DIRECTIVE No. 05/2001/CT-TCBD OF FEBRUARY 21, 2001 ON THE GOODS LABELING OF HOME-MADE AND IMPORTED SUBSCRIBED END-TERMINAL TELECOMMUNICATIONS EQUIPMENT In furtherance of the Regulation on goods labeling promulgated together with the Prime Minister’s Decision No. 178/1999/QD-TTg of August 30, 1999 and Decision No. 95/2000/QD-TTg of August 15, 2000, the General Department of Post and Telecommunications promulgated on July 26, 2000 Circular No. 03/2000/TT-TCBD and on September 11, 2000 Circular No. 05/2000/TT-TCBD guiding the goods labeling of home-made and imported end-terminal subscribed telecommunications equipment. Prompted by the slow enforcement of the Regulation, due to its generality and some inappropriate points, the Prime Minister issued on December 27, 2000 Directive No. 28/2000/CT-TTg on the implementation of the Regulation on goods labeling promulgated together with Decision No. 178/1999/QD-TTg of August 30, 1999. In spirit of the Prime Minister’s Directive No. 28/2000/CT-TTg of December 27, 2000 and with a view to well carrying out the goods labeling of subscribed end-terminal telecommunications equipment of all kinds, the General Director of Post and Telecommunications gives the following instructions: 1. Regarding organizations and individuals that produce, trade in and import subscribed end-terminal telecommunications equipment: a/ They shall strictly carry out the goods labeling of home-made or imported subscribed end-terminal telecommunications equipment according to the provisions of Circular No.03/2000/TT-TCBD and Circular No.05/2000/TT-TCBD of the General Department of Post and Telecommunications. b/ For subscribed end-terminal telecommunications equipment with their old labels printed before January 1, 2001 and still left in stock, the producing, trading and importing organizations and individuals shall have to additionally inscribe such equipment’s labels according to the provisions of Circular No.03/2000/TT-TCBD and Circular No.05/2000/TT-TCBD of the General Department of Post and Telecommunications. c/ They shall report on the goods labeling of subscribed end-terminal telecommunications equipment at requests of the competent bodies and create favorable conditions for the State management bodies to inspect the goods labeling situation. d/ Organizations and individuals are strictly prohibited to print and use labels of subscribed end-terminal telecommunications equipment not in compliance with the provisions of Circular No.03/2000/TT-TCBD and Circular No.05/2000/TT-TCBD of the General Department of Post and Telecommunications. e/ For subscribed end-terminal telecommunications equipment made in Vietnam for export, which are required by foreign customers to be affixed with specific equipment labels, their original equipment labels shall be added with the following inscription: "Made in Vietnam" or "Product of Vietnam". Other contents may be inscribed at the importing customers’ labeling requests. f/ Any problems arising in the course of implementation should be reported to the General Department of Post and Telecommunications for consideration and solution. 2. Regarding the State management bodies under the General Department of Post and Telecommunications: a/ They shall, within the ambit of their assigned responsibilities, coordinate with the concerned competent local bodies in taking measures to implement, disseminate and guide the goods labeling of subscribed end-terminal telecommunications equipment according to Circular No.03/2000/TT-TCBD and Circular No.05/2000/TT-TCBD of the General Department of Post and Telecommunications. b/ They shall enhance the inspection and examination of the goods labeling of subscribed end-terminal telecommunications equipment by producing, trading in and importing organizations and individuals; and promptly handle cases of violation. c/ They shall have to promptly disseminate management documents on goods labeling issued by the General Department of Post and Telecommunications to organizations and individuals producing, trading in and importing subscribed end-terminal telecommunications. The General Director of Post and Telecommunications requests the units attached the General Department of Post and Telecommunications, organizations and individuals that produce, trade in and import subscribed end-terminal telecommunications to strictly implement this Directive.
