and Slaughter Quarantine

Chapter
¢ñGeneral
Provisions
|
Article
1 Depending on the real conditions of Shenzhen Special
Economic Zone, in accordance with relevant laws and administrative
regulations of People' s Republic of China, this ordinance is
formulated for the purpose of strengthening
the supervision of
livestock-poultry slaughter and quarantine, preventing the spread
of livestock-poultry
infectious diseases, and protecting human
health.

Article
2 The
ordinance shall apply to livestock-poultry slaughter and slaughter
quarantine.
|
The
entrance
and exit
quarantine of livestock, poultry and their products, and the
hygiene inspection of livestock-poultry
food shall be conducted
respectively in accordance with the provisions of Law of the
People' s Republic of China on the Entrance
and Exit Quarantine
of Animal and Plant and Law of the People' s Republic
of China on the Food Sanitation.

Article 3
In this ordinance: "Livestock" shall refer to pigs, cattle, sheep, etc.;
|
"Poultry"
shall refer to chickens, ducks, geese, etc.;
|
"Livestock-poultry
products" shall refer to non-processed meat, viscera, hides of
livestock-poultry,
etc.;
|
"Livestock-poultry
slaughterhouse (slaughter spot)" shall refer to professional
sites for slaughtering
livestock and poultry;
|
"Slaughter
quarantine" shall refer to the quarantine of livestock, poultry
and their products conducted
in slaughterhouse (slaughter spot),
including pre-slaughter quarantine |
Article 4 The municipal or district administrative department for agriculture (hereinafter referred as the municipal or district agricultural
department) shall exercise supervision and administration over livestock-poultry slaughter quarantine work; the municipal or district
supervision institution over livestock-poultry epidemic prevention and inspection shall be concretely responsible for carrying out
the quarantine work of livestock-poultry slaughter. |
The
municipal or district administrative department for commodity
circulation (hereinafter referred
as the municipal or district
department of commodity circulation) shall be in charge of
livestock-poultry
slaughtering & processing industry, and
responsible for establishing industry development plans, service
regulations and technical standards.
|
The
municipal or district administrative departments, such as
department of industry & commerce,
public security department,
department of land planning, department of environmental
protection shall
implement this ordinance in accordance with their
duties and functions.
|
Article 5 Livestock slaughter and quarantine shall be carried out on the principle of slaughter in settled place, concentrative quarantine,
and separation of slaughter, quarantine and management.
|
Chapter

Livestock slaughter
|
|
Article 6 The establishment of slaughterhouse shall be planned and arranged uniformly by the municipal government. The specific locations of
slaughterhouse shall be determined, under the organization of the municipal government, by the municipal or district departments
of commodity circulation, land planning, agriculture, and other relevant departments, in light of the principles of promoting production,
benefiting circulation, favoring quarantine and management, and convenient to the people. |
Whoever
applying for the establishment of slaughterhouse, shall submit a
formal application in advance
to the municipal or district
department of commodity circulation, which shall reply in written
within
10 days.
|
Article 7 Any unit or individual shall be prohibited to establish livestock slaughterhouse without permission or to supply locations for others
to establish livestock slaughterhouse without permission. |
Article 8 Livestock slaughterhouse shall be built, rebuilt and expanded as required below: |
(1)
the chosen locations shall be complied with the
requirements of city planning, environmental protection and
epidemic prevention;
|
(2)
the overall structure arrangement shall be reasonable, and
the procedure of slaughter shall be pursuant to the requirements
of slaughter quarantine; there shall be infrastructure facilities
that fit the slaughtering quantum,
such as room for wait, room for
slaughtering, isolation room for ill livestock, room for emergent
slaughter and room for meat cooling. The preceding facilities
shall be kept sufficient of illumination and well
ventilated. The
interior walls and the operating desks of the room for
slaughtering and the room
for emergent slaughter shall be covered
by a stucco with white, glazed, easy-cleaned architectural
materials;

