Procedures of Shanghai Municipality on Administration of Lightning Protection

| (Promulgated on February 25, 2000 by the Shanghai Municipal People' s Government) Article 1 Purpose For the purposes of strengthening the administration of lightning protection, taking precautions against and alleviating lightning disasters, these Procedures are formulated in accordance with the Meteorological Law of the People' s Republic of China and in the light of specific circumstances of Shanghai. Article 2 Scope of Application These Procedures apply to the lightning-protective activities within this Municipality' s administrative areas such as the design, construction and check and acceptance test of lightning-protection engineering, and the inspection and test of lightning protective equipment as well as related administrative activities. Article 3 Responsible and Coordination Departments The Shanghai Municipal Meteorological Bureau (hereinafter referred to as SMMB) is this Municipality' s competent meteorological authority responsible for the administration of lightning protection in Shanghai. The district and county competent meteorological department is responsible for the administration of lightning protection within their respective jurisdiction according to the division of duties. This Municipality' s administrative departments of public security, fire prevention, technological supervision, city planning, urban construction , housing and land shall, according to their respective duties, cooperate with the competent meteorological authority to implement these Procedures. Article 4 Where to Install Lightning Protectors The following premises or facilities shall be equipped with lightning protectors : 1. Lightning-protective structures and buildings of grades 1,2 and 3 under the provisions of the buildings' lightning-protection design standards; 2. Premises for the production and storage of petroleum and chemicals; 3. Electricity generation facilities and electricity transmission and distribution systems; 4. Main facilities of social public service systems such as post and telecommunication, communication and transportation, broadcasting and television, medical and health, finance and securities, and computer information; 5. Other premises and facilities that shall be equipped with lightning protectors according to laws, regulations and rules, and relevant technological standards. Article 5 Control of Qualification of Design and Construction of Lightning-Protection Engineering The design and construction units of structures' and buildings' lightning-protection engineering in Shanghai shall hold the qualification certificates of engineering project design and construction issued by the construction administration department. The specialized lightning-protection engineering design and construction units not included in the previous Clause shall complete the qualification grade accreditation formalities according to relevant provisions set by the State competent meteorological authority. Article 6 Requirements for Lightning-protection Engineering Design The lightning-protection engineering design units shall make designs on the basis of the regularity of the local lightning' s activities, and the external conditions such as geography, geology, soil and environment, etc., and in the light of the scope of protection and the objects of lighting protection, and in strict accordance with the lightning-protection design standards set by the State and this Municipality. Article 7 Examination and Verification of Lightning-protection Engineering In case the public security fire-fighting organizations examine and verify fire prevention that involve lightning- protection engineering and needs the assistant examination and verification or technological expounding and proving of SMMB, the SMMB shall offer its opinion of examination or proof. As for the lightning-protection engineering under Item 4, Article 4 of these Procedures, the construction unit shall send the design schemes, drawings and related materials of lightning-protection engineering directly to the SMMB for examination and verification. In case altering the design of lightning-protection engineering needs to be altered, the construction unit shall report for approval according to the original examination and approval procedure. Article 8 Procedure of Examination and Verification In case the lightning-protection engineering is involved during the examination and verification of fire prevention, the public security fire-fighting organization shall conduct examination and verification according to the procedure and time limit of examination and verification stipulated by laws and regulations. As for the lightning-protection engineering examined directly by the SMMB, the SMMB shall make the examination and verification decision within 20 days from the date of receiving the application materials and issue the design examination and verification papers for those that meet the design requirements. The SMMB shall make the decision of refusing design examination and verification for those that fail to meet the design requirements, and notify the applicants in writing. Article 9 Construction of Lightning-Protection Engineering The construction unit of lightning-protection engineering shall perform the construction according to the design papers examined and approved , and accept the technological guidance of the SMMB. Article 10 Check and Acceptance of Lightning-Protection Engineering In case the lightning- protection engineering is involved in the check and acceptance of fire prevention and the public security fire-fighting organization needs the participation of the SMMB in the check and acceptance of lightning-protection, the SMMB shall issue a check and acceptance report for the lightning- protection engineering. As for the lightning-protection engineering that is examined verified by the SMMB, the construction unit shall apply with the SMMB for the check and acceptance of the lightning-protection engineering. The lightning-protection engineering that do not undergo or fail to pass the check and acceptance shall not be put into use. Article 11 Lightning Protector Testing Organization The establishment of lightning