Article 1 (Purpose)
The purpose of these Rules is to provide matters concerning tuition and entrance fees to be collected by national high schools, (hereinafter referred to as "schools"), under the provisions of Article 10 of the Elementary and Secondary Education Act. Article 2 (Amount of Collection)
(1) Tuition and entrance fees of a school shall be determined by the head of the relevant school, and they shall be the same amount as for public schools in the same area where the relevant school is located, (referring to Gu for the Special Metropolitan City and the Metropolitan City, and City or Eup/Myeon for other areas, and referring to neighboring Eup/Myeon where public high schools exist in cases where no public high school exists in the same Eup/Myeon).
(2) Where deemed necessary by taking into account the actual conditions of each school
and changes in financial circumstances, notwithstanding
Paragraph (1), tuition and
entrance fees may be determined differently from public schools. In this case, the
head of a school
shall obtain the prior approval of the Minister of Education, Science,
and Technology.
1. Tuition and entrance fees may be exempted or reduced for all or any part of students
depending on the actual conditions of the
relevant school;
2. Tuition and entrance fees may be exempted or reduced for a student having financial
difficulties and a student for whom it is
deemed necessary for the extension of his/her
athletic specialty, such as sports, or the encouragement of his/her learning. In this
case,
the amount of any reduction for a student having financial difficulties shall be no less
than fifty percent; and
3. If the payment of tuition and entrance fees is deemed difficult due to natural disasters,
tuition and entrance fees may be exempted
or reduced.
(2) For persons subject to an exemption of tuition and entrance fees under the Act on the
Honorable Treatment and Support
of Persons, etc. of Distinguished Services to the
State and other laws and regulations, tuition and entrance fees shall be exempted
as
prescribed by the relevant laws and regulations.
(3) The range of tuition and entrance fees exempted or reduced under Subparagraph 2 of
Paragraph (1) shall not exceed twenty percent
of the total amount of collection.
(4) For a student on temporary leave, tuition for the period of temporary leave shall be
exempted.
(5) Where school classes have been suspended until the total period of the preceding
term or preceding month, tuition for the relevant
term or month shall be exempted
except during vacation periods.
(6) Tuition shall not be reduced or exempted for absences.
Article 4 (Method of Collection)
(1) Tuition shall be divided evenly and collected over four terms, provided, that the head
of a school may, where necessary, collect
tuition as determined otherwise.
(2) The total amount of entrance fees shall be collected at the time of the entrance of a
student.
(3) When a student is transferred, the collection of tuition and entrance fees shall be
subject to any of the following subparagraphs:
1. Where he/she is transferred to a school of the same level with the same founder and
where the school from which he/she was transferred
has collected tuition and
entrance fees, the school to which he/she is transferred shall exempt fees and tuition
thereof; and
2. Where he/she is transferred to a school of the same level with a different founder, the
school from which he/she is transferred
shall collect entrance fees and tuition up to
the month of the date of said transfer, and the school to which he/she is transferred
shall collect only that tuition from the month following the date of transfer.
(4) Tuition of a student who reenters or transfers
to a school shall be collected from the
date of entrance and the total amount of entrance fees shall be collected.
(5) Tuition
of a student who returns to a school after temporary absence shall be
collected from the date of return.
Article 5 (Collection Date)
(1) The collection date of tuition shall be determined by the head of a school and it shall
not be ten days prior to the beginning
of the relevant month.
(2) The head of a school may, notwithstanding Paragraph (1), determine the collection
date of the initial
tuition and entrance fees for the first academic year within fifty
days prior to the beginning of the semester.
(3) Notwithstanding the provisions of Paragraph (1), with respect to students who pay
tuition by receiving a scholarship or school
expense subsidies, etc., the head of a
school shall not set the date of tuition collection prior to the delivery date of said
scholarship
or school expense subsidy, etc.
Article 6 (Refund, etc. of Tuition, etc.)
(1) Where tuition or entrance fees have been overpaid or erroneously paid, the whole
amount concerned shall be refunded.
(2) Where a student has transferred to a school of the same level with a different founder,
the balance of any tuition paid, exclusive
of tuition to the month of the date of
transfer, shall be refunded.
(3) In any cases falling under any of the following subparagraphs, (hereinafter referred to
as "grounds for refund"), previously
paid tuition or entrance fees shall be refunded
according to the standard as provided for under Paragraph (4):
1. Where a student unable to enter, (including readmission and transfer; hereinafter the
same shall apply), under laws and regulations
or to continue his/her studies;
2. Where a person who has received the permission of admission has indicated his/her
intention of withdrawal from admission;
3. Where an enrolled person has indicated his/her intention to depart a school
voluntarily; and
4. Where a student unable to enter the relevant school or to continue his/her studies due
to disease, death, or natural disaster
or other unavoidable reasons.
(4) The criteria for a refund under Paragraph (3) shall be provided for under any of the
following
subparagraphs:
1. Where the grounds for refund has occurred up until the beginning date of the relevant
semester or the relevant term, (referring
to the date of entrance in cases of entering
students; hereinafter the same shall apply), the total amount of previous paid tuition
and entrance fees shall be refunded; and
2. Where the grounds for refund has occurred after the following date of the beginning
date of the relevant semester or the relevant
term, entrance fees shall not be refunded,
and the balance of tuition, exclusive of tuition paid up until the date of the grounds
for refund, shall be refunded.
(5) The amount of any unpaid tuition of a person who has been expelled from a school or
has left school voluntarily shall not be
collected.
Article 7 (Notification, etc.)
(1) Where the head of a school has determined the collection amount of tuition and
entrance fees of a school under Article 2, he/she
shall immediately notify the public
thereof and report said fact to the Minister of Education, Science, and Technology.
(2) The notification under Paragraph (1) shall be made at least ten days prior to the
beginning date of accepting the application
from a new student.
ADDENDA (ENFORCEMENT RULES OF PRESIDENTIAL DECREE ON THE
ORGANIZATION OF THE MINISTRY OF EDUCATION, SCIENCE,
AND
TECHNOLOGYAND INSTITUTIONS ATTACHED THERETO)
Article 1 (Enforcement Date)
This Act shall enter into effect on the date of its promulgation.
Article 2 Through Article 4 Omitted.
Article 5 (Amendment to Other Laws and Regulations)
(1) Through (12) Omitted.
(13) Part of the Rules on Tuition and Entrance Fees of National High Schools shall be
amended as follows.
The "Minister of Education and Human Resources Development" in the latter part of
Article 2 (2) and Article 7 (1) shall be the "Minister
of Education, Science, and
Technology".
(14) Through (63) Omitted.
