DECISION No. 587/2002/QD-BLDTBXH OF MAY 22, 2002 PROMULGATING POOR COMMUNE CRITERIA FOR THE 2001-2005 PERIOD

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Law on Organization of the Government of December 25, 2001;

Pursuant to the Government’s Decree No. 96/CP of December 7, 1993 on the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;

Pursuant to the Prime Minister’s Decision No. 143/2001/QD-TTg of September 27, 2001 approving the national target program on hunger elimination, poverty alleviation and employment in the 2001-2005 period;

Pursuant to the Government Office’s Notice No. 63/TB-VPCP of April 5, 2002 on the conclusion of Deputy Prime Minister Nguyen Cong Tan at the March 11, 2002 meeting of the Managing Board of the national target program on hunger elimination, poverty alleviation and employment;

After gathering comments from the ministries, branches and mass organizations,

DECIDES:

Article 1.- To promulgate poor commune criteria (outside Program 135) under the Prime Minister’s Decision No. 143/2001/QD-TTg of September 27, 2001 approving the national target program on hunger elimination, poverty alleviation and employment in the 2001-2005 period:

Poor communes mean those which:

1. Have the poor households rate of 25% or higher;

2. Have less than 3 out of 6 essential infrastructure items (including traffic roads; schools; health stations; daily-life water; daily-life electricity; and markets), more concretely:

+ Less than 30% of the households use clean water;

+ Less than 50% of the households use daily-life electricity;

+ There are yet motorways leading to commune centers, or where automobiles are inaccessible to all the year round;

+ The number of classrooms (under the regulations of the Ministry of Education and Training) meets only less than 70% of the pupils’ demand, or they are makeshift classrooms made of thatch, bamboo, neohouzeaua or trees’ leaves;

+ There are no commune health stations, or the commune health stations are available but only makeshift;

+ There are no markets, or only makeshift markets.

Article 2.- Basing themselves on the criteria prescribed in Article 1 of this Decision, the presidents of the People’s Committees of the provinces or centrally-run cities shall direct and conduct survey for determination of poor communes in their respective localities; sum up the lists of poor communes and report them to the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Agriculture and Rural Development in July of 2002, which shall serve as basis for the elaboration of plans to support poor communes in the 2002-2005 period.

Article 3.- This Decision takes effect 15 days after its signing.
