[Effective March 4, 2008] [Regulation No. 1 of Ministry of Education, Science and Technology, March 4, 2008. Amendment of Other Laws and Regulations] Ministry of Education, Science and Technology (Digital Local Education Finance Team) 02-2100-6530
Article 1 (Purpose)
The purpose of this Enforcement Regulation is to provide for the matters delegated
by the Local Education Subsidy Act and its Enforcement
Decree and other matters
necessary for the enforcement thereof.
Article 2 (Scope of Personnel Expenses for Teachers)
Personnel expenses for teachers as referred to in Article 2 (2) of the Enforcement
Decree of the Local Education Subsidy Act (hereinafter referred to as the
"Enforcement Decree") shall be the aggregate of the amounts
falling under any of
the following subparagraphs.
1.Salaries and salary-adjusting allowances paid to educational personnel and staff
engaged in public elementary and middle schools
according to the Remuneration
Regulations for Public Officials;
2.Allowances and out-of-pocket expenses (hereinafter referred to as "allowances,
etc.") paid to educational personnel and staff
engaged in public elementary and
middle schools according to the Regulations on Allowances, etc. for Public
Officials; and
3.Salaries, salary-adjusting allowances and other allowances subject to
subparagraphs 1 and 2, and paid to teachers of private schools
that implement
compulsory education for students as entrusted by Article 12 (3) of the
Elementary and Secondary Education Act.
Article 3 (Submittal of Estimation Data for Subsidies)
(1) The heads of educational administrative institutions in the Special Metropolitan
City, Metropolitan Cities, Dos and Special Self-Governing Do (hereinafter
referred to as the "Cities/Dos") shall submit data necessary
for estimation of
subsidies to the Minister of Education, Science and Technology by the end of
June of the previous year.
(2) The Minister of Education, Science and Technology may conduct examination
of related data to confirm whether the data submitted
by the heads of educational
administrative institutions in Cities/Dos as referred to in paragraph (1) are
prepared according to
facts.
Article 4 (Notice of Granting General Subsidies)
(1) The Minister of Education, Science and Technology shall notify the heads of
educational administrative institutions in Cities/Dos
of the total amount of
general subsidies to be granted to the Cities/Dos by end of February, every year:
Provided, that, in the
event that the total amount of general subsidy for a City/Do
is changed due to special reasons such as change of the entire amount
allotted for
general subsidies for the concerned year, the Minister of Education, Science and
Technology shall notify the head
of educational administrative institution
concerned of such change.
(2) The Minister of Education, Science and Technology may notify in advance the
heads of educational administrative institutions
in Cities/Dos of the expected
amount of general subsidies before each fiscal year begins.
Article 5 (Grant of Special Subsidies)
(1) When a head of educational administrative institutions in Cities/Dos file
application for special subsidies as referred to in
the former part of Article 5-2 (2)
of the Local Education Subsidy Act (hereinafter referred to as the "Act"), he/she
shall submit
a project plan containing the necessity of the project and the
expected investment effect along with other related documents needed
for
granting special subsidies to the Minister of Education, Science and Technology.
(2) The Minister of Education, Science and Technology shall grant special
subsidies at the periods falling under any of the following
subparagraphs:
Provided, that the period of granting special subsidies for policy project demand
in subparagraph 1 may be adjusted
for smooth proceeding of the project.
1. National policy project demand: January 31 of every year;
2. Pending demand for local education: when educational pending demand has been
generated in the concerned region; and
3. Disaster countermeasures demand: when the disaster countermeasures demand
has been generated
Article 6 (Execution of Special Subsidies)
Special subsidies shall be appropriated in the budget of Cities/Dos for the concerned
year and thus executed: Provided, that subsidy
whose usage has been designated and
the entire amount in need has been granted, as well as subsidy granted for disaster
relief
and restoration, can be executed before any revised supplementary budget is
formulated according to the proviso of Article 45 of
the Local Finance Act.
(1) Formula and unit cost to compute the amount of standard financial demands
according to Article 6 (2) of the Act and Article
4 (4) of the Enforcement Decree
of the Act shall be subject to the Attached Table 1.
(2) Formula and unit cost to compute the amount
of standard financial demands in
view of voluntary efforts according to Article 4 (2) and (4) of the Enforcement
Decree of the
Act shall be subject to the Attached Table 2.

Article 8 (Calculation of Odds)
In computing subsidies, odds of not more than 500won occurred shall be discarded
and odds between 500 won and 1,000 won shall be
treated as 1,000 won.
ADDENDA (Enforcement Regulation of Office Organization of the Ministry of
Education, Science and Technology,
and the Agencies under the Ministry)
Article 1 (Enforcement Date)
This Regulation shall enter into force on the date of its promulgation.
Articles 2 through 4 Omitted.
Article 5 (Amendment of Other Laws and Regulations)
From (1) to <33> Omitted.
<34> A part of the Enforcement Regulation of the Local Education Subsidy Act
shall be amended as follows.
In Article 3 (1) and (2), the main part of Article 4 (1) and Article 4 (2), the main part
other than those of each subparagraph
of Article 5 (1) and (2), the "Minister of
Education and Human Resources" shall be amended to the "Minister of Education,
Science
and Technology."
In the computation formula column and remarks column (2) of the Attached Table 1,
the "Minister of Education and Human Resources"
shall be amended to the
"Minister of Education, Science and Technology."
In the computation formula column of the Attached Table 2, the "Minister of
Education and Human Resources" shall be amended to the
"Minister of Education,
Science and Technology."
