Pursuant to the Law on Organization of the Government of September 30, 1992;

Pursuant to the Regulation on Industrial Parks, Export-Processing Zones and Hi-Tech Parks issued together with Decree No. 36/CP of April 24, 1997 of the Government;

Pursuant to the Regulation on the Management of Investment and Construction issued together with Decree No. 42/CP of July 16, 1996 and Decree No. 92/CP of August 23, 1997 of the Government;

At the proposal of the President of the People’s Committee of Quang Ngai province (in Report No. 836/TT-UB of May 22, 1998, Official Dispatch No. 1985/UB of November 17, 1998 and the Additional Report No. 673/TT-UB of April 3, 1999), as well as the evaluation comments of the Minister of Planning and Investment (in Report No. 9045/ BKH/VPTD of December 26, 1998),

DECIDES:

Article 1.- To set up Quang Phu Industrial Park in Quang Ngai province.

Quang Phu Industrial Park shall be organized and operate in accordance with the Regulation on Industrial Parks, Export-Processing Zones, Hi-Tech Parks issued together with Decree No. 36/CP of April 24, 1997 of the Government.

Quang Phu Industrial Park shall be placed under direct State management by the Board for Management of Industrial Parks in Quang Ngai.

Article 2.- To ratify the investment project on infrastructure construction and business (stage I) in Quang Phu Industrial Park, Quang Ngai province, with the following contents:

1. Name of the project: Investment project on infrastructure construction and business in Quang Phu Industrial Park, Quang Ngai province.

2. Project owner: Quang Ngai Sugar Company (under the Ministry of Agriculture and Rural Development) which is headquartered in Quang Phu commune, Quang Ngai provincial town, Quang Ngai province.

3. Project’s objectives: To level the ground, to build traffic, water and power supply, information and communication and waste treatment systems... aimed at doing business with infrastructure built in the industrial park.

4. Construction location: Quang Phu commune (Quang Ngai town) and Nghia Ky, Nghia Dien communes (Tu Nghia district), Quang Ngai province.

5. Used land area: Total land area is 138.6 ha, that shall be divided into 3 investment stages. In which, 56.6 ha is used for the stage-I investment construction.

This area shall be re-determined at the time of filling the land lease procedures according to the Land Law.

6. Total investment capital of stage I: 43.8 billion VND.

7. Capital sources: Own capital, advance capital of investors and borrowed capital.

8. Stage-I investment timetable: The project shall be implemented in 4 years from the date the investment decision is issued.

9. Duration of operation: 50 years from the date the investment decision is issued.

Article 3.- Quang Ngai Sugar Company (under the Ministry of Agriculture and Rural Development) shall be entitled to borrow the State’s preferential investment and development credit capital for construction of infrastructure in Quang Phu Industrial Park, and shall be eligible for preferences under the Law on the Domestic Investment Promotion.

Article 4.- The President of the People’s Committee of Quang Ngai province and the Minister of Agriculture and Rural Development shall have to direct the investor to execute the project in accordance with the current regulations; to elaborate a master plan for the development of the infrastructure outside the project’s perimeter in compatibility with the infrastructure inside the perimeter so as to ensure efficient operation of the industrial park.

Article 5.- This Decision takes effect 15 days after its signing.

Article 6.- The President of the People’s Committee of Quang Ngai province, the Minister of Planning and Investment, the Minister of Agriculture and Rural Development, the Minister of Finance, the Minister of Construction, the Minister of Industry, the Minister of Defense, the Minister of Science, Technology and Environment, the General Director of Land Administration, the Governor of Vietnam State Bank, the chairman of the Board for Management of Vietnam’s Industrial Parks, the chairman of the Board for Management of Quang Ngai Industrial Parks, the Director of Quang Ngai Sugar Company, the heads of the concerned agencies shall, within their functions and powers, have to implement this Decision.
