Announcement of the Council for Democratic Reform
No. 29
Re: Amendment to the Announcement of the Council for Democratic Reform No. 12
dated 20th September B.E. 2549
Pursuant to the Announcement of the Council for Democratic Reform No. 12 dated
20th September B.E. 2549 which continues the
enforcement of the Organic Act
on State Audit, B.E. 2542 (1999), in order to clarify the continued enforcement
of such Organic
Law, the Council for Democratic Reform hereby announces as follows:
Clause 1. The provisions of clause 1 of the Announcement of the Council for Democratic Reform No. 12 dated 20th September B.E. 2549 (2006) shall be repealed and replaced by the following:
“Clause 1. The repeal of the Constitution of the Kingdom of Thailand does not affect the enforcement of the Organic Act on State Audit, B.E. 2542 (1999). The Organic Law on State Audit, B.E. 2542 (1999) shall remain in force, provided that the provisions of Part 1, Chapter 1, shall be suspended until the enactment of a law amending or repealing thereof. The State Audit Commission holding office on 18th September B.E. 2549 (2006) shall vacate from office.”
Clause 2. The provisions of clause 2 of the Announcement
of the Council for Democratic Reform No. 12 dated 20th September B.E. 2549 (2006)
shall be repealed and replaced by the following:
“Clause 2. The State Auditor-General holding office on 18th September
B.E. 2549 shall remain in office until 30th September
B.E. 2550.”
Clause 3. The selection and appointment of the State Audit Commission and the State Auditor-General under the Organic Act on State Audit, B.E. 2542 (1999) shall be carried out within ninety days as from the date the State Auditor-General under clause 2 of the Announcement of the Council for Democratic Reform No. 12, dated 20th September B.E. 2549 (2006) as amended by this Announcement vacates from office.
During the vacancy of the State Audit Commission and the State Auditor-General under paragraph one, the State Auditor-General who vacates from office under paragraph one shall remain in office to perform the duties of the State Audit Commission and the State Auditor-General.
