Human Rights Violation by Failure to Notify the Family of Arrestee [2005] KRNHRC 2 (1 January 2005)

Human Rights Violation by Failure to Notify the Family of Arrestee

The victim's family filed a petition alleging that the respondent, belonging to the
District Public Prosecutor's Office, failed to notify the family upon arresting the victim
for false accusation in June 2005.

An investigation revealed that the officer violated due process by failing to notify the
victim's family of the reasons, time, and place of arrest. To prevent similar cases in the
future, the Commission recommended the Attorney General to issue a warning to the
respondent and to educate other investigation officers of the due process requirements.
