Provisional Measures of the Shenzhen Special Economic Zone

on Administration of Facilities for Flood Control

Chapter I General
Provision
|
|
Article 1 In order to
strengthen the administration of facilities for flood control in
the Shenzhen Special
Economic Zone (hereinafter referred to as
"the Special Zone" ), ensure the safety of people' s lives
and property, and meet the needs of economic development in the
Special Zone, these measures are hereby formulated
in accordance
with the related rules of the state and in the light of the
specific conditions of
the Special Zone. |

Article 2 All
units and individuals shall have obligations to protect the
facilities for flood control and
participate in flood prevention
and salvage. |
The administration of facilities for flood control shall
follow the principle of "day-to-day maintenance, prompt
repair, maintenance prior to repair, repair prior to salvage." |
|
Article 3 The
administrative department of the municipal people' s government
in charge of water shall be
the responsible department for the
Special Zone' s facilities for flood control, and appoint
full-time
administration staff to manage the facilities. |
|
Chapter II Facilities
for Flood Control
|
|
Article 4 The facilities
for flood control referred to in these measures shall include: |
(1)
the reservoirs and their auxiliary facilities such as
dams, sluice gates, spillways (culverts), etc., within the
Special Zone; |
(2)
the dams, dikes, culverts, bridge sluices and their
auxiliary facilities within flood storage areas; |
(3)
the rivers within the Special Zone and the river courses
which are intersected with them, dikes, sluices and their
auxiliary structures; |
(4)
precipitation stations, hydrometric stations. |

Chapter III
Administration of Facilities for Flood Control
|
|
Article 5 The department in
charge of facilities for flood control shall arrange frequent
inspection, observation
of the facilities, be aware of the use
of structures, and ensure that mechanical devices operate well.
If any damage to the structure for flood control has been found,
salvage and repair shall be organized immediately to make
sure that the facilities for flood control should be in
good
condition and capable of functioning to the full in flood
prevention. |

Article 6 River
courses shall be kept unblocked and culvert gates shall be
maintained in normal operation.
If there is any obstacle
blocking water within the protection area of facilities for
flood control,
the department in charge of facilities for flood
control, in compliance with the principle of "whoever places
an obstacle is responsible for removing it" , shall propose a
plan for removing the obstacle as
well as a working schedule,
and order that the person placing the obstacle should remove it
by
a prescribed deadline. |

Article 7 The
equipments and materials for flood control and salvage shall be
stored and maintained in good
condition as special supplies for
special purposes. It shall be guaranteed that the materials for
flood control and salvage would be on call at any time. |
|
Article 8 The
construction within the protection areas of facilities for flood
control shall be subordinated
to the overall arrangements and
unified planning of flood control, and forestation for both
flood
control and scenery shall be done in a planned way, by
stages and by sections. |
|
Article 9 The
department in charge of facilities for flood control shall pay
attention to collecting, sorting
and accumulating of
hydrological data on rainfall, flood and tides, conduct
hydrological analyses,
forecast possible happenings and
problems, and make sure of good prevention. |
|
Article 10 The
administrative personnel of facilities for flood control shall
manage and maintain the facilities
properly with strong sense of
responsibility. The department in charge of facilities for flood
control shall establish a workable system of rewards and
penalties according to specific conditions. |
|
Chapter IV Rewards and
Penalties
|
|
Article 11 If one of the
following acts, in violation of these measures, has been found,
the department in
charge of facilities for flood control shall
order stopping illegal acts, removing obstacles by a deadline or
taking other remedy measures, and impose a fine at the same
time; if a crime has been committed,
the criminal responsibility
shall be investigated according to law: |
(1)
the acts to damage the facilities for flood control such
as excavating sands, quarrying stones, removing the earth,
sinking a well, drilling, blasting, digging a fish pond, felling
trees, etc., within the protection
areas of facilities for flood
control; |
(2)
dumping slag, cinder, coal, earth, bricks, broken tiles,
smashed pieces of pottery and glass, garbage within the
protection areas of facilities for flood control; |
(3)
building work sheds, houses, and piling equipments and
sundry articles within the protection areas of facilities
for
flood control without approval of the department in charge of
facilities for flood control. |

Article 12
The person with meritorious deeds in protection of the
facilities for |
flood
control shall be rewarded. |
|
Chapter V Supplementary
Provision
|
|
Article
13 These
measures shall take effect as of the date of promulgation. |
