DECREE No.32-CP ON THE 22ND OF MAY 1995 OF THE GOVERNMENT TO PLACE THE VIETNAM CIVIL AVIATION DEPARTMENT UNDER THE DIRECT CONTROL OF THE GOVERNMENT THE GOVERNMENT Pursuant to the Law on Organization of the Government on the 30th of September 1992; In implementation of the Law on Amendments to a Number of Articles of the Law on Vietnam Civil Aviation on the 20th of April 1995 which stipulates that the office that performs the function of State management of civil aviation is attached to the Government, DECREES: Article 1.- To transfer the Vietnam Civil Aviation Department from the Ministry of Transport and Communication to the direct control of the Government in order to perform the function of specialized State management over the civil aviation service. The Ministry of Transport and Communication is responsible for turning over the whole organizational apparatus, personnel, material and technical bases, documents and the function of State management of civil aviation to the Vietnam Civil Aviation Department. Article 2.- The Government Commission on Organization and Personnel, together with the Vietnam Civil Aviation Department, shall draft a decree to stipulate the function, tasks, powers and organizational structure of the Vietnam Civil Aviation Department, and submit it to the Government for approval. Article 3.- This Decree takes effect as from the date of its issuance. The earlier regulations which are contrary to this Decree are now annulled. The Minister of Transport and Communication, the Director of the Vietnam Civil Aviation Department, the Minister-Chairman of the Government Commission on Organization and Personnel and the other Ministers, the Heads of the agencies at ministerial level, the Heads of the agencies attached to the Government, and the Presidents of the People's Committees of the provinces and cities directly under the Central Government are responsible for implementing this Decree.
