Main tasks and practical skills:
- When starting the trial, instead of reading the decision on bringing the case to trial, the presiding Judge shall open the trial. The opening speech must consist of the following contents:
“Today, date … month… year…, The Court… (name of the Court of Appeal) hereby opens an appellate trial to hear the administrative case heard at first instance level by the People’s Court … (name of the Court of first instance) under Judgment No. … , date…, month…, year… due to the appeal, protest by… (This only refers to the proceeding status of the persons participating in the proceedings, for example “The petitioner”, “The petitioned”…; name of the protesting Procuracy). On behalf of the Trial Panel, I would like to open the trial”.
