DECISION No. 57/2000/QD-BTC OF APRIL 20, 2000 ISSUING THE CIVIL STATUS REGISTRATION FEE LEVELS
THE MINISTER OF FINANCE
Pursuant to the Government’s Decree No. 15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries
and ministerial-level agencies;
Pursuant to the Government’s Decree No. 178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry
of Finance;
Pursuant to the Government’s Decree No. 184/CP of November 30, 1994 stipulating the procedures for marriage, claim of out-of-wedlock
children, child adoption, and sponsorship between Vietnamese citizens and foreigners;
Pursuant to the Government’s Decree No. 83/1998/ND-CP of October 10, 1998 on civil status registration;
Pursuant to the Government’s Decree No. 04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget;
After obtaining the opinions of the Ministry of Justice (Official Dispatch No. 163/TP-HT of January 31, 2000) as well as the Ministry
for Foreign Affairs (Official Dispatch No. 06-CV/NG-LS-PL of January 4, 2000) and at the proposal of the General Director of Tax,
DECIDES:
Article 1.- To issue together with this Decision the Table of civil status registration fee levels. The fee levels stipulated in the Table cover
also expenses for dossiers related to the civil status management work.
Article 2.- Payers of fees prescribed in this Decision are persons for whom the competent State agencies perform civil status-related work according
to the provisions of law.
Article 3.- The competent State agencies performing the function of State management over civil status and also organizing the collection of
civil status fees include:
1. The commune/ward/district township People’s Committees, which are allowed to collect fees at the levels specified in Section A
of the Table of fee levels.
2. The Justice Services of the provinces and centrally-run cities, which shall collect fees at the levels specified in Section B of
the Table of fee levels.
3. The Vietnamese overseas diplomatic missions and consulates, which shall collect fees at the levels specified in Section C of the
Table of fee levels.
The commune/ward/district township People’s Committees and the Justice Services of the provinces and centrally-run cities shall collect
civil status registration fees in Vietnam Dong; Vietnamese overseas diplomatic missions and consulates shall collect fees in US dollar
or local currency at the exchange rate announced by the host country at the collection time.
Article 4.- The fee-collecting agencies are allowed to temporarily deduct 30% of the actually collected fee amount and remit the remainder (70%)
into the State budget. The temporarily deducted amount must be incorporated into the annual budget estimates and used according to
the prescribed regime. At the end of each year, any unused amount must be remitted into the State budget. The collecting agencies
shall have to organize the collection, remittance and management of fees according to the provisions in the Government’s Decree No.
04/1999/ND-CP of January 30, 1999 on charges and fees belonging to the State budget and the Ministry of Finance’s Circular No. 54/1999/TT-BTC
of May 10, 1999 guiding the implementation thereof.
Article 5.- This Decision takes effect 15 days after its signing and replaces the provisions on civil status fees in Joint Circular No. 33/TT-LB
of April 24, 1995 of the Ministry of Finance and the Ministry of Justice prescribing the collection, remittance, management and use
of fees for marriage registration, recognition of marriage, claim of out-of-wedlock children, registration of child adoption and
recognition of child adoption between Vietnamese citizens and foreigners and in Joint Circular No. 83/TTLB of October 4, 1993 of
the Ministry of Finance and the Ministry for Foreign Affairs prescribing the collection of foreign consul charges and fees.
Article 6.- Organizations and individuals subject to payment of fees and concerned agencies shall have to implement this Decision.

toward their minor children, and other events prescribed by law.
- Inscribing in the registers the civil status works already registered at the overseas Vietnamese diplomatic missions or consulates
or issued by the foreign competent agencies. |
