ENFORCEMENT RULE OF THE ACT ON THE
CREATION AND FACILITATION OF USE OF SMART GRIDS
Ordinance of the Ministry of Knowledge Economy No. 211, Nov. 24, 2011
Article 1 (Purpose)
The purpose of this Rule is to provide for matters delegated pursuant to the Act on the Creation and Facilitation of Use of Smart Grids and the Enforcement Decree of said Act and matters necessary for the enforcement thereof.
Article 2 (Smart Grid Technologies)
"Technologies specified by Ordinance of the Ministry of Knowledge Economy for the creation and use of smart grids" in subparagraph
4 of Article 2 of the Act on the Creation and Facilitation of Use of Smart Grids (hereinafter referred to as the "Act")
mean technologies under any of the following
subparagraphs:
1. Technologies for improving the efficiency of electric power demand management and electric power trade or for improving the stability,
security, or efficiency of operation of smart grids by utilizing
information and communications technologies;
2. Technologies for improving the efficiency in the use of energy by inducing electricity users to use electric power in a reasonable
manner through exchange of smart grid information;
3. Technologies for establishing and operating infrastructure for charging electric motor vehicles or improving the stability of
smart grids in connection with such infrastructure;
4. Technologies for connecting new and renewable energy defined in subparagraph 1 of Article 2 of the Act on the Promotion of the
Development, Use and Diffusion of New and Renewable Energy.
Article 3 (Application for Registration of Smart Grid Businesses, etc.)
(1) An application for the registration (modified registration) of a smart grid business under Article
8 (1) or 9 (1) of the Enforcement Decree of the Act on the Creation and Facilitation of Use of
Smart Grids (hereinafter referred to as the "Decree") shall be prepared in attached Form 1 attached hereto.
(2) An application for registration (modified registration) under paragraph (1) shall be accompanied by the following documents
(referring only to modified documents already submitted along with
the relevant registration application in cases of modified registration). In such cases, upon receipt
of an application pursuant to Article 12 of the Act and subparagraph 2 of Article 19 of the Decree, the head of the Smart Grid Association
(hereinafter referred to the "head of the Association") shall
verify the certified transcript of records on the relevant corporate register (applicable only to cases
where an applicant is a corporation), the relevant business registration certificate, and the certificates of national technical
qualification under the National Technical Qualifications Act by sharing and
using the administrative information pursuant to Article 36 (1) of the Electronic Government Act,
but if an applicant does not consent to verifying the business registration certificate or the certificates of national technical
qualification under the National Technical Qualifications Act by matching admin-
istrative information, the applicant shall submit copies of relevant documents with the relevant
application:
1. Business plan;
2. Documents evidencing capital;
3. Other documents evidencing that the applicant meets the criteria for the registration of smart grid
businesses under Article 8 (2) of the Decree and the scope of business activities.
(3) The Minister of Knowledge Economy may authorize the head of the Association to issue a certificate of smart grid business
in attached Form 2 when he/she accepts registration pursuant to Article
8 (3) of the Decree.
(4) If a person who has obtained a registration certificate issued pursuant to paragraph (3) loses the registration certificate or
it is mutilated, he/she may file an application for the re-issuance of the
registration certificate. When an application for the replacement for a mutilated registration certificate
is filed, the registration certificate shall be submitted along with the application.
(5) Upon receipt of an application for the re-issuance of a registration certificate pursuant to paragraph (4), the head of the
Association shall verify whether the applicant is a registered smart grid business and then re-issue the registration certificate.
Article 4 (Application for Certification, etc.)
(1) Persons eligible for filing an application for the certification under Article 15 (1) of the Act shall be as follows:
1. A person who produces an instrument or a product for smart grids;
2. A person who provides smart grid services;
3. An owner of a building in which an instrument or a product for smart grids is installed.
(2) If a person under any subparagraph of paragraph (1) intends to obtain certification, he/she shall file an application for
certification with the Minister of Knowledge Economy or the head of a certifying
agency, along with documents evidencing that his/her business meets the standards for certification
under Article 11 of the Decree.
(3) Upon receipt of an application for certification under paragraph (2), the Minister of Knowledge Economy or the head of a certifying
agency shall issue a letter of certification to the applicant if he/she finds that the application meets the standards for
certification under Article 11 of the
Decree.
(4) A person who obtains certification in accordance with Article 15 (1) of the Act may place the certification mark on the relevant
product or document to show that the product is certified.
