Re: Powers and Duties of the Election Commission relating to Election of Members of Local Assembly and Local Administrators

In order to expeditiously accomplish an election of members of local assembly and local administrators while retaining the ability to investigate dishonest acts committed by elected persons, the Council for Democratic Reform hereby announces as follow:

Clause 1. In an election of members of local assembly or local administrators of any local government organization under the Election of Members of a Local Assembly or Local Administrators Act, B.E. 2545 (2002), the Election Commission shall announce an election result without delay, but shall not exceed thirty days as from the election date.

Clause 2. When an election result has been announced by the Election Commission under clause 1, if there is subsequent evidence which constitutes a reasonable cause to believe that any elected person under clause 1 committed any dishonest act or offence relating to an election so as to be elected, or such election was held dishonestly and unfairly, or there was any violation of laws relating to such election, the Election Commission shall suspend the right to vote at an election of such elected person for a period of one year and shall organize a new election, except where commission of such act did not involve the elected person.

Clause 3. Provisions of the Election of Members of a Local Assembly or Local Administrators Act, B.E. 2545 (2002) which are contrary to or inconsistent with the provisions of this Announcement shall be replaced by the provisions of this Announcement.

Clause 4. This Announcement shall also apply to the election of members of local assemblies or local administrators that have been carried out prior to the date this Announcement comes into force. In this regard, the period of thirty days under clause 1 commences as from the date this Announcement comes into force.