protective equipment testing organizations shall be examined and verified by the SMMB jointly with the public security fire-fighting organizations. After receiving the metrological accreditation of the technological supervision department, the testing shall start according to the verified testing items and scope. The lightning protective equipment inspecting and testing organizations may accept the entrustment of lightning-protection engineering building, design and construction units to provide technological services for lightning-protection engineering. Article 12 Inspecting and Testing of Lightning Protective Equipment The unit that uses the lightning protective equipment installed according to the provisions of Article 4 of these Procedures shall do a good job of routine maintenance and pass the annual inspection by the lightning protective equipment inspecting and testing organization. The lightning-protection engineering completed in the current year shall apply for the test of lightning protective equipment before being put into use. The real estate management enterprises shall do a good job of daily maintenance of lightning protective equipment of residential housing. High-rises with 19 storeys and more shall pass the annual inspection and test by the lightning protective equipment inspecting and testing organization. As for housing with 18 storeys and less, the real estate management enterprises may, according to the needs, apply for inspection and test with the lightning protective equipment inspecting and testing organization. Article 13 Handling of Inspection and Test Results After completing the inspection and test, the lightning protective equipment inspecting and testing organization shall send the test report to the entrusting unit, which shall make a timely rectification of the lightning protective equipment that fail to meet the requirements of the technological standards. Article 14 Standards of Inspection and Test The lightning protective equipment inspecting and testing organization shall carry out inspecting and testing work according to relevant provisions of laws, regulations and rules as well as technological standards. The lightning protective equipment inspecting and testing organization shall present inspection and test data that are fair and accurate , and bear appropriate responsibilities as agreed on. Article 15 Administration of Lightning-Protective Product Quality Lightning-protective products shall meet the quality requirements set by the State and this Municipality and shall pass the inspection by the technological supervision department or its authorized agency. Sale and use of substandard or banned lightning-protective products are forbidden. Article 16 Monitoring and Protecting, Forewarning, and Scientific Research of Lightning Protection This Municipality' s meteorological organizations at all levels of this Municipality shall intensify the monitoring and detecting, and forewarning of lightning, organizing the scientific research of lightning protection and the popularization and application of lightning-protective technology. Article 17 Investigation and Appraisal of Lightning Accidents This Municipality' s subdistricts, villages, townships and all units shall, according to relevant regulations, report timely the casualties and property losses caused by lightning stroke in their regions and in the units, and concurrently report to the SMMB or the local meteorological regulatory agency. This competent meteorological authority at all levels shall assist relevant departments in investigating and appraising the lightning accidents and in identifying the cause of the accidents. Article 18 Handling of Wrongful Acts Those who violate the provisions of Article 4, Clause 2 of Article 5, Clause 2 of Article 7, Clause 2 of Article 10 and Article 12 shall be ordered to make correction, or be criticized in circular notices by the SMMB or the related district and county competent meteorological authority. The acts in violation of these Procedures, which shall be punished as stipulated by laws, regulations and rules, shall be dealt with according to relevant provisions. Article 19 Administrative and Civil Liabilities If the violation of these Procedures causes lightning-stroke fires, explosions, casualties and heavy property losses, the administrative liability of the unit and person held liable shall be investigated according to law, and the unit and person concerned shall have appropriate civil liability according to law. Article 20 Protection of Power Facilities Against Thunderbolt Electric power administrative departments shall take charge of the design, construction and check and acceptance of lightning-protection engineering of power generating facilities, high-tension lines and grid transformer stations, and accept the supervision and guidance of the SMMB. Article 21 Definition The definitions of the terms in these Procedures are as follows: 1. Lightning-protection engineering: Construction projects of lightning protection. Based on their performance, they are specifically divided into: Direct lightning stroke protection engineering: A construction project of system installation which is composed of lightning arrester (including lightning rod, band, line or net), down lead, grounding and other connecting conductor, with the performance of guarding against direct lightning stroke. Lightning electromagnetic impulse protection engineering: A construction project of system installation which is composed of electromagnetic screen, isoelectric connection, common grounding net, surge protector and other connecting conductor, with the performance of guarding against lightning electromagnetic impulse (including lightning induction and lightning wave intrusion). 2. Lightning protective equipment: a general name for lightning arrester, down lead, rounding, surge protector and other connecting conductor, with the performance of guarding against direct lightning stroke, lighting induction and lightning wave intrusion. Article 22 Department for Interpretation of Application The SMMB may interpret these Procedures in their specific application. Article 23 Date of Implementation These Procedures shall become effective on May 1, 2000. |