(5) More detailed matters necessary for certification, including the application for certification under paragraph (2), the letter
of certification under paragraph (3), and the certification mark under paragraph (4), shall be determined and publicly notified
by the Minister of Knowledge Economy.
Article 5 (Application for Designation of Certifying Agency, etc.)
(1) A person who intends to have his/her business designated as a certifying agency under Article
16 (1) o the Act shall file an application for designation as a certifying agency with the Minister of Knowledge Economy in attached
Form 3, along with the following documents. In such cases,
upon receipt of an application for designation, the Minister of Knowledge Economy shall verify the certified transcript of records
on the relevant corporate register (applicable only to cases where an applicant is a corporation) or the certified transcript
of the resident registration card of the
representative (applicable only to cases where an applicant is not a corporation) by sharing and using the administrative information
pursuant to Article 36 (1) of the Electronic Government Act, but if an applicant does not consent to verifying the certified transcript
of the resident registration
card of the representative by sharing and using administrative information, the applicant shall submit the document along with
the relevant application:
1. Articles of incorporation;
2. A business plan describing the field or scope of certification;
3. Documents regarding the composition of the organization exclusively performing the certification and the current status and performance
of professional experts;
4. Regulations on certification, including the procedure for certification;
5. Other documents proving that the standards for the designation of certifying agencies under Article
12 of the Decree are met.
(2) Upon receipt of an application for designation as a certifying agency pursuant to paragraph (1), the Minister of Knowledge
Economy shall issue a letter of designation of a certifying agency to
the applicant in attached Form 4, if he/she finds that the standards for the designation of certifying
agencies under Article 12 of the Decree are met, and shall give public notice of the designation. In such cases, the Minister
of Knowledge Economy may conduct a field assessment in order to
ensure that the standards for the designation of certifying agencies are met.
Article 6 (Application for Designation of Assisting Institutions, etc.)
(1) A person who intends to have his/her institution designated as an institution assisting in the promotion of the smart
grid industry under Article 19 (1) of the Act (hereinafter referred to as "assisting
institution") may file an application for designation as an assisting institution with the Minister
of Knowledge Economy in attached Form 5, along with the following documents. In such cases, upon receipt of an application for designation,
the Minister of Knowledge Economy shall verify
the certified transcript of records on the relevant corporate register (applicable only to cases where
an applicant is a corporation) or the certified transcript of the resident registration card of the representative (applicable
only to cases where an applicant is not a corporation) by sharing and
using administrative information pursuant to Article 36 (1) of the Electronic Government Act, but
if an applicant does not consent to verifying the certified transcript of the resident registration card of the representative
by sharing and using administrative information, the applicant shall submit
the document along with the relevant application:
1. Articles of incorporation;
2. Documents proving the results of performance of the relevant business activities under subparagraph
2 of Article 14 of the Decree;
3. Documents regarding the composition of the exclusively responsible organization under subparagraph
3 of Article 14 of the Decree and the current status and career of professional experts;
4. Other documents evidencing full compliance with that the requirements under subparagraph 4 of
Article 14 of the Decree.
(2) Upon receipt of an application for designation as an assisting institution pursuant to paragraph (1), the Minister of Knowledge
Economy shall issue a letter of designation of an institution assisting in the promotion of the smart grid industry to the
applicant in attached Form 6, if he/she finds
that the standards for the designation of assisting institutions under Article 14 of the Decree are met, and shall notify the
public of the designation. In such cases, the Minister of Knowledge Economy may conduct a field assessment in order to ensure
that the standards for the designation of assisting
institutions are met.
Article 7 (Petition for Mediation, etc.)
(1) A petition for mediation under Article 15 (1) of the Decree shall be prepared in attached Form
7.
(2) If a smart grid business intends to apply for mediation pursuant to Article 15 (1) of the Decree, it shall file a petition for
the mediation in attached Form 7, along with the following documents:
1. A statement of developments in negotiations on the dispute between the parties (referring to details of negotiations between
the parties in a chronological order from the time when a dispute subject
to mediation arose until the time the application is filed and documents evidencing such developments);
2. Other objective data that can serve as references for the mediation of the case.
Article 8 (Identification Certificates)
A certificate under Article 17 (2) of the Decree shall be in attached Form 8.
ADDENDA
This Rule shall enter into force on November 25, 2011.
