THE MINISTRY OF FINANCE DECISION No.127/1999/QD-BTC OF OCTOBER 22, 1999 PROMULGATING THE BRACKET OF CHARGES AND FEES APPLICABLE TO SECURITIES MARKET ACTIVITIES THE MINISTER OF FINANCE Pursuant to the Government’s Decree No.15/CP of March 2, 1993 on the tasks, powers and State management responsibilities of the ministries and ministerial-level agencies; Pursuant to the Government’s Decree No.178/CP of October 28, 1994 on the tasks, powers and organizational structure of the Ministry of Finance; Pursuant to the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the fees and charges belonging to the State budget; Pursuant to the Government’s Decree No.48/1998/ND-CP of July 11, 1998 on securities and securities market; After consulting the State Securities Commission (in Official Dispatch No.141/UBCK of October 14, 1999); At the proposal of the General Director of Tax, DECIDES: Article 1.- To promulgate together with this Decision the bracket of charges and fees applicable to securities market activities. Article 2.- The agency(ies) collecting the charges and fees for the State management over securities market activities shall carry out the registration, declaration and payment of fees with the tax authorities of localities where such fees are to be collected according to provisions of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999 guiding the Government’s Decree No.04/1999/ND-CP of January 30, 1999 on the fees and charges belonging to the State budget. Article 3.- Organizations and individuals engaged in securities market activities shall have to pay charges and fees stipulated in this Decision. Article 4.- The agency(ies) collecting charges and fees for securities activities may deduct 10% of the collected charge and fee amount to cover the collection-organizing expenses according to provisions at Point 5.b, Section III of the Ministry of Finance’s Circular No.54/1999/TT-BTC of May 10, 1999. Particularly for the securities trading centers, the deduction levels shall comply with the provisions at Point 3c, Section II of the Ministry of Finance’s Circular No.10/1999/TT-BTC of January 29, 1999 provisionally guiding the financial management regime applicable to the Securities Trading Centers. Article 5.- This Decision takes effect 15 days after its signing. Article 6.- Organizations and individuals liable to pay charges and fees for securities activities, units tasked by the State Securities Commission to organize the collection of charges and fees, and the concerned agencies shall have to implement this Decision.
