DECISION No.507-TTg OF AUGUST 26, 1995 OF THE PRIME MINISTER TRANSFERRING STATE MANAGEMENT RESPONSIBILITY OVER THE DA RIVER, THACH NHAM, DAU TIENG AND TRI AN PROTECTIVE FOREST BUILDING PROJECTS TO THE PEOPLE'S COMMITTEES OF THE PROVINCES IN THE PROJECT AREAS THE PRIME MINISTER Pursuant to the Law on Organization of the Government of September 30, 1992; At the proposal of the Minister of Forestry made in Report No.1805-TCLD of June 30, 1995, and considering the comments of the State Planning Committee in its Official Dispatch No.2189-UB/NLN of July 5, 1995, and of the Ministry of Construction in its Official Dispatch No.1158-BXD/CSXD of August 10, 1995, DECIDES: Article 1.- To transfer the State management responsibility over the Da River, Thach Nham, Dau Tieng, Tri An protective forest building projects from the Ministry of Forestry to the People's Committees of the provinces in their respective localities, in accordance with Decision No.354-CT of December 11, 1989, Decision No.219-CT of June 15, 1990, Decision No.89-CT of April 2, 1991, Decision No.229-CT of July 27, 1991, and Decision No.71-CT of March 5, 1992 of the Chairman of the Council of Ministers (now the Prime Minister), under the following terms: 1. The Da River upstream protective forest building project is now placed under the management of the People's Committees of 5 provinces: Hoa Binh, Son La, Lai Chau, Lao Cai and Yen Bai. 2. The Thach Nham protective forest building project is now placed under the management of the People's Committees of 2 provinces: Quang Ngai and Kon Tum. 3. The Dau Tieng protective forest building project is now placed under the management of the People's Committees of 2 provinces: Song Be and Tay Ninh. 4. The Tri An protective forest building project is now placed under the management of the People's Committees of the 3 provinces: Dong Nai, Lam Dong and Binh Thuan. Article 2.- The Ministry of Forestry has the responsibility to transfer to the People's Committees of the above-said provinces all the documents of each province's project, the investment achievements up to December 31, 1994, and the 1995 plan. The transfer shall be completed in 1995. After the completion of the transfer, the Ministry of Forestry shall have to conduct, supervise and assure the development of the above-said protective forest building projects in accordance with the objectives and plans already approved; to dissolve the Managing Board of afforestration projects attached to the Ministry; and at the same time to reinforce the experts group in charge of Program No.327 in order to assist the Ministry in conducting and supervising key protective forest building projects. Wages and other expenses for the reinforced experts group shall be deducted from the budget for the management of Program No.327, which is managed by the Ministry of Forestry. Article 3.- The People's Committees of the concerned provinces shall have to receive the project dossiers and the records on the investment results; to arrange, readjust (if necessary) and make it a separate project, on investment in and construction of protective forests in their respective localities, in accordance with the objectives and plans defined in Article 1, and under the guidance of the Central Steering Committee of Project No.327; to consolidate the existing Protective Forest Construction Managerial Boards in order to carry on the protective forest building projects transferred to them. Pending the arrangement, readjustment and separation, the projects' units and technical and economic plans being invested by communes and already approved by competent agencies shall continue to be invested in accordance with annual plan already approved. Article 4.- This Decision takes effect from the date of its signing. The Minister-Chairman of the State Planning Committee, the Minister of Forestry and the Ministers, the Heads of the ministerial-level agencies, the Heads of the relevant agencies attached to the Government, the Presidents of the People's Committees of the above-said provinces shall have to implement this Decision.
