Crimes against Humanity and State Crimes in violation of Human Rights
The Commission received an inquiry from the Legislation and Judiciary Committee of
the National Assembly on its proposed Bill on Special Cases concerning Crimes
against Humanity and State Crimes against Human Rights.
The Commission expressed an opinion that it would be desirable to
1) restrict the scope of crimes without a statute of limitations;
2) partly expand boundaries of the scope of crimes for which the statute of limitations is suspended;
3) further specify the period of suspension of the statute of limitations;
4) acknowledge a longer extinctive prescription than the current one;
5) and avoid retroactive application in cases where the statute of limitations or extinctive prescription has expired.
As a result, the Bill is pending in the Legislation and Judiciary Committee of the
National Assembly, and the Minister of Justice has yet to express any particular
opinion on the Commission's recommendation.
