2.5.2. A number of cases already stipulated by the Civil Code


  • As for cases of compensation for damage already stipulated in the Civil Code, the Judge must apply provisions of an appropriate article of the Civil Code. If a case is not stipulated in detail in a particular article, the Judge shall apply other provisions of the Civil Code.
  • Note that, when resolving a dispute over compensation for non-contractual damage, the Judge shall often have to resolve issues about the application of an insurance contract (as provided from Article 571 to Article 584 of the Civil Code).
