ON IMPROVING THE MANAGEMENT OF CONSTRUCTION IN HANOI CAPITAL

DIRECTIVE No.172-TTg ON THE 18TH OF MARCH 1995 OF THE PRIME MINISTER ON IMPROVING THE MANAGEMENT OF CONSTRUCTION IN HANOI CAPITAL

Recently, the management of construction according to the general planning in Hanoi capital has made initial progress, but loose control has been revealed in some respects.

The unlicensed and illegal construction of projects, especially small and medium-size projects, has become commonplace. Many projects have been built wantonly with casual architectural style which causes a lack of harmony among themselves and with the general architecture in the neighborhood.

A number of villas in ancient streets have been demolished to build multi-story houses, badly affecting the general landscape and causing risks to low houses beside them. On the other hand, these multi-story buildings are not commensurate with the infrastructure in the area, which may cause traffic congestion and choke up the sewers...

The preservation of ancient streets, and the upgrading of old streets have not been done in accordance with the Regulations on the management of construction in Hanoi City. The management of construction in the West Lake area and the area outside the dyke system of the Red River is also not in keeping with Decision No.132-CT on the 18th of April 1992 of the Prime Minister ratifying the adjustment of the general planning of Hanoi capital's total area.

The shortcomings in the management of construction have badly affected the architectural features of Hanoi capital, and infringed on law and other stipulations of the State. In order to respond to the requirement to build Hanoi capital into a modern and civilized city worthy of being the capital city of the whole country, the Prime Minister makes the following request:

1. The President of the People's Committee of Hanoi should direct the various branches and levels to strictly observe the Regulations on the management of construction in Hanoi city and Decision No.132-CT on the 18th of April 1992 of the Prime Minister ratifying the adjustment of the general planning of Hanoi capital's total area, with special emphasis on the ancient quarters, the old quarters, the Ba Dinh precinct, and West Lake area.

The People's Committees of precincts, districts, wards and communes are strictly forbidden to impose fines without ordering the demolition of all the projects built without a license or illegally.

The demolition of villas in the old streets to build multi-story buildings should be carefully considered, in order to match the new architectural structures with the technical infrastructure, and not to lose the existing architectural beauty of the old streets.

2. The Minister of Construction should organize regular inspection tours to detect timely any infringement on the Regulations on the management of construction in Hanoi, particularly in the ancient quarters and the old quarters, and take measures to ensure the need to preserve the ancient quarters and upgrade the old quarters, which represent the architectural, historic and aesthetic values of Hanoi capital.

3. The President of the People's Committee of Hanoi should direct the Chief Architect of the city and the branches concerned in the simultaneous building of the new roads, such as Giang Vo, Lang Ha, Kim Ma, Chua Boc-Thai Ha, Road 32, the road along the bank of the West Lake, in preparing for the construction of the road from South Thang Long to Buoi, etc., and in planning the construction of high-rises and other architectural structures along those roads, in order to create a new architectural feature of Hanoi capital, prevent the construction of too many multi-story buildings in the old streets, and prevent squatters from encroaching upon the new streets and wanton house building there.

The President of the People's Committee of Hanoi, the Minister of Construction, and the Heads of the branches and levels concerned shall have to fully implement this Directive.
