Main tasks and practical skills
- Any citizen, body, organization or the convicted person shall have the right to discover fresh evidence in a case and notify it to the Procuracy or the Court. The Chief Procurator of the Procuracy which has the right to protest shall issue a decision verifying such facts (Item 1 of Article 292 of the CrPC).
- If there exists one of the grounds as provided in Article 291 of the CrPC, the Chief Procurator of the Procuracy shall issue the decision on protesting under the procedure for a new trial and transfer the case file to a Court that has jurisdiction to resolve it. If there does not exist any of the stipulated grounds, the Chief Procurator of the Procuracy shall explain the reason for not protesting the case to the citizen, body, organization or person who has discovered such facts (Item 2 of Article 292 of the CrPC).
