Cruel and Ill-treatment by Prosecutors

Civilian "Choi" filed a complaint with the Commission, contending that he had been
forcibly taken from his home and subject to extreme torture and brutal treatment during
investigation at the Prosecutors' Office and the Investigation Room for Special
Investigations Department of the "A" Local Prosecutor's Office. "Choi" stated that the
torturous investigation lasted three nights and four days, and he was detained illegally.
The victim suffered a cerebral hemorrhage from the brutal treatment, and underwent a
serious operation. He was later classified as a person with disability.

After investigation, the Commission confirmed that the respondents illegally
detained the victim for three nights and four days, neglecting due process, and brutally
mistreated the victim. The respondents had hit the victim's chest several times during
the investigation, fracturing ribs No. 8 and No. 9. In response, the Commission
concluded that behavior should be considered as crimes corresponding to illegal
detention and violence/brutal act, as prescribed by the Criminal Act and reported this
case for indictment to the Prosecutor General. The recommendation also requested
legal aid from the Korean Bar Association in order to ensure substantive relief and
reparation for violation of the victim's rights.
