DECREE No. 86-CP ON THE 12TH OF AUGUST 1994 ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATION OF THE STATE PLANNING COMMITTEE

THE GOVERNMENT

Pursuant to the Law on Organization of the Government on the 30th of September 1992;

Pursuant to Decree No. 15-CP on the 2nd of March 1993, of the Government on the Tasks, Powers and State Management Responsibilities of the ministries and agencies at Ministerial Level;

Considering the proposals by the Minister-Chairman of the State Planning Committee and the Minister-Chairman of the Government Commission on Organization and Personnel.

DECREES:

Article 1.- The State Planning Committee is a Government agency and has the function of providing overall recommendations on the strategies, schemes and plans for socio-economic development for the whole country and on the mechanism for economic management; and assisting the Government in coordinating and directing the implementation of the targets and main balances of the economy.

Article 2.- The State Planning Committee shall perform the tasks, powers and State management responsibilities of the ministries and agencies at ministerial level stipulated in Decree No. 15-CP on the 2nd of March 1993, of the Government and the following main tasks:

1. To organize researches on and build the master strategy and plan for socio-economic development of the whole country and the socio-economic plans for branches and territorial areas for submission to the Government.

2. To synthesize all resources of the country, including resources from outside the country, to design for submission to the Government medium - and short-term plans for socio-economic development of the whole country and the main balances of the national economy: the balances between accumulation and consumption, between finance and montary, between goods and materials, import and export, capital for infrastructure construction and in a number of major goods and materials of the economy. To coordinate with the Ministry of Finance in planning revenues and expenditures of the State budget for the ministries, branches and localities for submission to the Government.

3. To provide the guidance for the ministries, agencies at ministerial level, agencies attached to the Government and the People’s Committees of provinces and cities directly under the Central Government in building and balancing plans in compliance with the strategy for socio-economic development of the whole country as well as plans of each economic branch and territorial area, which have already been approved.

4. To conduct research on and draft for submission to the Government laws, ordinances, mechanisms and policies for economic management in the realization of the economic structure, strategy, schemes and plans in the socio-economic development, by assignment from the Government.

To conduct research on and build procedures and methods for planning.

5. To provide guidance for and exercise control over the ministries, agencies at ministerial level, agencies attached to the Government and the People’s Committees of provinces and cities directly under the Central Government in the implementation of their socio-economic schemes and plans.

To regulate and coordinate the implementation of the major balances of the national economy, and be responsible for conducting the implementation of plans in a number of fields on appointment by the Government.

6. To submit for Prime Minister decision on the use of the State reserve.

7. To organize forecasting researches and to gather and assess information on socio-economic development at home and abroad to support the building and implementation of plans.

8. To organize personnel training and fostering as required by the new situation and tasks.

9. To preside over the Councils for: State-level evaluation and approval of economic and technical norms, evaluation of State-level investment projects, evaluation of direct in vestment projects under the Law on Foreign Investment projects under the Law on Foreign Investment and projects of ODA by assignment from the Government, national-level bidding, evaluation for establishment of State enterprises; and act as the coordinator in the management and utilization of the ODA resources.

Article 3.- The apparatus of the State Planning Committee is composed of:

1. The Central Institute of Economic management (equivalent to Level-1 General Department).

2. The Institute of Development Strategy (equivalent to Level-1 General Department).

3. The Department of External Economic Affairs.

4. The Department of General Affairs of National Economy.

5. The Department of Local and Territorial Economies.

6. The Department of Planning.

7. The Department of Finance and Montary.

8. The Department of Agriculture, Forestry and Fisheries.

9. The Department of Industry.

10. The Department of Trade and Services.

11. The Department of Infrastructure.

12. The Department of Labor, Culture and Social Affairs.

13. The Department of Science, Education and Environment.

14. The Department for Relations with Laos.

15. The Department of National Defense and Security.

16. The Department of Organization, Personnel and Training.

17. The Bureau for Evaluation of Investment Projects.

18. The National Bureau of Bidding Evaluation.

19. The Office of the Committee.

20. The Center for Research on Southern Economy.

21. The Information Center (including the Economy & Forecasts magazine).

22. The School of Planning.

The tasks, organizational structures and payrolls of the above-said units shall be defined by the Minister-Chairman of the State Planning Committee, within the framework of the overall payroll of the Committee already approved by the Government.

Article 4.- The Minister-Chairman of the State Planning Committee shall, after consulting with the Minister-Chairman of the Government Commission on Organization and Personnel, provide guidance on the tasks and organizational structures of the Planning Services of provinces and cities directly under the Central Government.

Article 5.- This Decree takes effect as from the date of its issuance. Decree No 49-CP of the 25th of March, 1974, of the Government Council and the other previous provisions on the tasks and organizational structure of the State Planning Committee which are contrary to this Decree are now annulled.

Article 6.- The Minister-Chairman of the State Planning Committee, the other ministers, the heads of agencies at ministerial level, the heads of agencies attached to the Government and the presidents of the People’s Committees of provinces and cities directly under the Central Government are responsible for the implementation of this Decree.
