DECISION No.343/QD-TTg OF APRIL 18, 1998 ON THE ESTABLISHMENT OF HOA KHANH INDUSTRIAL PARK IN DA NANG CITY AND THE APPROVAL OF THE INVESTMENT PROJECT FOR CONSTRUCTION AND COMMERCIAL OPERATION OF INFRASTRUCTURE THEREIN THE PRIME MINISTER Pursuant to the Law on Organization of the Government of September 30, 1992; Pursuant to the Regulation on Industrial Parks, Export Processing Zones and Hi-Tech Parks issued together with Decree No.36-CP of April 24, 1997 of the Government; Pursuant to the Regulation on Investment and Construction Management issued together with Decree No.42-CP of July 16, 1996 of the Government and Decree No.92-CP of August 23, 1997 of the Government; At the proposals of the president of the People's Committee of Da Nang city in Official Dispatch No.424/CV-UB of March 30, 1998, and of the Da Nang City Board for Management of Industrial Parks and Export Processing Zones in Official Dispatch No.32/CV-BQL of February 26, 1998, DECIDES: Article 1.- To establish Hoa Khanh industrial park, Da Nang city (which was previously a part of Lien Chieu-Hoa Khanh industrial park in Hoa Khanh ward, Lien Chieu district, Da Nang city). Hoa Khanh industrial park shall be organized and operate under the Regulation on Industrial Parks, Export Processing Zones and Hi-Tech Parks issued together with Decree No.36-CP of April 24, 1997 of the Government and shall be subject to direct management by the Da Nang City Board for Management of Industrial Parks and Export Processing Zones of Da Nang city. Article 2.- To approve the investment project for construction and commercial operation of infrastructure of Hoa Khanh industrial park, Da Nang city, with the following contents: 1. Name of the project: Investment in construction and commercial operation of the infrastructure of Hoa Khanh industrial park, Da Nang city; 2. Investor: Quang Nam-Da Nang Joint Business Company for House Construction, Installation and Trading; 3. The project's objectives: To level ground and to build communication, power supply, water supply and drainage, information and communications, waste treatment,... systems, in order to put the infrastructure already created in the industrial park into commercial operation; 4. Construction location: Hoa Khanh ward, Lien Chieu district, Da Nang city. 5. Land area under use: 423.5 hectares (of which 162 hectares for the first stage) which shall be precisely re-determined when the land lease procedures are carried out in accordance with the Land Law; 6. Total investment capital: 49,956,000 USD (of which 25,632,000 USD for the first stage) 7. Capital sources: own capital, capital advanced by the investor, borrowed capital. 8. Operation duration: 50 years from the date the president of the People's Committee of Quang Nam - Da Nang province signed the decision on investment project for construction and commercial operation of the technical infrastructure of Hoa Khanh industrial cluster (Lien Chieu - Hoa Khanh industrial park) in Quang Nam - Da Nang province (in Decision No.3698/QD-UB of December 12, 1996). Article 3.- The Quang Nam - Da Nang Joint Business Company for House Construction, Installation and Trading shall be entitled to borrow capital at the preferential interest rate partly from the State for the construction of infrastructure of the industrial park and enjoy financial preferences provided for by the Law on Domestic Investment Promotion. Article 4.- The president of the People's Committee of Da Nang city, the Da Nang City Board for Management of Industrial Parks and Export Processing Zones shall have to direct the investor to execute the project strictly in accordance with the detailed planning already approved by the Ministry of Construction in Decision No.199-BXD/KTQH of May 6, 1997; draw up master plan for development of the infrastructure inside the industrial park's fence in compatibility with that outside the industrial park and ensure the efficient operation of the industrial park. Article 5.- This Decision takes effect after its signing. All previous stipulations which are contrary to this Decision are now annulled. Article 6.- The president of the People's Committee of Da Nang city, the Minister of Planning and Investment, the Minister of Finance, the Minister of Construction, the Ministry of Industry, the Minister of Defense, the Minister of Science, Technology and Environment, the General Director of the General Land Administration, the Governor of the State Bank of Vietnam, the head of the Vietnam Industrial Park Management Board, the head of the Da Nang City Board for Management of the Industrial Parks and Export Processing Zones, the director of the Quang Nam - Da Nang Joint Business Company for House Construction, Installation and Trading and heads of the concerned agencies shall, within their respective functions and powers, have to implement this Decision.
