Rules of the
Standing Committee of the Shenzhen People' s Congress on the
handling of Deputy' s Bill |

Article 1 In
order to standardize the handling of the bill of deputy to
Shenzhen People' s Congress (hereinafter referred to as the
municipal people' s congress), these rules are formulated
according to relevant provisions of the Organic Law of the
People' s Republic of China on the People' s Congresses and
People' s Governments at All Local Levels, the Law of the
People' s Republic of China on the Deputies to the National
People' s Congress and People' s Congresses at All Local Levels,
the Rules of Debate of the Shenzhen People' s Congress and other
laws and regulations, and combining with the actual
circumstances of this city. |
Article 2
Deputy' s bill in these rules refers to the bill, which is
jointly submitted by the deputies of the municipal people' s
congress (hereinafter referred to as the deputy) according to
law, handed over to the municipal people' s government
(hereinafter referred to as the municipal government) for
handling by the municipal people' s congress, and be deliberated
by the Standing Committee of the municipal people' s congress
(hereinafter referred to as the Standing Committee) with
the
authorization from the municipal people' s congress. |
Deputy' s bill may be a separate original bill, or may be
composed of several same or similar original bills. |
Article 3
The handling of deputy' s bill shall be designed scientifically,
organized meticulously, and be practical and effective. |
Article 4
The meeting of directors of the Standing Committee (hereinafter
referred to as the meeting of directors) shall lead and
coordinate the supervision and handling of deputy' s bill. |
The working committee of selection, liaison, personnel
appointment and removal of the Standing Committee is the
administrative
department of the supervision and handling of
deputy' s bill, which is in charge of the registration, delivery
and liaison
of deputy' s bill and other concrete routine work. |
The special committee and working committee (hereinafter
referred to as the department of supervision and handling),
which is determined by the meeting of directors, shall be in
charge of the concrete supervision and handling. |
Article 5
Deputy' s bill shall be handed over by the Standing Committee
within 30 days from the adjournment of the municipal people'
s
congress to the municipal government for handling. |
Article 6
Mayor or the deputy mayor designated by mayor shall be in charge
of the handling of deputy' s bill, and the government shall
determine corresponding undertaking unit of deputy' s bill
(hereinafter referred to as undertaking unit). |
Article 7
The municipal government shall make out the handling scheme
according to the content of deputy bill and the decision of
the
municipal people' s congress. |
The handling scheme shall include the aim, duty, measure,
completion time limit and so on. |
Article 8
When the undertaking unit draws up the handling scheme, it shall
listen to the opinions of the sponsor of deputy' s bill,
relevant
representatives and the department of supervision and handling
of the Standing Committee. |
Article 9
The municipal government shall submit the handling scheme to the
meeting of the Standing Committee for deliberation within
3
months from the date when the deputy' s bill is handed over. |
If it needs to extend the period for special circumstance,
having been agreed by the meeting of directors, it may be
extended for less than 3 months. |
Article 10
If the municipal government considers that the deputy' s bill may
be handled in 6 months, having been agreed by the meeting
of
directors, it may directly submit handling report to the meeting
of the Standing Committee for deliberation without
submitting
handling scheme. |
Article 11
After the Standing Committee receives the handling scheme
submitted by the municipal government for deliberation, the
meeting of directors shall refer it to relevant department of
supervision and handling for original deliberation, which
shall
submit the report of original deliberation. Having been
deliberated and decided by the meeting of directors, the
report
of original deliberation shall be submitted to the meeting of
the Standing Committee for deliberation. |
The department of supervision and handling and the Standing
Committee shall invite the sponsor of deputy' s bill and relevant
representatives to take part in their original deliberation or
deliberation of handling scheme. |
The Standing Committee shall make a resolution or decision when
it adopts the handling scheme. |
If handling scheme is not adopted by the meeting of directors,
the municipal government shall remake it and submit to the
next
meeting of the Standing Committee for deliberation. |
Article 12
The undertaking unit shall periodically report the handling of
deputy' s bill to the Standing Committee in writing. |
If handling scheme is executed by stages, the undertaking unit
shall report the execution to the department of supervision
and
handling at the end of every stage. Report may take a written
form. |
Article 13
During the handling of deputy' s bill, if it needs to make
relatively large adjustment to the time, measure and so on of
handling scheme for special circumstance, the municipal
government shall submit a report of adjustment scheme to the
Standing Committee. The handling procedure shall accord with the
provisions of the first paragraph of Article 11. |
Article 14
The municipal government shall submit the settlement report
after deputy' s bill is handled. The handling procedure shall
accord with the provisions of the first paragraph of Article 11. |
Article 15
The department of supervision and handling and the Standing
Committee shall invite the sponsor of deputy' s bill and relevant
representatives to attend the meeting of the original
deliberation or deliberation of settlement report. If it
concerns
special problem, they may invite the expert of relevant
aspect to attend meeting. If the meeting of directors or the
department
of supervisor and handling considers it necessary, it
may hold a hearing to listen to opinions. |
The meeting of the Standing Committee shall make a resolution or
decision when it adopts the settlement report. If the settlement
report is not adopted by the meeting of the Standing Committee,
the municipal government shall handle it continuously and
resubmit the settlement report according to the requirements of
the resolution or decision of the meeting of the Standing
Committee. |
Article 16
The Standing Committee or the department of supervisor and
handling shall periodically organize representatives to inspect
and examine the handling of deputy' s bill. |
The Standing Committee shall organize representatives to
reexamine the handled deputy' s bill. |
Article 17
The municipal government and its undertaking department shall
reply to the inquiries or questions to handling, which are
proposed by the members of the Standing Committee and deputies
according to law. |
Article 18
The Standing Committee shall report the handling of deputy' s
bill at the next meeting of the municipal people' s congress
of
current session, print and distribute the report to all
deputies. |
The deputy' s bill, which has not been handled during the
municipal people' s congress of current session, shall be
supervised and handled continuously by the Standing Committee of
the municipal people' s congress of the next session. |
Article 19
If relevant undertaking unit violates these rules, the Standing
Committee shall require it to rectify within a prescribed
time
limit, and may suggest relevant unit to give a sanction to the
person liable. |
Article 20
The handling of the deputy' s bill, which is handed over to the
Standing Committee for handling by the municipal people'
s
congress, shall accord with the provisions of the
Rules of Procedure of the Standing Committee of Shenzhen
Municipal People' s
Congress. |
The handling of the deputy' s bill, which is handed over to the
intermediate People' s Court, city People' s Procuratorate or
other department, shall observe these rules referentially. |
Article 21
These rules shall go into effect as of its promulgation. |
