AN

ORDINANCE

to reconstitute and reorganize the Kinnaird College for Women, Lahore.

Preamble.-- Whereas it is expedient to reconstitute and reorganize the
Kinnaird College for Women, Lahore in co-operation with the Association of
the Kannaird College for Women, Lahore being the owner and previous management of the College, and to make provisions connected therewith and ancillary thereto;

And whereas the Provincial Assembly of the Punjab is dissolved and the Governor is satisfied that circumstances exist which render it necessary to take immediate action;

And whereas under Article 4 of the Provisional Constitution (Amendment) Order No.9 of 1999, as amended by the Chief Executive Order No.11 of 2000, the Governor of a Province may issue and promulgate an Ordinance;

Now, therefore, in exercise of the aforesaid powers and all other powers enabling him in that behalf, the Governor of the Punjab is pleased to make and promulgate the following Ordinance:-

1. Short title and commencement.-- (1) This Ordinance may be called the Kinnaird College for Women, Lahore Ordinance, 2002.

(2) It shall come into force at once.

2. Definitions.-- In this Ordinance, unless there is anything repugnant in the subject or context -

(a) "Association" means the Association of the Kinnaird College for Women, Lahore;

(b) "Board" means the Board of Governors;

(c ) "College" means the Kinnaird College for Women, Lahore;

(d) "Government" means the Government of the Punjab;

(e) "Governor" means the Governor of the Punjab;

(f) "prescribed" means prescribed by rules made under this Ordinance; and

(g) "Principal" means the Principal of the Kinnaird College for Women, Lahore.

3. Incorporation.-- (1) The College shall be reconstituted and reorganized in accordance with the provisions of this Ordinance.

(2) The College shall be a body corporate having perpetual succession and a common seal with power to acquire, hold and dispose of property other than that owned by the Association, and shall by the said name sue and be sued.

4. Board of Governors.-- (1) The Board shall consist of the following: -

(i) Chairman of the Association;

(ii) Vice Chairman of the Association;

(iii) Secretary to the Government of the Punjab, Education Department or his nominee not below the rank of Additional Secretary;

(iv) Secretary to the Government of the Punjab, Law and Parliamentary Affairs Department or his nominee not below the rank of Additional Secretary;

(v) Secretary to the Government of the Punjab, Finance Department or his nominee not below the rank of Additional Secretary;

(vi) eight nominees of the Association;

(vii) one alumnae of the College to be nominated by the Board;

(viii) one member of the teaching staff of the College to be selected by the Board;

(ix) Principal, Convent of Jesus and Mary, Lahore;

(x) two distinguished educationists or eminent persons to be nominated by the Governor for a period of three years if not prematurely removed by the Governor in his discretion;

(xi) Chairman Higher Education Commission or his nominee; and

(xii) the Principal.

(2) Chairman and Vice Chairman of the Association shall be the Chairman and Vice Chairman respectively of the Board and the Principal shall be the Secretary of the Board.

5. Powers and functions of the Board.-- (1) The administration and management of the affairs of the College shall vest in the Board.

(2) Without prejudice to the generality of the foregoing provisions, the functions and powers of the Board shall be to -

(i) take effective measures to raise the standards of teaching, research and other academic pursuits in the light of national and international needs with special emphasis on education and training in scientific and technological disciplines;

(ii) hold, control and administer the property and funds of the College;

(iii) consider and approve the annual and revised budget estimates;

(iv) transfer and accept transfer of moveable and immoveable property on behalf of the College;

(v) enter into and cancel contracts on behalf of the College;

(vi) cause proper books of accounts to be kept for all sums of moneys received and expended by the College, and for the assets and liabilities of the College;

(vii) invest any money belonging to the College, as the Board may determine, with the like power of varying such investments;

(viii) receive and manage any property transferred, and grants, bequests, trusts, gifts, donations, endowments and other contributions made to the College;

(ix) govern and regulate the finance, accounts and investments of the College and for that purpose appoint such agents and auditors as the Board may deem fit;

(x) determine the form, custody and regulate the use of the Common Seal of the College;

(xi) provide buildings, libraries, premises, furniture, apparatus, equipment and other means required for carrying out the work of the College;

(xii) approve or license hostels or lodgings for the residence of students;

(xiii) institute Professorship, Associate Professorship, Assistant Professorship, Lectureship and other teaching posts or to suspend or abolish such posts;

(xiv) create, suspend or abolish such teaching, research, training, extension administration or other posts as may be necessary and to appoint persons thereto;

(xv) prescribe the terms and conditions of service of teaching and non-teaching staff including their qualifications, experience and eligibility for appointment, and to appoint, confer, suspend, remove, dismiss or take disciplinary action against the staff in the prescribed manner;

(xvi) institute Emeritus Professorships and make these appointments on such terms and conditions as may be prescribed;

(xvii) confer Honorary Degrees in accordance with the conditions prescribed;

(xviii) prescribe the duties of officers, teachers and other employees of the College;

(xix) institute fellowships, scholarships, medals and prizes;

(xx) promote cooperation with the Government, national and international organizations and universities in activities falling within the purview of the College;

(xxi) devise and implement participatory, merit based, result oriented and accountable management with suitable checks and balances; and

(xxii) perform such other functions as have been assigned to it by the other provisions of this Ordinance.

