DECISION No.75-TTg OF FEBRUARY 3, 1997 OF THE PRIME MINISTER ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE VIETNAM REGISTRATION AND INSPECTION DEPARTMENT THE PRIME MINISTER Pursuant to the Law on Organization of the Government of September 30, 1992; Pursuant to Decree No.22-CP of March 22, 1994 of the Government on the tasks, powers, State management responsibilities and organizational structure of the Ministry of Communications and Transport; At the proposals of the Minister of Communications and Transport and the Minister-Chairman of the Government Commission on Organization and Personnel, DECIDES: Article 1.- The Vietnam Registration and Inspection Department is attached to the Ministry of Communications and Transport and shall assist the Minister of Communications and Transport to perform the function of specialized management over registration and inspection of technical safety and certification of the quality of the equipment and means of marine, land, railway, internal waterway communications and transport, offshore rigs, floating structures and facilities and a number of equipment related to communications and transport safety. The Vietnam Registration and Inspection Department has the legal status, its own seal, its bank account and its head office located in Hanoi city. The Vietnam Registration and Inspection Department has its transaction name of Vietnam Register, VR for short. Article 2.- The Vietnam Registration and Inspection Department has the following main tasks and powers: 1. To elaborate and participate in the elaboration of legal documents, policies, regimes, regulations, economic and technical norms regarding the registration and inspection of technical safety and certification of the goods quality of equipment and means of marine, land, railway, internal waterway communications and transport, offshore rigs, floating structures and facilities and other equipment related to the safety of communications and transport which shall be submitted to the Minister of Communications and Transport for promulgation according to his/her jurisdiction or to be submitted by the Ministry of Communications and Transport to the Prime Minister for decision. The Department shall organize the implementation of the above-said issues after they are promulgated by the Ministry of Communications and Transport or the competent authority. 2. To organize the registration and inspection of technical safety, as follows: a/ Registration and inspection of ships in Vietnam in accordance with the provisions of Decision No.203-TTg of December 28, 1992 of the Prime Minister on ship registration and inspection in Vietnam. b/ Means and equipment for land, railway, internal waterway communications and transport and equipment for lifting cargo of 1 tone or more, according to the Governments provisions and assignment of the Ministry of Communications and Transport. c/ Offshore rigs and accompanying equipment. d/ Floating structures and facilities. e/ Steamers and pressurized equipment fixed on communications and transport at means. f/ Containers of various kinds used in the communications and transport service. 3. To perform the following tasks as provided for by law and assigned by the Ministry of Communications and Transport: a/ To assess or participate in the assessment of projects on technical designs for the manufacture, assembly and improvement of transport means, offshore rigs and related systems and equipment. b/ To conduct technical inspection of the manufacture, assembly, improvement, repair, use, import and export of communications and transport means and equipment, offshore rigs. c/ To grant and withdraw certificates: registrar-inspector, product quality, technical safety and properties of communications and transport means according to the Departments responsibility and the provisions of the Vietnamese law and international treaties which Vietnam has acceded to. To inspect and grant certificates of technical safety-control systems to those enterprises the products of which are subject to the technical inspection by the Department in accordance with the provisions of Vietnamese law and related international laws (ISM Code) which Vietnam has acceded to. 4. To inspect and examine the observance of laws and policies on the registration and inspection of technical safety, product quality of communications and transport means and participate in the technical assessment of incidents and accidents caused by transport means. 5. To organize the application of technical and technological advances to the registration and inspection as well as international cooperation in the registration and inspection field. 6. To organize the collection of charges and registration and inspection fees. 7. To manage the Departments organizational apparatus, its personnel and properties in accordance with the provisions of the State. To organize the training and fostering of officials and employees of the Department in registration and inspection skills. Article 3.- The organizational structure of the Vietnam Registration and Inspection Department comprises: 1. The Head and Deputy Heads assisting the Head. The Head shall be answerable to the Minister of Communications and Transport for all the Departments activities. The Deputy Heads shall take responsibility before the Head for their assigned tasks. The Heads and Deputy Heads of the Department shall be appointed or dismissed by the Minister of Communications and Transport. 2. The specialized organizations to assist the Department Head include the Office of the Department and specialized sections, boards, its branches, regional specialized registration and inspection services which shall be decided by the Minister of Communications and Transport. Article 4.- The Minister of Communications and Transport shall, basing himself on the Ministrys functions and tasks of the management of the registration and inspection and this Decision, issue detailed provisions on the tasks, powers and organizational structure of the Vietnam Registration and Inspection Department. Article 5.- This Decision takes effect from the date of its signing for promulgation. The earlier provisions which are contrary to this Decision are now annulled. The Minister of Communications and Transport, the Ministers, the Heads of the ministerial-level agencies and the agencies attached to the Government, the President of the Peoples Committee of the provinces and cities directly under the Central Government shall have to implement this Decision.
