DECISION No. 225/QD-TTg OF FEBRUARY 26, 2003 APPROVING THE MASTER PROJECT ON CONSERVATION, REPLENISHMENT AND PROMOTION OF THE VALUES OF THE DIEN BIEN PHU VICTORY HISTORICAL RELICS ZONE, LAI CHAU PROVINCE THE PRIME MINISTER Pursuant to the Law on Organization of the Government of December 25, 2001; Pursuant to the Law on Cultural Heritage of June 29, 2001; At the proposals of the People's Committee of Lai Chau province (in Official Dispatch No. 479/TTr-UB of July 31, 2002) and the Ministry of Planning and Investment (in Official Dispatch No. 7592-BKH/VPTD of November 29, 2002), DECIDES: Article 1.- To approve the master project on conservation, replenishment and promotion of the values of the Dien Bien Phu Victory Historical Relics Zone in Lai Chau province with the following principal contents: 1. Objectives: a/ To conserve and replenish the Dien Bien Phu Victory Historical Relics Zone; b/ To acknowledge and eternalize other monuments related to the historic Dien Bien Phu victory, which have been already recognized and classified; c/ To build museum complex; d/ To build the central monument and other icons; e/ To conserve and replenish beauty spots and environment of the Dien Bien Phu Victory Historical Relics Zone. 2. Requirements: a/ To determine the legal base and create necessary conditions for the long-term conservation of a number of typical places and monument clusters; b/ To fully and accurately conserve important place names, evidences and historic events related to the Dien Bien Phu victory; c/ To make the model of the historic Dien Bien Phu campaign panorama fully reappear (to build museum complex and to display exhibits together with models, tangibles with intangibles); d/ To further glorify the historic Dien Bien Phu victory in grandiose art forms; and at the same time to link the Relics Zone's activities with economic, cultural, social and environmental landscape development in the locality. 3. Scope: The place names and evidences within the administrative boundaries of Lai Chau province, which acknowledge the historic events related to the Dien Bien Phu victory between late 1953 and the May 7, 1954 historic victory, include: a/ Relics and evidences related to our army's battlefields; b/ Relics related to the enemy's defensive battlefields; c/ Relics demonstrating the development of the historic Dien Bien Phu campaign; d/ Other relevant relics: martyrs' cemetery and war evidences; show rooms; stelae, boards and other place names acknowledging events related to the historic Dien Bien Phu campaign. 4. Investment contents: a/ To invest in conservation and replenishment of typical relics, including: - Bases of the Campaign Command in Muong Phang; - Headquarters of the Dien Bien Phu stronghold; - Hill A1 garrison; - Him Lam center; - Our armymen's paths for cannon haulage; - Blockage battlefields (fortifications, trenches, camouflage posts and attack positions of our armymen). b/ To build the system of stelae, boards and symbols acknowledging historical events and other important relics spots; c/ To renovate and upgrade the Historic Dien Bien Phu Victory Museum; d/ To build the Central Victory Monument in Dien Bien provincial capital and a number of other monuments associated with the historic Dien Bien Phu victory event; e/ To restore a number of hamlets of the Thai ethnic group; f/ To collect, restore and conserve exhibits and intangible elements related to the historic Dien Bien Phu campaign; g/ To train and foster the contingent of conservation and museum managerial and professional officials; h/ To make ground compensations and clearance. 5. Implementation solutions: a/ To investigate, survey and collect historic data and documents on the historic Dien Bien Phu victory. On that basis, to determine the scope of delineating zones for protection of each relic and relic zones; b/ To adjust the general planning on Dien Bien provincial capital till 2020 so as to ensure that it shall not affect the scope of delineating zones for protection of relics; determine in detail the works to be cleared; to elaborate the Regulation on management of relics, management of plannings and management of the construction of architectural works and technical infrastructures in the course of renovation, construction and development of Dien Bien provincial capital; c/ To assess and classify professional qualifications and to make statistics on the number of officials and public servants engaged in conservation and museum work in the locality. On that basis, to devise a plan on training, re-training, fostering and raising the professional qualifications of the contingent of officials engaged in conservation and museum work in the relics zone and at relevant relics; d/ To build a museum complex; and to combine the display of exhibits with the display of clay models and tangibles with intangibles in order to make the model of the historic Dien Bien Phu victory panorama fully reappear; e/ To use pottery mosaics, monuments, bas-relief and other art forms and genres in order to further glorify the historic Dien Bien Phu victory; f/ To make feasible study reports on component projects according to the investment priority order so as to mark in time the 50th anniversary of the historic Dien Bien Phu victory (May 7, 1954 - May 7, 2004). On that basis, to determine capital for each phase: - Phase I: From 2003 to May 2004: The Central State budget shall allocate the annual capital not exceeding Vietnam dong 100 billion. It is necessary to select according to the priority order a number of work items: The Central Victory Monument, the campaign Command's base in Muong Phang and headquarters of the Dien Bien Phu stronghold; Hill A1 garrison, Him Lam center and our armymen's cannon-haulage paths; our armymen's battlefields, the system of acknowledgement stelae and boards as well as full introduction of historic events and other relic spots, renovation and upgrading of the Historic Dien Bien Phu Victory Museum; and to select fully capable units for the construction thereof in order to ensure the tempo and quality of works, manage the use of capital for the right purposes and without losses, and to serve in time the 50th anniversary of the historic Dien Bien Phu victory. - Phase II: From June of 2004 to 2007, including all remaining work items of the project. 6. Capital sources: The State budget and other lawfully mobilized capital sources. Article 2.- Responsibilities of the People's Committee of Lai Chau province: 1. Basing itself on the investment objectives, requirements, scope and contents already mentioned in Article 1 of this Decision, to specifically determine the time for project execution and the roadmap for execution of component projects in each phase; to formulate, evaluate and approve the total cost estimates of the master project and component projects according to the current legislation on investment and construction management. 2. To coordinate with the Ministry of Construction in adjusting the general planning and detailed plannings on construction of Dien Bien provincial capital to suit the master project on conservation, replenishment and promotion of the values of the Dien Bien Phu Victory Historical Relics Zone, then submit them for approval according to the current regulations. 3. To coordinate with the Ministry of Culture and Information and the Ministry of Finance in finding and adjusting funding sources in order to execute the project according to the set tempo and ensure that capital sources are managed and used efficiently and in strict accordance with law provisions. 4. To propose fundamental solutions to the conservation, replenishment and promotion of the values of the Dien Bien Phu Victory Historical Relics Zone. To closely monitor and supervise the implementation of the project, ensuring its tempo and quality. 5. To elaborate and publicly announce the Regulation on management and protection of relics, management of planning and construction of Dien Bien provincial capital; and the Regulation on management of tourist activities in the Dien Bien Phu Victory Historical Relics Zone. 6. To study for elaboration of solutions on mechanisms and policies to mobilize resources as well as measures to organize and manage them in order to efficiently promote the Dien Bien Phu Victory Historical Relics Zone. Article 3.- The Ministry of Planning and Investment, the Ministry of Culture and Information, the Ministry of Construction, the Ministry of Defense, the National Administration of Tourism and the Army Museum shall coordinate with and support the People's Committee of Lai Chau province in implementing this project according to their respective functions and competence. The Ministry of Planning and Investment and the Ministry of Finance shall have to cover fund sources for implementation of the project. Article 4.- This Decision takes effect 15 days after its publication on the Official Gazette. The president of the People's Committee of Lai Chau province, the ministers, the heads of the concerned ministerial-level agencies and agencies attached to the Government, and the Army Museum shall have to implement this Decision.