6. Principal.-- (1) The Government shall, on recommendation of the Board, appoint the Principal whose qualifications and terms and conditions of service shall be such as may be determined by the Board.

(2) The Principal shall be the Chief Executive of the College and shall perform such functions as may be prescribed or assigned to him by the Board.

7. Committees.-- The Board may constitute such committees as may be deemed necessary for carrying out the purposes of this Ordinance.

8. Appointments.-- (1) The College may appoint such persons in its service as may be necessary on the terms and conditions as may be determined by the Board.

(2) All persons serving the College, in any capacity, immediately before the commencement of this Ordinance, unless absorbed in the service of the College, shall remain on deputation and shall be liable to be transferred to their parent department at any time.

9. Delegation of powers.-- The Board may delegate to any person or a committee any of its powers, duties or functions.

10. Business of the Board.-- (1) The meetings and the business of the Board shall be conducted in such manner and in accordance with such procedure as may be prescribed and until these matters are prescribed, as may be determined by the Board.

(2) No act or proceeding of the Board shall be invalid by reasons of any vacancy or defect in the constitution of the Board.

11. Functions and powers of the College.-- The functions and powers of the College shall be to -

(i) provide instruction, tuition, training, research, demonstration and service in the fields of arts and sciences and applied disciplines at the undergraduate, graduate and postgraduate levels;

(ii) perform academic functions to achieve its objectives;

(iii) prescribe criteria of admission, migration and examination of students;

(iv) admit students and conduct examinations;

(v) award degrees, diplomas, certificates and other academic disciplines;

(vi) select, appoint and promote academic and administrative staff;

(vii) frame and prescribe courses of study;

(viii) provide for research and printing and publication of research and other works;

(ix) decide teaching methods and strategies as well as co-curricular activities in order to ensure the most effective educational and other related programmes;

(x) accept examinations passed and the periods of study spent by students at other colleges or universities or institutions and places of learning as equivalent to such examination and study in the College as it may determine and to withdraw such acceptance;

(xi) make provisions for research, consultancy and advisory services and with these objectives to enter into arrangements with other institutions or with public bodies;

(xii) affiliate or associate itself with other institutions within Pakistan or abroad and to establish facilities in Pakistan or abroad for the effective discharge of its functions and responsibilities;

(xiii) introduce, suspend or abolish any of the disciplines; and

(xiv) do such other acts and things whether incidental to the powers aforesaid or not, as may be required in order to further the objects of the College as a place of education, learning and research.

12. College fund.-- (1) There shall be a fund to be known as the Kinnaird College Fund which shall vest in the College and to which shall be credited all sums received by the College.

(2) The fund shall be kept in such custody and shall be utilized and regulated in such manner as may be prescribed.

13. Budget, audit and accounts.-- The budget of the College shall be approved and its accounts shall be maintained and audited in such manner as may be prescribed.

14. Rules.-- Government may, by notification, make rules not inconsistent with the provisions of this Ordinance for carrying out the purposes of this Ordinance.

15. Regulations.-- The Board may, by notification, make regulations not inconsistent with the provisions of this Ordinance and the rules made thereunder for the administration and management of the affairs of the College.

16. Savings.-- Upon the commencement of this Ordinance -

(a) all funds, properties, rights and interests of whatsoever kind issued, used, enjoyed, possessed or owned by the College immediately before the commencement of this Ordinance and all liabilities subsisting against the College shall stand transferred to the College established under this Ordinance:

Provided that all properties owned by the Association shall continue to be owned by the Association; and

(b) everything done, action taken, obligations and liabilities incurred, persons appointed or authorized, jurisdictions or powers conferred, orders issued and rules or regulations made by or in relation to the College immediately before the commencement of this Ordinance shall be deemed to have been respectively done, taken, incurred, acquired, appointed, conferred, created, made or issued under this Ordinance.

17. Removal of difficulties.-- If any difficulty arises in giving effect to any provision of this Ordinance, Government may, on recommendation of the Board, give such directions, not inconsistent with the said provisions, as it may consider necessary for the removal of such difficulty.
