DECISION No.242-TTg ON THE 27TH OF APRIL 1995 OF THE PRIME MINISTER ON THE FUNCTION, TASKS, POWERS, ORGANIZATIONAL STRUCTURE AND WORKING REGIME OF THE RADIO FREQUENCY COMMITTEE THE PRIME MINISTER Pursuant to the Law on Organization of the Government on the 30th of September 1992; Pursuant to the Regulations on the Post and Telecommunication Service issued together with Decree No.121-HDBT on the 15th of August 1987; Pursuant to Decree No.28-CP on the 24 of May 1993 of the Government on the function, tasks, powers and the organizational apparatus of the General Post Office; Pursuant to Decision No.75-CT on the 29th of March 1989 of the Chairman of the Council of Ministers on the establishment of the Radio Frequency Committee; At the proposal of the Director General of the General Post Office, the Chairman of the Radio Frequency Committee and the Minister-Chairman of the Government Commission on Organization and Personnel, DECIDES : Article 1.- The Radio Frequency Committee has the following tasks and powers : 1. To organize the coordination among different agencies in the elaboration of the strategy and plan for the exploitation, distribution and use of radio frequencies; work out the national technical norms on frequencies; make suggestions to the Prime Minister on the ratification of the projects related to these questions. 2. To supervise the coordination among the related branches in settling cases of harmful interference, and work out solutions to ensure safety for the radio frequency bands among the information networks of the defense, the interior and civilian services. 3. To coordinate the work of the defense, the interior and postal service in the control of radio frequencies, and carry out control to handle the violations in order to ensure information safety and national security. Article 2.- The Radio Frequency Committee comprises the following members : + Chairman of the Radio Frequency Committee : the Director General of the General Post Office; + The Vice-Chairmen of the Committee : A Vice-Minister of the Interior, A Vice-Minister of Defense, A Deputy Director General of the General Post Office. The other members of the Committee : - The Commander of the Information and Communications Force of the Ministry of Defense, - The Director of the Specialized and Technical Department I of the Ministry of the Interior, - The Director of the Technology Development Department of the Ministry of Science, Technology and Environment, - A Deputy-Head of the Coded Communication Commission of the Government, - The Director of the Radio Frequency Department of the General Post Office. The Government Commission on Organization and Personnel shall submit a proposal to the Prime Minister for decision on the appointment and dismissal of the members of the Committee as proposed by the Chairman of the Radio Frequency Committee. The Chairman of the Committee shall define a concrete plan for assignment of responsibilities to each member and report it to the Prime Minister. Article 3.- The working office of the Radio Frequency Committee is established at the General Post Office. The general operational budget of the Committee shall be provided by the State through the accounts of the General Post Office. The Committee is allowed to use its own seal as prescribed by law. Article 4.- The organizations assisting the Radio Frequency Committee shall comprise the Office and specialized sub-commissions. The responsible persons and staff of these organizations shall work part-time, and are appointed by the Chairman of the Radio Frequency Committee according to a plan adopted by the Committee. Article 5.- The members of the Committee shall work according to the regime of cumulation of responsibilities and according to the assignment of work by the Committee. The Radio Frequency Committee shall meet regularly every six months. It shall adopt the system of collective work, and the decisions of the Committee shall be adopted by consensus. With regard to important issues related to many branches, the Committee must report to the Prime Minister before taking any decision. After approval by the Prime Minister, the Committee must notify the related branches of the contents of such decision. Article 6.- The Chairman of the Radio Frequency Committee shall decide the concrete working regulations for the Committee and the tasks and powers of the assisting organizations. Article 7.- This Decision takes effect from the date of its promulgation. The earlier regulations which are contrary to this Decision are now annulled. Article 8.- The Chairman of the Radio Frequency Committee, the Heads of the agencies mentioned in Article 1, the Ministers, the Heads of the ministerial-level agencies, the Heads of the agencies attached to the Government, the Presidents of the People's Committees of the concerned provinces and cities directly under the Central Government shall have to implement this Decision.
