Procedures of Shanghai Municipality on the Protection of Aviation Gasoline Pipelines of Civil Airport

(Promulgated by Shanghai Municipal People's Government on October 18, 1999) Article 1 Purpose and Basis These Procedures are formulated with a view to protecting the aviation gasoline pipelines of civil airports in this Municipality (hereinafter referred to as aviation gasoline pipelines), ensuring the normal operation of civil airports in this Municipality and the security of the lives and property of the people living along the pipelines. Article 2 Definition Aviation gasoline pipelines mentioned in these Procedures include aviation gasoline pipelines of Pudong International Airport and Hongqiao International Airport and the auxiliary facilities thereof. Auxiliary facilities of aviation gasoline pipelines include kilometer posts, corner posts, sacrificial positive pole testing posts, sacrificial positive poles, pipeline cutoff valve wells, and warning boards along the pipelines, as well as tubes for pipelines going through roads and rivers. Article 3 Application These Procedures apply to the protection of aviation gasoline pipelines and related administrative activities. Article 4 Duties of Administrative Organs The Office of the Airport Administrative Commission of Shanghai Municipality (hereinafter referred to as the Municipal Airport Office) shall be responsible for organizing the implementation of these Procedures. Public security departments shall be responsible for imposing administrative penalties on acts that endanger the security of the aviation gasoline pipelines and acts that violate administrative provisions on fire prevention. Planning, construction, housing and land, municipal engineering, public utilities, agricultural, water conservancy, transportation, environmental protection and other related administrative departments, as well as district and county people's governments concerned, shall cooperate in the implementation of these Procedures in accordance with their respective duties. Article 5 Units Responsible for Routine Protection Units operating the aviation gasoline pipelines shall be responsible for the routine patrolling and checking and maintenance of the pipelines in accordance with these Procedures, so as to ensure their safe operation, and subject themselves to the guidance and supervision of relevant administrative departments. If there are any acts endangering the safety of the aviation gasoline pipelines, the pipeline operating units shall dissuade the wrongdoers to stop the wrongful acts at once and, if the wrongdoers refuse to stop doing such wrongful acts, the aviation gasoline pipeline operating units shall promptly report the wrongful acts to the Municipal Airport Office, public security department or other administrative departments concerned. Article 6 Delimitation of the Protected Zone The protected zone of aviation gasoline pipelines covers the following areas: 1. 5 meters on either side of the center line of the pipelines; and 2. 5 meters around the pipeline cutoff valve wells, sacrificial positive pole devices and other auxiliary facilities. Article 7 Prohibited Acts The following acts are prohibited in the protected zone of aviation gasoline pipelines: 1. Dumping or stacking combustible or explosible materials; 2. Dumping or discharging poisonous or hazardous solid wastes or waste liquids; or 3. Other acts endangering the safety of aviation gasoline pipelines. Covering, moving, climbing and hanging oneself on, or damaging auxiliary facilities of aviation gasoline pipelines and permanent identification markers is prohibited. Anchoring or clubbing by ships is prohibited in the 50ª²meter water area on either side of the center line of the aviation gasoline pipelines across the beds of Chuanyang River and Pudong Canal and in the 20-meter water area on either side of the center line of the aviation gasoline pipelines across the beds of other rivers. Article 8 Restricted Acts in the Protected Zone The following acts in the protected zone of aviation gasoline pipelines shall first be approved by the Municipal Airport Office before their implementation: 1. Digging wells, ditches, canals, pits or ponds; 2. Dumping or stacking sand, gravel, bricks, tiles, timber, metals or other materials; 3. Planting trees or other plants with deep roots; or 4. Parking heavy motor vehicles or construction machinery. The construction of buildings or other structures in the protected zone of aviation gasoline pipelines shall first be approved by the Municipal Airport Office before going through the necessary examination and approval procedures in accordance with relevant regulations. Article 9 Restricted Acts in the 50-meter Zone When it is necessary to do any of the following acts in the 50-meter area on either side of the center line of aviation gasoline pipelines, approval by the Municipality Airport Office shall be obtained before going through the examination and approval procedures as required: 1. Demolition; or 2. Building large scale construction works. When it is necessary to conduct dredging operations in the 50-meter area on either side of the center line of the aviation gasoline pipelines, prior