DECISION No.96-TM/XNK ON THE 14th OF FEBRUARY 1995 PUBLICIZING THE LIST OF COMMODITIES BANNED FROM EXPORT AND IMPORT THE MINISTER OF TRADE Pursuant to Decree No.95-CP on the 4th of December 1993 of the Government on the functions, tasks, powers and organization of the apparatus of the Ministry of Trade; Pursuant to Article 5 of Decision No.752-TTg on the 10th of December 1994 of the Prime Minister on the commodity policy and the running of import-export operations in 1995; Proceeding from the opinion of the Prime Minister in official dispatch No.294/KTTH on the 19th of January 1995. DECIDES: Article 1.- To publicize together with this Decision: The list of commodities banned from export and import. Article 2.- This list of commodities shall apply to all forms of export and import, and takes effect as from the 1st of April 1995. Article 3.- The specialized agencies under the Ministry of Trade and the juridical persons, and those engaged in export and import activities shall have to implement this Decision. Article 4.- This list replaces "The list of commodities banned from export and import" issued together with Decision No.238-TM/XNK on the 24th of March 1994 by the Ministry of Trade. LIST OF COMMODITIES BANNED FROM EXPORT AND IMPORT (Issued together with Decision No.96-TM/XNK on the 14th of February 1995 of the Minister of Trade) I. COMMODITIES BANNED FROM EXPORT: 1. Weapons, ammunition, explosive, military technical equipment. 2. Antiques. 3. Narcotics of all kinds. 4. Toxic chemicals. 5. Logs, sawn timber, semi-finished wood products, unprocessed rattan. 6. Wild animals, and rare and precious animals and plants. II. COMMODITIES BANNED FROM IMPORT: 1. Weapons, ammunition, explosive, military technical equipment. 2. Narcotics of all kinds. 3. Toxic chemicals. 4. Depraved and reactionary cultural products. 5. Firecrackers. Children's toys which might adversely affect their ethical education, or social order and safety. 6. Cigarettes (exclusive of the allowed quantity for each personal baggage). 7. Used consumer goods (except for cars of less than 12 seats, mopeds and motorcycles, property on transfer and personal baggage according to allowed amount). 8. Vehicles and other self-propelled means with right-handed drive (including disassembled cars and accessories). Notes: 1. When security, defense or other needs arise, the exportation and importation of goods listed above shall be allowed in writing by the Prime Minister. 2. The ban on the export of wild animals as required by the protection of the ecology shall be guided by the Ministry of Forestry together with the Ministry of Science, Technology and Environment in separate documents. 3. After consulting the Ministries managing the production and the Ministry of Trade, the Ministry of Science, Technology and Environment shall compile and publish the document guiding the importation of used complete equipment as well as of used individual machines. 4. After consulting the Ministry of Trade and the Ministry of Foreign Affairs, the General Customs Department shall publish the document to guide the implementation of the Item "property on transfer" plementation of the Item "property on transfer" mentioned in the last part of Point II/7).-
