Procedures of Shanghai Municipality on the Administration of Fire Hydrants

(Promulgated by Decree No. 81 of the Shanghai Municipal People' s Government on April 27, 2000) Article 1 Purpose and Basis With a view to strengthening the management of fire hydrants, preventing and minimizing fire hazards and protecting the personal safety of citizens and the safety of public and private property, these Procedures have been formulated in accordance with the Law of the People' s Republic of China on Fire Prevention and Control (hereinafter referred to as the Fire Prevention and Control Law) and the Regulations of Shanghai Municipality on Fire Prevention and Control (hereinafter referred to as Fire Prevention and Control Regulations). Article 2 Definition For the purpose of these Procedures, fire hydrants refer to water supply devices and their accessory equipment, consisting of valves, water outlets and their casings, that are connected to the water supply mains and used for the exclusive purpose of fire prevention and extinguishment. They include specifically: 1.Fire hydrants provided and constructed on municipal roads (hereinafter referred to as municipal fire hydrants); 2.Fire hydrants provided and constructed by units (hereinafter referred to as units' fire hydrants); and 3.Fire hydrants provided and constructed in residential quarters (hereinafter referred to as residential quarter' s fire hydrants). Article 3 Competent Authority Shanghai Municipal Public Security Bureau hereinafter referred to as Municipal Public Security Bureau is the competent authority in charge of the supervision and management of the fire hydrants in this Municipality. Public security fire prevention and control organizations at different levels are in charge of specific aspects of the supervision and administration of fire hydrants. Article 4 Responsibilities for Planning, Provision and Construction Municipal engineering and water supply administration departments shall be responsible for the planning, provision and construction of fire hydrants on municipal roads required by regulations; the planning, provision and construction of fire hydrants in residential quarters required by regulations are the responsibility of the construction units. Article 5 Construction Standards The construction design of fire hydrants and their water supply pipelines shall meet the technical standards of the state and this Municipality for fire protection of construction projects. The Municipal Public Security Bureau jointly with the planning and construction administration departments shall formulate the technical standards for fire protection of construction projects in this Municipality. Article 6 Examination of Schemes and Product Quality The installation scheme of fire hydrants shall be examined and approved by public security fire prevention and control organization before being implemented. The quality of fire hydrants shall meet state or professional standards. Article 7 Requirements for Construction The construction of fire hydrants shall be carried out in accordance with the design and scheme examined and approved by public security fire prevention and control organization. Upon completion, they shall be checked and accepted by the public security fire prevention and control organization before being put into use. Municipal fire hydrants shall be installed on sidewalks, 0.5 meters from the edge of the carriageways. Outdoor fire hydrants in units or residential quarters shall be located on either side of the fire passages or crossings of such passages in the area. Fire hydrants installed above the ground shall have their large water outlets facing the road or the middle of the fire road, with their main body visible above the ground. Their water supply switches shall be located within 2 meters of the fire hydrants. Article 8 Formalities for Temporary Use If it is indeed necessary to use on a temporary basis outdoor hydrants on municipal roads or in residential areas for plant-watering, sanitation or construction purposes, the user units shall go through the necessary formalities with the water supply units for the use of running water and obtain the permit for temporary use of fire hydrants upon the approval of public security fire prevention and control organization before such uses. Those who make unauthorized use of fire hydrants shall pay afterwards to the water supply units 10-fold the normal water supply rates. Article 9 Requirements for Temporary Use Those making temporary use of outdoor fire hydrants on municipal roads or in residential quarters shall use them at the time and place specified in the permit for temporary use of fire hydrants and have people specially appointed for their operations, and under no circumstances may they damage or change the original conditions of the fire hydrants. Should fires occur in the surrounding areas in the course of their use, the users must terminate their use and restore them to their original conditions. Article 10 Maintenance Units Municipal fire hydrants and outdoor hydrants in residential quarters shall be maintained and serviced on a regular basis by public security fire brigades of their localities. Units' fire hydrants and indoor fire hydrants in residential quarters shall be maintained and serviced by personnel specially designated by units or property management units concerned. Article 11 Requirements for Maintenance Maintenance units shall strengthen their maintenance and service of fire hydrants. Maintenance and service operations shall be conducted at least once in a quarter. A special check-up shall be made on the eve of an important holidays or celebration activity in accordance with the specific requirements laid down by the municipal public security fire prevention and control organization. Maintenance units shall lose no time in replacing or repairing missing or damaged parts of fire hydrants identified in the course of their maintenance, service or check-up operations, so as to ensure that they are in good conditions and can be used effectively. Article 12 Provisions on Dismantlement and Relocation If dismantlement or relocation of fire hydrants is necessary because of the needs of urban construction, they shall be subject to the examination and approval by the public security fire prevention and control organization. Article 13 Time Limit for Examination and Verification The public security fire prevention and control organization shall examine and verify the installation plan of fire hydrants, approve their dismantlement or relocation, and conduct their check and acceptance upon completion within the time limit stipulated by relevant provisions of fire control supervision procedures formulated by the State and this Municipality. Article 14 Regulations on Prohibited Acts All units and individual persons have the duty to protect the fire hydrants, and shall report promptly to public security fire prevention and control organization any acts damaging the fire hydrants. The following acts are prohibited: 1.Burying, covering up, or enclosing and occupying fire hydrants; or 2.Using, dismantling, or suspending the use of fire hydrants without authorization, or damaging them. Those who damage the fire hydrants shall pay damages for the losses. Article 15 Legal Liability Any acts in violation of these Procedures shall be punished in accordance with the provisions of the Fire Prevention and Control Law and the Fire Prevention and Control Regulations, provided they are covered by such provisions. Where the wrongful act is not covered by the Fire Prevention and Control Law and the Fire Prevention and Control Regulations, it shall be punished in accordance with the following provisions: 1.Any unit or property management unit that fails to perform their duties for the maintenance and servicing of the fire hydrants as required, thus affecting the normal use of the fire hydrants, shall be ordered by the public security fire prevention and control organization to make corrections. If it fails to make corrections within the specified time limit, the chief person directly responsible for such failure and other responsible personnel shall be given warnings. 2.The units that violate the regulations on the temporary use of fire hydrants shall be given warnings by the public security fire prevention and control organization and be penalized with a fine of 200 to 1000 yuan inclusive. Article 16 Public Security Punishment Anyone whose act violates the provisions of these Procedures shall be subjected to the security administration punishment and is to be punished by the public security department in accordance with the Regulations of the People' s Republic of China on Public Security Administration and Imposition of Punishment; if his/her act constitutes a crime, he/her shall be prosecuted in accordance with law. Article 17 On-the-Sport Enforcement When it is foreseeable that a decision on the payment of damages or the imposition of a fine against the act of damaging hydrant(s) in violation of these Procedures shall be difficult to be enforced afterwards, this decision may be enforced on the spot. However, if the party concerned gives a security, the decision may not be enforced on the spot. Article 18 Department for Interpretation in Application The Municipal Public Security Bureau may interpret these Procedures in their specific application. Article 19 Date of Coming into Effect These Procedures shall become effective on August 1, 2000. The Procedures of Shanghai Municipality on the Administration of Fire Hydrants approved by the Shanghai Municipal Revolutionary Committee on April 19, 1978 shall be repealed at the same time. |
