RESOLUTION No. 09/2003/NQ-CP OF JULY 28, 2003 AMENDING AND SUPPLEMENTING THE GOVERNMENT'S RESOLUTION No. 16/2000/NQ-CP OF OCTOBER 18, 2000 ON THE STREAMLINING OF ADMINISTRATIVE AGENCIES AND NON-BUSINESS UNITS In furtherance of Conclusion No. 15-KL/TW of July 26, 2002 of the 6th plenum of the Party Central Committee, the IXth Congress, on further implementing the Resolution of the Party Central Committee's 3rd plenum, the VIIth Congress, and the Resolutions of the Party Central Committee's 3rd plenum and 7th plenum, the VIIIth Congress, on the work of organization and personnel; pursuant to Resolution No. 07 of May 30, 2003 of the Government's May 2003 regular meeting amending and supplementing a number of solutions and policies, and continuing to streamline administrative agencies and non-business units already prescribed in the Government's Resolution No. 16/2000/NQ-CP of October 18, 2000 on the reduction of payrolls in administrative agencies and non-business units according to the following specific contents: I. A NUMBER OF SOLUTIONS AND POLICIES ON PAYROLL REDUCTION 1. To continue implementing the policy on streamlining the administrative agencies and non-business units under the Government's Resolution No. 16/2000/NQ-CP of October 18, 2000 on the reduction of payrolls in administrative agencies and non-business units till the end of 2005. 2. To add objects of streamlining under the Government's Resolution No. 16/2000/NQ-CP of October 18, 2000 for officials and public employees directly working in non-business units in the education and training, health, scientific research, culture and information, and sport sectors, and other non-business sectors. In 2003, to reduce payrolls for teachers in mountainous and Central Highland provinces. As from 2004, payroll reduction shall apply to all the objects stated at this Point. 3. Severance allowances for redundancies due to payroll reduction under the Government's Resolution No. 16/2000/NQ-CP of October 18, 2000 shall comply with the provisions in Clause 2, Article 6 of the Government's Decree No. 03/2003/ND-CP of January 15, 2003 readjusting wages and social allowances and renewing the wage management mechanism. 4. The ministries, branches and People's Committees of the provinces and centrally-run cities shall continue the streamlining: a/ To elaborate and promulgate appropriate management mechanisms for non-business units on the principle of giving autonomy together with powers and responsibilities in performing the functions, tasks, plans, finance, personnel and service quality of each unit; b/ To step up the socialization of non-business activities in cities, urban centers and industrial parks where conditions permit the socio-economic development under the Government's Resolution No. 90/CP of August 21, 1997 on orientations and undertakings for socialization of educational, healthcare and cultural activities and the Government's Decree No. 73/1999/ND-CP of August 19, 1999 on policies to encourage the socialization of activities in the educational, healthcare, cultural and sport domains. 5. For those officials and public employees who are targeted for streamlining, if they are laid off due to reorganization or overcoming of the overlapping of functions and tasks, the payroll norms shall be reduced correspondingly; to permit the recruitment of qualified persons to replace those who are laid off due to poor health or professional unqualification in order to qualitatively and quantitatively increase officials and public employees who can meet the set requirements and the assigned tasks. II. ORGANIZATION OF IMPLEMENTATION 1. The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government and the presidents of the People's Committees of the provinces and centrally-run cities shall organize the evaluation of the results of implementation of the Government's Resolution No. 16/2000/NQ-CP of October 18, 2000 and report to the Party Committees of the same levels on the results and plans for continued streamlining under this Resolution. 2. The Minister of Finance shall have to arrange State budget plan and assume the prime responsibility and coordinate with the Ministry of the Interior in guiding the procedures for allocating, paying and settling fundings for the implementation of this Resolution. 3. The Minister of the Interior shall have to assume the prime responsibility and coordinate with the Ministry of Finance in guiding the implementation of this Resolution; coordinate with the Government's Office in monitoring, urging and examining the implementation of the Resolution; and annually report thereon to the Prime Minister. 4. The streamlining policies prescribed in Resolution No. 16/2000/NQ-CP and this Resolution shall apply to titles being Managing Board members, general directors, deputy-general directors, directors, deputy directors, chief accountants and Control Board members, who are subject to rearrangement due to the reorganization of State enterprises. Funding sources for settling policies for the above-said titles of State enterprises shall comply with the provisions in the Government's Decree No. 41/2002/ND-CP of April 11, 2002 on policies towards laborers redundant due to the reorganization of State enterprises. This Resolution takes implementation effect 15 days after its publication in the Official Gazette. On behalf of the Government |
