2.2.5. Composition of an Appellate Trial Panel. |

Main tasks and practical skills: In principle, an Appellate Trial Panel consists of three Judges, and two assessors if necessary. Practices of appellate hearing in recent years show that an Appellate Trial Panel often consists of three Judges. However, if the case is of a complex nature or involves a juvenile offender and the judge thinks there needs to be assessors, the Judge shall report to the Chief Justice or a person authorized by the Chief Justice the decision to establish an Appellate Trial Panel of three Judges and two Assessors. Noting that because the SPC and the Central Military Tribunal do not have Assessors, the above composition shall not apply to the Appellate Court of the SPC and the Central Military Tribunal. |
