DECISION No. 21/2003/QD-TTg OF JANUARY 29, 2003 ON STATE BUDGET SUPPORT RENDERED TO POLITICAL-SOCIAL-PROFESSIONAL ORGANIZATIONS, SOCIAL ORGANIZATIONS AND SOCIO-PROFESSIONAL ORGANIZATIONS FOR ACTIVITIES ASSOCIATED WITH THE STATES TASKS THE PRIME MINISTER Pursuant to the December 25, 2001 Law on Organization of the Government; Pursuant to December 16, 2002 State Budget Law No. 01/2001/QH11; At the proposal of the Minister of Finance, DECIDES: Article 1.- The State shall provide budget fund support for political-social-professional organizations, social organizations and socio-professional organizations, which are engaged in activities associated with the States tasks according to the provisions of this Decision. Article 2.- 1. Funds for operations of political-social-professional organizations, social organizations and socio-professional organizations shall be covered by themselves according to law provisions. The State shall not allocate payroll norms and operation funds to these organizations. 2. The State budget shall provide render support for political-social-professional organizations, social organizations and socio-professional organizations, which are engaged in activities associated with the States tasks, according to the following principles: a/ The State budget shall wholly or partly render fund support for the activities assigned by the Prime Minister (for the central political-social-professional organizations, social organizations and socio-professional organizations); or by presidents of the Peoples Committees of all levels (for local political-social-professional organizations, social organizations and socio-professional organizations). b/ The State budget shall render fund support for products, works and activities already carried out by political-social-professional organizations, social organizations and/or socio-professional organizations, which are of practical value and bring about practical benefits to the society as certified by the competent authorities. c/ The State budget shall render fund support for other activities under the decisions of the Prime Minister or the presidents of the Peoples Committees of the provinces and centrally-run cities, including: - The State budget shall continue to render fund support for operation till 2005 to political-social-professional organizations, social organizations and socio-professional organizations, which have been already assigned payrolls by the State. - The State shall partly render fund support for the organization of conferences to review typical and progressive movements throughout the country as permitted by the competent agencies. - The State budget shall partly render fund support for the organization of congresses of political-social-professional organizations, social organizations and socio-professional organizations according to their terms. - In special cases where political-social-professional organizations, social organizations and socio-professional organizations are permitted to procure, build, buy or rent working offices under decisions of the Prime Minister or the presidents of the provincial-level Peoples Committees, they shall be considered for partial fund support from the State budget. Article 3.- The State budget shall render support for political-social-professional organizations, social organizations and socio-professional organizations on the basis of revenue sources for self-financed operations of these organizations according to the current financial expenditure regime and capability of annual State budgets of all levels. The Prime Minister shall decide or authorize the Minister of Finance to decide on the levels of support from the central budget to the central political-social-professional organizations, social organizations and socio-professional organizations; and the presidents of the Peoples Committees of all levels shall consider and decide on the levels of support from their local budgets to local political-social-professional organizations, social organizations and socio-professional organizations. Article 4.- The process of rendering State budget fund support to political-social-professional organizations, social organizations and socio-professional organizations for their activities associated with the States tasks is conducted as follows: Annually, within the State budget estimation time limit, the political-social-professional organizations, social organizations and socio-professional organizations shall base themselves on the plan years working programs, the units revenue sources, contents of activities to be supported by the State budget, as well as the current financial expenditure regimes, criteria and norms to make fund estimates and send them to the Ministry of Finance (for the central organizations) or to the local finance bodies (for local organizations). Finance bodies of all levels shall base themselves on the support demands of political-social-professional organizations, social organizations and socio-professional organizations and the capability of the State budget of all levels to include the support funds into the annual State budget estimates and submit them to the competent authorities for approval. Article 5.- 1. Finance bodies of all levels shall have to provide support funds strictly according to the estimates approved by the competent authorities, coordinate with the specialized State management agencies in inspecting the use of funds supported by the State budget, ensuring the strict compliance with the regimes and purposes, and approve support fund settlement according to regulations. 2. The political-social-professional organizations, social organizations and socio-professional organizations shall have to manage, use and settle funds supported by the State budget strictly according to regimes, publicly and transparently according to the current regulations. Article 6.- This Decision takes effect after its signing. Article 7.- The Minister of Finance guides the implementation of this Decision. Article 8.- The ministers, the heads of the ministerial-level agencies, the heads of the agencies attached to the Government, the heads of the central political-social-professional organizations, social organizations and socio-professional organizations, and the presidents of the Peoples Committees of the provinces and centrally-run cities shall have to implement this Decision.
