JOINT CIRCULAR No. 02/2002/TTLT/BTM-BKHDT-BCN OF FEBRUARY 28, 2002 ADJUSTING AND GUIDING THE IMPLEMENTATION OF JOINT CIRCULAR No. 25/2001/TTLT/BTM-BKHDT-BCN OF NOVEMBER 9, 2001 On November 9, 2001, the Ministry of Trade, the Ministry of Planning and Investment and the Ministry of Industry issued Joint-Circular No. 25/2001/TTLT/BTM-BKHDT-BCN guiding the implementation of the quotas of textiles and garments to be exported to the EU, Canadian and Turkish markets in 2002; On the basis to the situation on implementation of quotas in the first 2 months of 2002; The Ministry of Trade, the Ministry of Planning and Investment and the Ministry of Industry hereby jointly adjust and additionally guide the implementation of Joint-Circular No. 25/2001/TTLT/BTM-BKHDT-BCN of November 9, 2001 as follows: 1. To supplement Section I General provisions: To add to the end of the first sentence (the sixth line from the bottom) the phrase: " excluding the quotas of the countries having separate agreements if any)", and the first sentence shall read as follows: "In 2002, automatic export licenses (E/L) shall be granted to all categories of textiles and garments to be exported to the EU, Canadian and Turkish markets, including the ASEAN transferred quotas (excluding the quotas of the countries having separate agreements if any)." 2. To adjust Item 1, Section II Quota implementation: Item 1 of Section II shall be adjusted with the following paragraph: "All quotas of textiles and garments to be exported to the EU, Canadian and Turkish markets in 2002 shall be granted automatic E/L. When the export level (E/L granting) reaches 50% of the total base quotas in the first quarter of 2002; 70% in the second quarter of 2002; or 90% in the third and fourth quarters of 2002, the granting of automatic E/L shall cease." After the granting of automatic E/L ceases, the remaining quotas shall be implemented as follows: The Ministries of Trade, Planning and Investment, and Industry shall base themselves on the quota implementation levels in 2001 and 2002 to allocate them to the units and the Peoples Committees of Hanoi, Ho Chi Minh, Hai Phong and Da Nang cities, with priority given to the units which have the produced goods awaiting export, have already imported raw and auxiliary materials, have already purchased raw auxiliary materials for production, or have already signed export contracts (especially the contracts already signed with the EU industrialists). 2. Other regulations of Joint-Circular No. 25/2001/TTLT/BTM-BKHDT-BCN of November 9, 2001 of the Ministry of Trade, the Ministry of Planning and Investment and the Ministry of Industry shall still be effective.
