51-6 of its Enforcement Rule (hereinafter referred to as “Enforcement Rule”).
(2) A foreign investor intending to make a report of foreign investment under Article 5 (1), Subparagraphs 4 and 5, Article 7 (1), and Article 121-2 (7) of the Foreign Investment Promotion Act and an application for tax reduction or exemption under Article 121-2 (6) of the Act at the same time shall submit the written report and the written application to the head of a foreign exchange bank (hereinafter referred to as “head of the entrusted agency”) entrusted with authorities by the Minister of Knowledge Economy under Article 40 (2) of the Enforcement Decree of the Foreign Investment Promotion Act. In this case, the head of the entrusted agency -- when issuing a certificate of completion of report on foreign investment -- shall immediately send to the Minister of Strategy and Finance a photocopy of the certificate of completion of report and the complete application documents for tax reduction or exemption. (3) Where making a determination of tax reduction or exemption/modification of contents thereof/prior confirmation as to whether a business intended to be run is eligible for tax reduction or exemption concerning requests under Paragraph (1), the Minister of Strategy and Finance shall serve notice thereof immediately to the competent Minister of the project concerned, the Minister of Knowledge
Economy, the head of the local government, the Commissioner of the National Tax Service, the Commissioner of Customs, and the
head of the entrusted agency.
when
requested to present his/her opinion according to Article 121-2 (8) of the Act -- shall present his/her opinion on the matter to the Minister of Strategy and Finance within ten days of the date of receiving such request. Where making a decision on tax reduction or exemption is deemed to take a long time, however, he/she may extend the time period within the scope of ten days. In this case, the Minister of Strategy and Finance shall be notified of the grounds thereof and the extended period.
(2) Where any of the application documents is missing, any of the required information is omitted, or the contents are unclear, or if
deemed inevitable in the decision on tax reduction or exemption, the Minister of Strategy and Finance or the competent Minister and
the head of the local government
– when requested to present his/her opinion under Paragraph (1) -- may request the applicant to
complement or amend the application documents by setting a period of seven days or more. In this case, where there is a request by the applicant, the period for complementation or amendment may be extended.
(3) The competent Minister or head of the local government -- when requesting the applicant to complement or amend the application documents in accordance with the first part of Paragraph (2) -- shall serve notice thereof to the Minister of Strategy and Finance immediately. (4) The period required to complement or amend the application documents as per Paragraph (2) shall not be included in the period for treatment under Paragraph (1) and (2), Article 116-3 of the Enforcement Decree and the period for presentation of opinion under Paragraph (1).
(2)The head of the local government, the Commissioner of the National Tax Service, or the Commissioner of Customs may prescribe matters necessary for the follow-up management of a foreign investor or a foreign capital-invested company enjoying tax reduction or exemption according to Articles 121-2 to 121-4 of the Act. In this case, the head of the local government, the Commissioner of the National Tax Service, or the Commissioner of Customs shall have consultations with the Minister of Strategy and Finance in advance.