(3)
there shall be abundant water supply with the quality up to
the State criterion of drinking water;
|
(4)
there shall be facilities for innocuous sewage disposal;
|
(5)
there shall be transportation vehicles and containers up to
the requirements of hygiene epidemic prevention;
|
(6)
the livestock slaughter personnel shall be healthy and hold
the medical certificate.
|
Article 9 The built slaughterhouses shall be checked by the municipal or district department of commodity circulation, in conjunction with
the departments in charge of agriculture, construction, environmental prevention, and sanitation. Those that pass the checking shall
be granted certification of animal epidemic prevention by the municipal or district agricultural department; applicant shall make
registrations according to law, on the strength of the certifications, in the industry-commerce administrative department as well
as the tax administrative department. |
Article 10 Livestock slaughter shall comply with the following
requirements: |
(1)
before bloodletting, swill livestock' s bodies and clear
the gore up;
|
(2)
the water for slaughter shall be kept clean, the water in
scald pond shall be replaced in time, and that in cold-water
pond
shall be kept flowing;
|
(3)
in the course of slaughtering, livestock shall be kept away
from the ground, and after slaughtering, carcass shall
be hung in
ventilation, shady and clean places, for fear the contamination of
poisonous, harmful
or odorous materials;
|
(4)
carcasses and viscera shall not be with blood, hair,
excrement, spot, scar, focus of a disease and deleterious gland;
|
(5)
vehicles, facilities and packages for livestock products
delivering, loading-unloading, packing shall be pursuant
to the
State sanitary criterion.
|
Article
11 It shall be prohibited to slaughter healthy
livestock together with ill ones. Depending on the type of
diseases, ill livestock shall be disposed according to the
relevant State regulations; whoever finding people
as well as
livestock suffering from strong infectious diseases, shall notify
it to the municipal or
district agricultural department and
sanitation administrative department in time, and deal with it in
accordance with the State legislations.

Article
12 It shall be prohibited to slaughter dead livestock.
Dead livestock shall be disposed in accordance with the relevant
State regulations, and not be cast away at random.
|
Article
13 The regulation of sanitary supervision and
disinfections shall be necessary for the livestock slaughterhouse.
After slaughtering per day (shift), the sites, tools, and
equipment for slaughtering shall be cleaned up
and disinfected.
|
Hair,
excrement, bedding materials or other waste shall be subject to
innocuous disposals, and the sewage
and noise shall be let out in
accordance with the State provisions of environmental protection.

Chapter

Livestock Quarantine
|
Article
14 The livestock conveyed into slaughterhouse shall be
attached with the transport quarantine certification as well as
the transportation tools disinfection certification, which are
issued by county-level above supervision
institution over
livestock-poultry epidemic prevention and quarantine in place of
origin. The livestock
originated from Shenzhen City shall be
attached with the place of origin quarantine certification issued
by the municipal or district supervision institution over
livestock-poultry epidemic prevention and quarantine.

Article
15 The municipal or district supervision institution
over livestock-poultry epidemic prevention and quarantine shall
dispatch inspectors to conduct quarantine in slaughterhouse, and
to exercise slaughter quarantine strictly
according to the
procedures and regulations stipulated by the State pertaining to
the hygiene quarantine
of meat products.
|
With
respect to the livestock slaughtered in slaughterhouse, only the
ones quarantined up to grade shall
be affixed a uniform proof mark
indicating "quarantine accepted" on their carcasses or be
granted
the quarantine certification of eligible livestock
products.
|
Article
16 Veterinarian or hygiene inspectors shall have
relevant professional knowledge, take unified examination and
obtain the
certification for veterinarian and hygiene inspector
from
the municipal agricultural department, and shall conduct
quarantine on the strength of the certification.
|
Veterinarian
or hygiene inspectors shall perform their duties pursuant to
relevant provisions stipulated
by the State.
|
Article
17 Charges for slaughter quarantine shall be collected
in accordance with the State standards. Depending on real
conditions, specific collecting measures shall be established by
the municipal agricultural department,
and shall be implemented
after the approval of the municipal administrative department of
price.
|
Preceding
charges for quarantine shall be turned over in full amount to the
State Treasury. Any unit
or individual shall be prohibited to
intercept, distribute illicitly or embezzle the charges mentioned
above.
|
Article
18 Livestock and the products shall be permitted to
enter the market on the strength of valid proof mark or quarantine
accepted certification; those livestock and the products that do
not undergo quarantine or that fail
the standard quarantine shall not be allowed to be processed or
distributed.
|
No
unit or individual shall be allowed to add or fill water or other
materials into eligible livestock.
|

