DECISION No. 65/2002/QD-BKHCNMT OF AUGUST 19, 2002 PROMULGATING THE LIST OF MEASURING DEVICES SUBJECT TO EXPERTISE AND EXPERTISE REGISTRATION THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT Pursuant to the Measurement Ordinance of October 6, 1999; Pursuant to the Government’s Decree No.22/CP of May 22, 1993 on the tasks, powers and organizational structure of the Ministry of Science, Technology and Environment; Pursuant to Article 12 of the Government’s Decree No.06/2002/ND-CP of January 14, 2002 detailing the implementation of the Measurement Ordinance; At the proposal of the general director of Standardization, Metrology and Quality Control, DECIDES: Article 1.- To promulgate together with this Decision the List of measuring devices subject to expertise and expertise registration. Article 2.- The General Department of Standardization, Metrology and Quality Control shall have to guide and inspect the implementation of this Decision. Article 3.- This Decision takes effect 15 days after its signing and replaces Decision No.2537/1998/QD-BKHCNMT of December 31, 1998 of the Minister of Science, Technology and Environment promulgating the List of measuring devices subject to the State expertise. Article 4.- The General Department of Standardization, Metrology and Quality Control, the Sub-departments of Standardization, Metrology and Quality Control and the concerned organizations and individuals shall have to implement this Decision. For the Minister of Science, Technology and Environment LIST OF MEASURING DEVICES SUBJECT TO EXPERTISE AND EXPERTISE REGISTRATION (Promulgated together with Decision No.65/2002/QD-BKHCNMT of August 19, 2002 1. List of measuring devices subject to expertise: 1.1. Measuring devices used for the purpose of quantifying goods and services in trading and payment; measuring devices directly related to the safety assurance, health and environmental protection are specified in the following list:
1.2. Standards used for expertising measuring devices on the above list must also be expertised. The expertise cycles shall comply with the standardized expertising process promulgated by the General Department of Standardization, Metrology and Quality Control. 1.3. Measuring devices, which are not on the above list but used for the judicial expertise and other public-service activities of the State, must be expertised on a case-by-case basis. The General Department of Standardization, Metrology and Quality Control shall have to organize the performance of this job at requests of the concerned State agencies. 2. Registration for measuring device expertise 2.1. General provisions 2.1.1. Expertise registration objects Organizations and individuals (collectively referred to as establishments) that manufacture, repair, import and use measuring devices on the list of measuring devices subject to expertise shall make the expertise registration with the competent expertising organizations according to the following regulations: a/ Establishments manufacturing and/or importing measuring devices must register for initial expertise; b/ Establishments using measuring devices must register for periodical expertise; c/ Establishments repairing measuring devices must register for extraordinary expertise. 2.1.2. For measuring devices which are newly manufactured or imported or which, after being repaired, can be expertised only at places where they are installed for operation, the measuring device-using establishments shall register for initial or extraordinary expertise with organizations licensed to expertise such type of measuring device. 2.1.3. Depending on the already recognized or authorized expertising capabilities of expertising organizations, establishments may choose places to register expertise most convenient for their business, manufacture and use. 2.1.4. Expertising organizations shall have to receive and satisfy requests for expertise of measuring devices of establishments in suitability with their recognized or authorized expertising capabilities. For measuring devices beyond their expertising capabilities, expertising organizations shall guide establishments to make registration with the nearest expertising organization which is capable of expertising such measuring devices. 2.1.5. Expertising organizations shall have to collect and manage expertise charge according to the current regulations. 2.2. Registration mode: 2.2.1. When wishing to have measuring devices expertised in large quantities, establishments shall have to send written registrations for measuring device expertise to expertising organizations (made according to the set form). Within 10 days after receiving written expertise registrations of establishments, expertising organizations shall have to notify such establishments of specific plans for expertise performance and preparatory works. 2.2.2. In cases where the expertise demand is single and simple, establishments may notify expertising organizations before carrying their measuring devices to the latter without having to make advance registration. Expertising organizations shall have to satisfy such demand within their own expertising capabilities and plans. For the Minister of Science, Technology and Environment
