Main tasks and practical skills:
- Upon receipt of the case file, the appeal or protest and attached documents and evidence, the Court of Appeal must record it in the book of acceptance.
- The Chief Justice of the Court of Appeal or the Chief Justice of the Appellate Court of the Supreme People’s Court shall establish a Trial Panel and assign a Judge to preside at the trial.
- Upon acceptance of the case file (i.e. right after acceptance or during the preparation for appellate hearing), the Court of Appeal shall forward the case file to the Procuracy of the same level for its consideration (in cases where the Procuracy must attend the trial). The delivery and receipt of the case file must be made in writing and signed by the Court and the Procuracy.
- The Judge must request the Court Clerk to follow the resolution of the case file (Time limit for the Procuracy to study the case file shall be fifteen days from the date of receipt of the case file by the Procuracy; upon expiry of such time limit, the Procuracy must return the case file to the Court).