Chapter¢ô
Poultry slaughter and quarantine
|
Article
19 Poultry
slaughterhouse shall be built, rebuilt and expanded as stipulated
in article 6, article 7,
article 8, and article 9 of this
ordinance.
|
Article
20 In the trade market of agricultural byproducts, the
poultry slaughter spots and other professional sites for
processing poultry shall be established pursuant to the following
requirements:
|
(1)
there shall be slaughter rooms that fit the slaughtering
quantum, in which the interior walls and the operating desks
shall
be kept clean, sanitary, sufficient of illumination, and well
ventilated.
|
(2)
there shall be abundant water supply with the quality up to the
State criterion of drinking water
|
(3)
there shall be instruments and containers for slaughter
conforming to the requirements of hygiene quarantine.
|
Those
pursuant to the preceding provisions, shall be granted certification
of animal epidemic prevention issued by the municipal or
district agricultural department and shall be approved and
registered in
the industry and commerce administrative department.
|
Article
21 The poultry conveyed into slaughterhouse (slaughter
spot) shall be attached with the place of origin quarantine
certification issued by county-level above supervision institution
over livestock-poultry epidemic prevention
and quarantine in the
place of origin.
|
Article
22 It shall be prohibited to slaughter dead or ill
poultry, which shall be disposed according to relevant State
provisions.
|
Article
23 No unit or individual shall be allowed to add clay,
sand, water or other materials into the poultry for slaughter
as
well as their products.
|
Article
24 In the absence of provisions in the chapter, the
slaughter and quarantine of the poultry conveyed into
slaughterhouse (slaughter spot) shall be conducted through
referring to other provisions in this ordinance.
|

Chapter¢õ
Legal Liabilities
|
Article
25 For anyone who violates the provisions in article 6,
article 7, article 8, and article 9 of the ordinance by
establishing slaughterhouse without permission and slaughtering
livestock unlawfully, the municipal or district
agricultural
department shall investigate him, dismantle the equipment for
unlawful slaughter, confiscate
illegal livestock, their products
and the instruments for slaughter, and destroy them as prescribed;
if the circumstances are serious, the offender shall be fined in
addition as much as the volume of business in livestock
slaughtered illegally.
|
Anyone
who violates the provisions in article 19 and article 20 of the
ordinance by setting up slaughterhouse
(spot) without permission
and slaughtering livestock-poultry unlawfully, shall be penalized
as stipulated
in preceding paragraph.
|
Article
26 For anyone who violates the provisions in article 7
of the ordinance by providing locations for others to establish
slaughterhouse without permission, his earnings of rent shall be
confiscated and a fine in addition
as much as the volume of the
earnings of rent shall be imposed by the municipal or district
agricultural
department.
|
Article
27 Anyone who violates the provisions in article 10 of
the ordinance by slaughtering livestock not as required, shall
be
warned by the municipal or district agricultural department and
ordered to rectify within specified
time limit. In case fail to
rectify within the time limit, the offender shall be fined not
less than
500 RMB but not more than 1000 RMB; if the circumstances
are serious, the offender shall be fined not less than 1000
RMB
but not more than 3000 RMB.

