CIRCULAR No.3/1998/TT-BTC OF FEBRUARY 24, 1998 GUIDING THE GRANTING OF PERMITS FOR IMPORT OF RAW MATERIAL WOOD FROM CAMBODIA Pursuant to Decree No.33-CP of April 19, 1994 of the Government on the State management over the export and import activities; Pursuant to Decision No.1124/1997/QD-TTg of February 25, 1997 of the Prime Minister on the export of wood products and forest products and the import of raw material wood; Pursuant to Documents No.2/CP-KTTH-m of January 13, 1998 of the Government and No.15/VPCP-KTTH-m of January 19, 1998 of the Government Office; The Ministry of Trade hereby provides the following guidance for the granting of permits for quota-regulated import of raw material wood from Cambodia: I. GENERAL PROVISIONS 1. This Circular regulates the quota-regulated import of raw material wood from Cambodia (with export permits therefor already granted by the Cambodian competent agency) across the land border of the two countries. 2. Raw material wood referred to in this Circular includes logs of various kinds (barked or unbarked); sawn timber and assembled slats of all categories. Artificial boards, assembled wood slats and all other kinds of wood products imported according to Clause 3(a), Article 5 of Decision No.1124/1997/QD-TTg of December 25, 1997 of the Prime Minister, shall not be subject to this Circular. 3. All enterprises having export and import business licenses for appropriate goods categories, shall be entitled to apply for permits for import of raw material wood from Cambodia if they have full and proper dossiers. II. DOSSIERS OF APPLICATION FOR IMPORT PERMITS A dossier of application for an import permit shall include: - An official request of the concerned enterprise, clearly stating the name of the enterprise that sell the wood, wood category and specifications (log, sawn timber or slats), the quantity sold, the import border gate. - The copy of the export and import business licenses; - The original of the principled contract signed with the Cambodian party; - The copy of the written export permission from the Cambodian Prime Minister or the Cambodian Council of Ministers' Office or the Cambodian Ministry of Trade clearly stating the name of the exporting enterprise; wood category, specifications and quantities permitted to be exported. Such a copy must be translated into Vietnamese and the translation must be certified by the Vietnamese Embassy or the Vietnamese trade counselor in Cambodia or the Vietnamese public notary or the Hanoi-based Cambodia Embassy. III. IMPLEMENTATION PROVISIONS 1. The permits for import of raw material wood from Cambodia, which were granted by the Ministry of Agriculture and Rural Development before the date of issuing this Circular, shall be valid till September 30, 1998. 2. The procedures for import goods clearance and the customs procedures for import goods shall comply with the current regulations. 3. This Circular takes effect after its signing.
