DECREE No. 46-CP ON THE 4TH OF JUNE 1994 OF THE GOVERNMENT ON THE PROVISIONAL ADJUSTMENT OF THE ONE-TIME-ONLY DEATH BENEFITS FOR SOLDIERS AND MEMBERS OF THE PEOPLE'S SECURITY WHO DIED WHILE IN ACTIVE SERVICE THE GOVERNMENT Pursuant to the Law on Organization of the Government on the 30th of September, 1992; Pursuant to Decree No. 66-CP of the Government on the 30th of September, 1993 providing the provisional regime of social insurance for the armed forces; At the proposal of the Minister of Defense, the Minister of the Interior, the Minister of Labor, War Invalids and Social Affairs, and the Minister of Finance; DECREES: Article 1.- The following provisional adjustments are made to the one-time-only death benefits for soldiers and members of the People's Security who died while in active service stipulated in Article 17 of Decree No 66-CP on the 30th of September, 1994 of the Government. "... In the event that the deceased has no close relative qualified to receive the monthly death benefits, or that the deceased has not contributed to the social insurance fund for 15 years, then the family of the deceased shall receive the one-time-only death benefits as specified below: - Survivors of soldiers or members of the People's Security who died while in active service shall receive an amount equal to one-half (1/2) of the monthly salary multiplied by the number of years the deceased has contributed to the social insurance fund. This amount shall not be higher than twelve months of salary nor lower than 6 months minimum salary of a government worker. Article 2.- This Decree takes effect on the date of its signing. This Decree is applicable to those instances specified in Article 1 of this Decree occurring between the 1st of April, 1993 and the date when this Decree takes effect. Article 3.- The ministers, the heads of ministerial-level agencies, the heads of organs attached to the Government, the Chairman of the People's Committees of provinces and of cities directly attached to the Central Government are responsible for implementing this Decree.
