DECISION No.1010/2000/QD-BYT OF MARCH 30, 2000 ISSUING THE LIST OF FOOD COMMODITIES SUBJECT TO QUALITY REGISTRATION

THE MINISTER OF HEALTH

Pursuant to the Law on Protection of People’s Health and the Hygiene Regulation issued together with Decree No.23-HDBT of January 24, 1991;

Pursuant to the Government’s Decree No.68-CP of October 11, 1993 defining the functions, tasks, powers and organizational structure of the Health Ministry;

Pursuant to the Government’s Decree No.86-CP of December 8, 1995 on the assignment of responsibilities for State management over goods quality and Inter-ministerial Circular No.07/TTLB of July 1st, 1996 of the Health Ministry and the Ministry of Science, Technology and Environment guiding the implementation of Decree No.86-CP of December 8, 1995;

At the proposal of the director of the Department of Foodstuff Quality, Hygiene and Safety Management under the Health Ministry,

DECIDES:

Article 1.- To issue together with this Decision the List of food commodities subject to quality registration (attached list).

Article 2.- On the basis of the practical requirements, the List of food commodities subject to quality registration prescribed in Article 1 of this Decision shall be considered for appropriate supplement and amendment.

Article 3.- Organizations and individuals of all economic sectors engaged in production, processing, trading and/or import of food commodities specified in the list mentioned in Article 1 of this Decision shall have to make goods quality registration as prescribed.

Article 4.- This Decision takes effect after its signing for issuance and replaces the Health Minister’s Decision No. 319/1999/QD-BYT of January 30, 1999 issuing the 1999 list of food commodities subject to quality registration.

Article 5.- The Department of Foodstuff Quality, Hygiene and Safety Management shall have to organize and inspect the implementation of this Decision.

Article 6.- The head of the Office, the directors of the Departments under the Health Ministry, the director of the Department of Foodstuff Quality, Hygiene and Safety Management, the director of the Vietnam Pharmaceutical Management Department and the directors of the Health Services of the provinces and centrally-run cities shall have to implement this Decision.

THE LIST OF DOMESTICALLY-CONSUMED FOOD COMMODITIES SUBJECT TO QUALITY REGISTRATION

(Issued together with Decision No.1010/2000/QD-BYT of March 30, 2000 of the Minister of Health)

GENERAL INSTRUCTIONS

1. The list of food commodities subject to quality registration is arranged in a table with three major columns, in which:

+ The first column specifies four-digit code numbers as commodity group headings which may be added with 2 or 4 more numerals (as concrete guides to commodity sub-headings), corresponding to commodities specified in the second column - commodity items announced by the General Department of Statistics with a view to creating harmony and convenience for commodity exchange and State management. In case of any terminological difference between the above-said commodity names and those defined in the Vietnamese Standard, the quality registration using the Vietnamese Standard’s terminology shall be encouraged.

+ Prescribed in the third column is the basis for quality registration that includes the Vietnamese standards and the commodity quality regulations issued by the specialized management ministries, in which:

a/ The quality norms subject to the compulsory registration (according to the detailed guidance in The Health Ministry’s Circular No. 01/2000/TT-BYT of January 21st, 2000 on the inspection and registration of foodstuff quality, hygiene and safety), including:

- The Vietnamese standards, which must be entirely applied or the compulsory norms involved in the Vietnamese standards;

- The base standards, which must not be lower than Vietnam’s compulsory standards;

- The hygiene standards applicable to food and foodstuff, issued together with the Health Minister’s Decision No. 867/1998/QD-BYT of April 4, 1998.

b/ Other norms that may be used by production establishments for reference purpose when they make quality registration, including:

- Quality provisions in commercial contracts signed by the importing enterprises with foreign exporters;

- The international standards which shall become applicable in the absence of relevant regulations of Vietnam.

2. The Health Ministry (the Department of Foodstuff Quality, Hygiene and Safety Management) shall uniformly issue quality registration certificates for tobacco products, bottled natural mineral water, food commodities of the same quality level and labels manufactured by different member enterprises of the same company in different localities.
