Rules of the Shenzhen Special Zone on the Prohibition of

Selling and Setting off Fireworks
|
(Promulgated
by the Shenzhen Municipal People' s Government on December 4,
1990, revised and promulgated
on January 29, 1994) |

Article 1 In order to
further strengthen the strict administration of fireworks and
guarantee the safety of
people' s lives and property, these
rules are hereby formulated according to the related rules of Regulations of the People' s Republic of China on the Control of
Explosive Goods for Civilian Use and in the light of the
practical conditions of the Shenzhen Special Economic Zone
(hereinafter
referred to as the Special Zone). |

Article 2 Except
the firework evening parties for grand celebrations and
ceremonies approved by the municipal
people' s government, all
other units or individuals in the Special Zone shall not be
allowed to
set off fireworks within the Special Zone. |

Article 3 The
sponsoring unit which has been entrusted with holding a firework
evening party by the municipal
people' s government shall
report its plan of setting off fireworks (including the place,
the description
and amount of fireworks, the surrounding
environment and security measures) to the municipal people' s
government for examination and approval before setting off
fireworks. |

Article 4 Any
unit or individual shall not manufacture and reproduce various
kinds of fireworks and firecrackers
on their own, and shall not
ship the fireworks and firecrackers from the other places into
the
Special Zone without authorization either. |

Article 5 If
the fireworks are those to be provided for a firework evening
party or to be exported from the
Special Zone, the sponsoring
unit shall file an application report to the municipal
people' s government,
bring the approved report to the
municipal bureau of public security to go through the
formalities
for the permits of fireworks purchase and shipment,
and then be allowed to ship the fireworks and firecrackers into
the Special Zone, and the passage shall be granted after the
second line checkpoint of the Special
Zone has verified the
permits. |

Article 6 If a
unit or a individual has violated these rules, the fireworks
shall be confiscated, a fine of
2,000 RMB shall be imposed on
the directly responsible person of the unit and the doer
according
to the circumstances, and an administrative detention
of less than 15 days may be imposed according to Article 19
of Regulations of the People' s Republic of China on Punishments in Public
Order and Security Administration. In case of causing fire
or explosion accidents, injuring people, and damaging property,
the compensation
shall be made for the loss, if the criminal law
has been violated, the criminal responsibility shall be
ascertained according to law. If a minor at the age of less than
14 has violated these rules, the minor
shall be immune from
punishments, but the guardian shall be held liable for damage
compensation. |

Article 7 If a
unit or individual has performed meritorious service in
reporting the violation of these rules
to the authorities, the
department of public security shall grant an award. |
|
Article 8 If
there is any conflict between these rules and the related rules
promulgated by the municipal
people' s government and the
related departments in the past, these rules shall be taken as
the
standards. |

Article 9 These
rules shall take effect as of January 1, 1991. |
