasing units shall strengthen the management of their
working areas and may not affect
the appearance of the city and
pollute the environment all around. |
In case of violation of the rules of the above section,
the responsible department shall order a correction by a
deadline; if the correction has not been done after the
deadline, a fine of more than 1,000 but
less than 5,000 RMB
shall be imposed. |
|
Part 2 Management of
Urban Garbage
|
|
Article 42 A
professional administrative department of environmental
sanitation shall be responsible for the
management of urban
garbage and gradually push to move toward having drainage,
collection and disposal
of urban garbage done according to their
classification. |
|
Article 43 Urban
consumer waste shall be bagged and placed on the designated
sites. |
In
case of violation of the rules of the above section, the
responsible department shall order a
correction and may also
impose a fine of 100 RMB. |
|
Article 44
Urban consumer waste shall be collected and shipped at the
designated time and designated places,
and also cleaned away on
the same day when they come out. |
In
case of violation of the rules of the above section, the
responsible department shall order a
correction and also impose
a fine of more than 1,000 but less than 3,000 RMB. |
|
Article 45 Urban
garbage collection and shipment shall be done in airtight
containers. It shall be prohibited
to use air-permeable
containers such as large baskets, etc. to collect garbage, and
it shall be
also prohibited to have garbage shipment in open
vehicles. |
In
case of violation of the rules of the above section, the
responsible department shall order a
correction and may also
impose a fine of more than 200 but less than 500 RMB. |

Article 46 Urban
garbage shall be treated in a systematic way to increase
resources, eliminate hazards, and
reduce the quantity of waste. |
Urban
consumer waste shall be uniformly disposed of in garbage
disposal plants. |
Medical
waste, poisonous and harmful industrial waste shall be treated
by the units of origin themselves
or entrusted to special
treatment of specialized institutions. |
The
residue of feces of septic tanks shall be shipped to designated
places to dispose of. |
The
residue of dirt shall be shipped to designated places to dispose
off. |
In
case of violation of the rules of the third section, the
department in charge of environmental
protection shall make a
punishment according to law. In case of violation of the rules
of the fourth
and fifth sections, the responsible department
shall order a correction and also impose a fine of more than 500
but less than 2,000 RMB. |

Article 47 Urban
consumer waste disposal plants (landfills) shall not accept
medical waste, the residue of
dirt, and poisonous, harmful
industrial waste. |
In
case of violation of the rules of the above section, the
responsible department shall order a
correction and also impose
a fine of more than 2,000 but less than 5,000 RMB. |

Article 48 It
shall be prohibited to mix poisonous, harmful industrial waste
into other garbage. |
In
case of violation of the rules of the above section, the
responsible department shall order making
a correction and
taking remedial measures, and also impose a fine of more than
2,000 but less than
5,000 RMB. |
|
Article 49 The
animals such as livestock, poultry, etc. which died of illness,
poison or unclear reason shall
be disposed of through
decontamination done by a municipal professional administrative
department
of environmental sanitation. |
In
case of leaving dead livestock and dead poultry all over the
places, the responsible department
shall impose a fine of 500
RMB per head of livestock and 100 RMB per head of poultry. |

Article 50 It
shall be prohibited to pick rubbish in garbage containers and
garbage collection sites, and to
collect the residue of urine
from sewage wells. |
Containers
for shipping hogwash shall be covered and sealed, and spilling
and leaking shall not
be allowed. |
In
case of violation of the rules of the first section, the
responsible department shall order cleaning
on the spot and also
impose a fine of 200 RMB. In case of violation of the rules of
the second
section and resulting in the pollution of the urban
environment, means of shipping shall be confiscated and a fine
of 200 RMB shall be imposed. |

Part 3 Environmental
Sanitation Facilities
|
|
Article 51 The municipal
responsible department shall organize to formulate a plan of
environmental sanitation
in accordance with the related
standards set by the state and a city-wide overall urban plan
and,
after reporting to the municipal urban planning commission
for examination and approval, organize its implementation
in
compliance with legal procedures. |
Garbage disposal plants (landfills) and their design
plans shall be in compliance with the plan of environmental
sanitation and the related technical standards set by the state. |
|
Article 52 Units
undertaking construction shall build public convenience, garbage
transfer stations and other
environmental sanitation facilities
as accessories in compliance with the state plan of
environmental
sanitation and its standards. |
Environmental sanitation facilities shall be designed,
built, completed, checked and accepted, and put into use at
the
same time when the principal part of a construction project has
these steps completed. |
The responsible department shall participate in
examination and approval of design plans of environmental
sanitation facilities and also in check and acceptance after the
completion of projects. |
In case of violation of the rules of the first, second,
third sections, the responsible department shall order a
correction by a deadline; if the correction has been refused for
violation of the rules of the
first section, a fine of more than
1,000 but less than 5,000 RMB shall be imposed. |

Article 53 Management
units shall perform regular maintenance and renovation of all
environmental sanitation
facilities, repair or renovate old,
damaged facilities in time and keep them in good condition. |
In case of violation of the rules of the above section,
the responsible department shall order repairing or renovating
by a deadline; if the repair or renovation has not been done
after the deadline, a fine of 1000
RMB shall be imposed. |

Article 54 It
shall be prohibited for all units and individuals to occupy,
damage, dismantle environmental
sanitation facilities or to
change their functions. If a removal is indeed necessary, it
shall
be done, upon approval of the responsible department, in
compliance with the principle to have a new one built up
before
removal; the unit doing removal shall be responsible for such
building. |
In case of violation of the rules of the above section,
the responsible department shall order restoring the original
state or taking other remedial measures, and also impose a fine
of more than 2,000 but less than
5,000 RMB. |

Chapter V Supplementary
Provisions
|
|
Article 55 The main and
secondary roads referred to in these regulations shall be
announced regularly by the
responsible department. |
|
Article 56
These regulations shall take effect as off August 1, 1999. |
