Amendment to the Law on Royal Thai Police - Announcement of the Council for Democratic Reform No. 18 - [2006] THCDR 18 (22 September 2006)

No. 18
Re: Amendment to the Law on Royal Thai Police


Whereas it is expedient to improve police administration for enhancing its independence and efficiency in the performance of its duties and to protect the initial stage of justice from political influence so as to secure public at large from injustice, it is therefore necessary to amend the Royal Thai Police Act, B.E. 2547 (2004). The Chairperson of the Council for Democratic Reform under Constitutional Monarchy hereby announces as follows:

Clause 1. As from the date this Announcement comes into force, the Royal Thai Police Commission under the Royal Thai Police Act, B.E. 2547 (2004) shall consist of the following:

(1) Commissioner-General of the Royal Thai Police as Chairperson;
(2) Inspector General or 2 Deputy-Commissioner General of the Royal Thai Police as appointed by the Commissioner-General of the Royal Thai Police;
(3) 6 qualified members selected by the Chairperson and members under (2).

The Commander of the Office of the Royal Thai Police Commission shall be member and secretary of the Royal Thai Police Commission and the Deputy-Commander of the Office of the Royal Thai Police Commission shall be assistance secretary of the Royal Thai Police Commission.

Clause 2. In the performance of duties of the Royal Thai Police Commission under clause 1, the provisions of section 54, section 55 and section 57, specifically in regard to the conclusion of an agreement and the giving of approval shall not be applied.

Clause 3. Any matter of the Royal Thai Police Commission under the Royal Thai Police Act, B.E. 2547 (2004) which has not yet completed prior to the date this Announcement comes into force and such act may affect to the personnel administration, the Royal Thai Police Commission under clause 1 shall, if such matter is subjected to the powers of the Royal Thai Police Commission, have the power to consider such matter as it thinks appropriate.

Clause 4. The members of the Royal Thai Police Commission holding office prior to the date this Announcement comes into force shall vacate office.

Clause 5. The Royal Thai Police Act, B.E. 2547 (2004) shall be amended within one years as from the date this Announcement comes into force.

Clause 6. Upon the completion of the amendment of the Royal Thai Police Act, B.E. 2547 (2004) or the completion of one year as from the date this Announcement comes into force, this Announcement shall be repealed.

This Announcement shall come into force from now on.