approval of the Municipal Airport Office shall be obtained. Article 10 Time Limit for Examination and Verification When it is necessary for the Municipal Airport Office to examine and verify restricted acts in accordance with these Procedures, it shall give its opinion in writing within 5 working days from the date of accepting the application. Article 11 Protection in the Course of Construction When carrying out with approval the acts specified in Articles 8 and 9 of these Procedures, the builder shall formulate schemes for the protection of the aviation gasoline pipelines jointly with the construction unit and submit them in writing to the aviation gasoline pipelines operating unit 10 days before the start of the work. The builder and the construction unit shall accept the suggestions for improvements, if any, made by the aviation gasoline pipelines operating unit to such schemes. If any dispute arises between the aviation gasoline pipelines operating unit on the one hand and the builder and the construction unit on the other, the parties to the dispute may apply for arbitration by the Municipal Airport Office. In the course of the construction, the aviation gasoline pipelines operating unit may assign its personnel for on-site inspection. Article 12 Reporting Wrongdoing Any individual person or unit may report to the Municipal Airport Office, public security organs or other relevant administrative authorities acts endangering the safety of aviation gasoline pipelines. Article 13 Commendations and Rewards The Municipal Airport Office shall commend and reward those units or individual persons that have rendered meritorious services in ensuring the safe operation of aviation gasoline pipelines, preventing the occurrence of accidents or in the rescue operations after the occurrence of accidents. Article 14 Legal Liability Any of the following acts in violation these Procedures shall be dealt with by the public security department in accordance with relevant regulations on administration of public security and fire prevention: 1. Covering, moving, climbing and hanging oneself on or damaging auxiliary facilities of aviation gasoline pipelines and permanent identification markers; 2. Dumping or stacking combustible or explosible goods in the protected zone of aviation gasoline pipelines; 3. Conducting demolitions in the 50ª²meter areas on either side of the center line of the pipelines without approval; or 4. Other acts endangering the safety of the pipelines. Dumping or discharging poisonous or hazardous solid wastes or waste liquids in the protected zone of the pipelines shall be dealt with by environmental protection administrative departments in accordance with law. The construction of buildings or structures in the protected zone of the pipelines without approval or building large scale construction works in the 50-meter areas on either side of the center line of the pipelines without approval shall be dealt with by planning administrative authorities in accordance with law. In case of any of the following acts in violation of these Procedures, the Municipal Airport Office shall order the wrongdoers to stop their wrongful acts. It may also order them to carry out removal or restoration at once or within specified time limit. If those wrongdoers refuse to carry out removal or restoration, the Municipal Airport Office may instruct the pipelines operating unit to carry out the removal or restoration on their behalf and at their expenses: 1. Anchoring or trawling of anchors by ships in the 50-meter water area on either side of the center line of the pipelines across the beds of the Chuanyang River and Pudong Canal and in the 20-meter water area on either side of the center line of the pipelines across the beds of other rivers; 2. Digging wells, ditches, canals, pits or ponds in the protected zone of the pipelines without examination and approval; 3. Dumping or stacking sand, gravel, bricks, tiles, timber, metal or other materials in the protected zone of the pipelines without examination and approval; 4. Planting trees or other plants with deep roots in the protected zone of the pipelines without examination and approval; 5. Parking heavy motor vehicles or construction machinery in the protected zone of the pipelines without examination and approval; or 6. Conducting dredging operations in the 50-meter area on either side of the center line of the pipelines without examination and approval. If such wrongful acts result in any damages to property, the wrongdoer shall be held liable for such damages. Those who cause damages to the pipelines in violation of these Procedures, thus disrupting the normal operation of civil airports of this Municipality, or who refuse or interfere with pipelines management personnel in performing their duties in accordance with law, shall be penalized by the public security department in accordance with Regulations of the People's Republic of China on Public Security Administration and Imposition of Punishment. Those whose acts constitute crimes shall be prosecuted for their criminal liability according to law. Article 15 Date of Implementation These Procedures shall become effective on November 15, 1999. |