Article
28 Anyone who violates the provisions in article 11 of
the ordinance by slaughtering healthy livestock together with
ill
ones, shall be ordered by the municipal or district agricultural
department to cease acts of violation,
to eliminate the harm, and
shall be imposed a fine in addition four times as much as the
volume of
the business in ill livestock; if serious results ensue,
the offender shall be fined as much as the total volume of
business in mixed slaughtered livestock.
|
Anyone
who violates the provisions in article 11 of the ordinance by not
notifying or concealing the
notification or preventing others from
notifying strong infectious diseases, shall be fined not less than
3000 RMB but not more than 5000RMB by the municipal or district
agricultural department.
|
Article
29 For anyone who violates the provisions in article 12
of the ordinance by slaughtering dead livestock, the municipal
or
district agricultural department shall confiscate the dead
livestock and their products, have them destroyed under supervision,
and simultaneously impose the offender a fine in addition five
times as much as the volume of business
in dead livestock; anyone
who casts away dead livestock against some related provisions,
shall be ordered
to rectify and be fined, depending on the quantum
of discarded livestock, at the rate of not less than 200 RMB but
not more than 500 RMB per head.

Article
30 Anyone who violates the provisions in article 13 of
the ordinance by establishing slaughterhouse without regulations
of sanitary management and disinfection, or disinfecting and doing
innocuous disposals not as prescribed,
shall be warned and be
ordered to rectify by the municipal or district agricultural
department; anyone
who refuses to rectify, shall be fined not less
than 200 RMB but not more than 500 RMB.

Article
31 Anyone who violates the provisions in article 14 of
the ordinance by not obtaining the transport quarantine
certification, the certification of disinfected transportation
tools or the place of origin quarantine certification,
shall be
ordered to undergo quarantine complementarily, and be charged of
double fees.
|
Anyone
who violates the provisions in article 21 of the ordinance by
slaughtering the poultry without
quarantine certification, shall
be penalized as prescribed in preceding paragraph.
|
Article
32 For anyone who violates the provisions in the first
paragraph of article 18 of the ordinance by processing and selling
the poultry that does not undergo quarantine or that fails
standard quarantine, the municipal or district
agricultural
department, in conjunction with department of industry and
commerce, shall investigate
and order the offender to cease the
act of violation, confiscate unlawful livestock and their
products,
and impose a fine two times as much as the illegal
volume of business.
|
For
anyone who violates the provisions in the second paragraph of
article 18 and article 23 of the ordinance
by adding clay, sand,
water or other materials into livestock, poultry and their
products, the municipal
or district department of industry and
commerce shall give the offender a warn, order him to cease the
act of violation, and impose him a fine two times as much as the
illegal volume of business. |
Article
33 For anyone who violates the provisions in article 22
of the ordinance by slaughtering dead poultry and ill poultry,
the
municipal or district agricultural department shall confiscate the
dead poultry, ill poultry and
their products, have them destroyed
under supervision, and simultaneously impose the offender a fine
five times as much as the volume of business in dead poultry as
well as ill ones; anyone who disposes of dead and
ill poultry
against the State provisions, shall be ordered to rectify, and be
fined simultaneously,
depending on the quantum of dead and ill
poultry, at the rate of not less than 50 RMB but not more than 100
RMB per poultry.

Article
34 Depending on the seriousness of the case, anyone who
violates the provisions of the ordinance by forge seal indicating
"quarantine accepted" or quarantine certification, shall be
imposed a fine of not less than 2000
RMB and not more than 5000
RMB; if the circumstances are
serious enough to constitute a crime, the offender shall be
investigated for
his criminal liability according to law.

Article
35 Anyone who takes violent and minatory measures to
obstruct functionaries from performing their duties according to
the ordinance, shall be ordered to cease the act of violation, and
may be imposed a fine, depending
on the seriousness of the case,
of not less than 500 RMB and not more than 3000 RMB; if the
circumstances
are serious enough to constitute a crime, the
offender shall be investigated for their criminal liability
according to law.

Article
36 The functionary, who
neglects his duties or engages in malpractices for personal gain,
shall be subject to disciplinary sanctions by the municipal or
district administrative department;
if the act of violation is
serious enough to constitute a crime, the offender shall be
investigated
for his criminal liability according to law.

Chapter¢ö
Supplementary Provisions
|
Article
37 As for the minority ethnic groups' edible livestock
and poultry slaughtering, if there exist other provisions
stipulated by the State, the provisions shall prevail.
|
Article 38 The ordinance shall enter into force from Oct 1st,
1997. |
